HomeMy Public PortalAboutResolution No. 255-06 02-28-2006 RESOLUTION NO. 255-06 • A RESOLUTION AUTHORIZING A JOINT ELECTION BETWEEN THE CITY OF RICHLAND HILLS, TEXAS, AND THE BIRDVILLE INDEPENDENT SCHOOL DISTRICT (BISD) ON THE SECOND SATURDAY IN MAY FOR THE PURPOSE OF ELECTING CITY OFFICIALS OF THC CITY OF RICHLAND HILLS AND TRUSTEES TO THE BISD BOARD OF TRUSTEES; PROVIDING FOR A METHOD OF ALLOCATING ELECTION EXPENSES; AND ESTAB- LISHING RESPONSIBILITY FOR THE ELECTION SHOULD EITHER ENTITY CANCEL ITS ELECTION. WHEREAS, the City of Richland Hills, Texas, and the Birdviile independent School District desire to conduct joint elections pursuant to the provisions of the Texas Election Code, including the conduct of joint early voting and to pMovide forthe sharing of expenses; and, WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections upon the passage of a resolution by each of the governing bodies participating therein reciting the terms of the agreement, including the method for allocating expenses for the election and establishing responsibility for the election should either entity cancel its • election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, AND THE TRUSTEES OF THE BIRDVILLE INDEPENDENT SCHOOL DISTRICT THAT: Section 1. The City and the BISD shall hold a joint election on the second :~aturday in tvtay for the purpose of electing City Officials of the City of Richland Hills and Tr~~stees tc~ the BISD Board of Trustees. It is further agreed that such election shall be conducted by Tarrant County at such polling places as the City shall designate, utilizing the election officers appointed by Tarrant County and that early voting shall be conducted by the Tarrant County at such location as the County shall name. Section 2. Voting machines shall be utilized far the election itself and sE;parate ballots may be utilized containing all the offices and propositions to be voted ~~n ~~t each polling place, provided that no voter shall be given a ballot or permitted to utilize a machine capable of casting a vote for any office or proposition on which the voter is inelic.~ible to vote. Returns may be made on forms which are individual or combined, and the officers designated by law to be the custodian of records for the County, City and the school district shall be designated as the custodian of the respective records. Section 3. The expenses of the election shall be borne equally by the City and the BISD, and the BISD agrees to indemnify the City for the cost of any recount or election • contest required for officers or propositions to be voted on for the BISD. • RESOLUTION NO. 255-06 PAGE 2 Section 4. Should the County, the City or the BISD qualify under Section 2.051 of the Texas Election Code to cancel their election, notification of cancellation must be made the day following the last day to file for a place on the ballot, including the filing deadline for write-in candidates. Should any entity cancel its election, the remaining entities shall assume responsibility for the established early voting and election day voting location(s) and election expense. Section 5. This Agreement will continue in force until repealed by ofi`icial action and notification by either party.
