HomeMy Public PortalAbout1998-03 City CodeORDINANCE 1998 -3 AN ORDiNANCE AMENDING § 10 -14 and § 10 -15 OF GREENCASTLE CITY CODE BE IT ORDAINED AND ADOPTED by the Common Council of the City of Greencastle, Indiana, that § 10 -14 and § 10 -15 of the Greencastle City Code is hereby amended as follows: Sec. 10 -14 5. the amendment will not interfere substantially with the Comprehensive Plan. If the report of the Commission is adverse to a proposed amendment referred to it, the amendment may be passed by a simple majority vote of the Council, and failure by the Council to pass a proposed amendment within ninety (90) days after its rejection by the Commission constitutes a rejection thereof by the Council. A proposed amendment rejected by the Commission and the Council may not be reconsidered by the Commission or the Council until expiration of one (1) year after the date of its original rejection by the Commission. c. Council Amendment to or Rejection of Amendment - If the Council rejects or amends a proposed amendment to the Comprehensive Plan, including without limitation Chapter 806, the zoning chapter thereof (except as concerns the rejection of a proposed redistricting, the procedures for which are set forth in Subsection 'b'), it shall return such amendment to the Commission for further consideration with a written statement of the reasons for its rejection or amendment. The Commission has forty -five (45) days in which to consider the rejection or amendment and to file a report with the Council thereupon. If the Commission approves the Council's amendment, the ordinance thereupon stands, as passed by the Council, as of the date of the recording of the Commission's report with the Council. If the Commission disapproves the rejection or amendment of its recommended amendment, the action of the Council on the original rejection or amendment stands only if confirmed by a simple majority vote of the Council. If the Commission does not file a report with the Council within forty -five (45) days, the Council's action in rejecting or amending the original amendment becomes final. Sec. 10 -15 Vacation of Plats and Ways Upon the filing with the City Council of any petition by any person who owns or is interested in the subject real estate for the abandonment or vacation of any public way or platted lot, the Council shall promptly refer such petition to the Plan Commission for initial consideration at a duly noticed and held public hearing. Thereafter, the Commission shall promptly forward its recommendation to the Councii upon the requested abandonment or vacation, and the Council may override or approve the Commission's recommendation by a simple majority vote of the elected members of the Common Council. • This Ordinance shall not affect any matter approved by the Plan Commission before the adoption of this Ordinance. This Ordinance only address the sections of § 10 -14 and § 10 -15 as to the vote requirements of Council from a two- thirds (2/3) vote of the Council to a simple majority vote of the elected members of the Common Council. All other aspects of § 10 -14 anc 10 -15 remain in full force and effect and are not changed. PASSED AND ADOPTED by the Common Council of the City of Greencastle, Indiana this ��ay of 1998. Nancy A.
