ORDINANCE VACATING PORTION OF COLLEGE STREET
SOUTH OF SIMPSON STREET NORTH OF HANNA STREET
WHEREAS Petitioner, DePauw University, a non - profit
corporation, having Petitioned the Common Council of the City of
Greencastle as follows, to -wit:
1. DePauw University, a non - profit corporation, is the
owner of certain Real Estate which is located in an area under
the jurisdiction of the Common Council of City of Greencastle.
2. There are certain public ways contiguous to said real
estate.
3. DePauw University, a non - profit corporation, desires to

vacate certain public ways as described in the Petition filed
herein on February 2, 1998 with the Clerk- Treasurer and forwarded
to the Greencastle Planning Commission pursuant to Greencastle
Code Section 10 -15, and which portion of public way to be vacated
is more particularly described in Exhibit A attached hereto.
4. The abutting land owners to the above described public
way other than DePauw University are:

5. That all of said public way to be vacated lies wholly
within the jurisdiction of the Common Council of the City of
Greencastle.
6. Having taken evidence and arguments, and being duly
advised, the Common Council of the City of Greencastle finds:
• a. Closing of the above public way is in the public
interest and economic interest of the City of Greencastle.
b. Such closing will not unreasonable interfere with the
® flow of traffic on the City of Greencastle road system.
WHEREAS, the Common Council of the City of Greencastle has
duly read, investigated and heard such Petition, and received the
recommendation of Greencastle Planning Commission.
IT IS THEREFORE ORDAINED the public way more particularly
described in the attached Exhibit A is hereby vacated, and that
such lands shall cease to be a public street or right -of -ways and
that title shall revert pursuant to law to DePauw University and
Phi Kappa Psi for valuable consideration and subject to an
easement for any existing utilities.

Beginning at the Southwest corner of Lot 210 in the Original Plat of the City of
• Greencastle; thence West 43.5 feet with the North i ight -of -way line of Hanna
Street to the Southeast corner of Lot 211; thence :North 716 feet with the West
right -of -way line of College Street to the South right -of -way line of Simpson
Street; thence East 43.5 feet with the South right- of -vay line of Simpson Street
to the East right -of -way line of College Street; thence South 716 feet with the
East right -of -way line of College Street to the point of beginning, containing 0.72
acres, more or less.
