AN ORDINANCE OF THE BOROUGH OF CARTERET AUTHORIZING THE
ACQUISITION OF PROPERTY COMMONLY KNOWN AS 55 -57 WASHINGTON
AVENUE AND IDENTIFIED ON THE BOROUGH'S TAX MAP AS
BLOCK 6703, LOT 5
WHEREAS, the Mayor and Council of the Borough of Carteret (the 'Borough ") has determined
that a need exits to acquire the following identified parcel of real property for use as a public
facility, including without limitation, public puking and such other purposes as are authorized by
law,

WHEREAS, the Governing Body has determined that said use is for a public purpose and will promote the
general health and welfare of the community; and
WHEREAS, Section 40A:12 -5 of the Local Lands and Buildings Law (N.J.S.A. 40A:12 -1 et seq.)
empowers municipalities to acquire real property by direct negotiation leading to the purchase of said
property, or by condemnation should that be necessary, however, in the case of a municipality, such
acquisition must be authorized by duly adopted ordinance.
NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough Council of the Borough of
Carteret, Middlesex County, New Jersey, as follows;
Section I. The acquisition of the real property commonly known as 55
Washington Avenue, Carteret, New Jersey and identified on the
Borough's tax map as Block 6703, Lot 5 by an of the following
methods, (i) consummation of a purchase and sale contract which
is the product of direct negotiations with the owners of such
property, (it) by a gift, grant or contribution by the owners of such
property, or (iii) by condemnation of such property that is carried
out pursuant to the Eminent Domain Act N J.S.A. 20:3 -1 at seq.)
is hereby authorized and directed for the purposes provided for
herein, and such other municipal purposes as may be authorized by
law.
Section 2. 'J7re Director of Law, and/or such other special legal counsel, are
hereby authorized and directed to perform or carry out or cause to
be performed or carried out, any studies, surveys, tests, soundings,
borings, appraisals, title searches, and title report reviews as
reasonably necessary to determine the value ofthe property, the
location and quality of the property, and environmental matters
— associated with the property and to undertake any action necessary
or appropriate to acquire the property.
Section 3. The Mayor, (lie Chief Financial Officer, the Director of Law and
the Borough Clerk are each Thereby authorized to sign any
document necessary to effectuate the acquisition of such property.
Section 4. This Ordinance shall take effect upon final passage and publication
in accordance with applicable law.
