HomeMy Public PortalAboutr 22-104#22 -104 April 21, 2022 Date of Adoptio AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT WITH COLLIERS ENGINEERING & DESIGN RIVER WALK PHASE II— NORTHERN SECTION WHEREAS, the Borough of Carteret is in need of specialized engineering services for Phase 1.0 Construction Bid Administration in connection with the River Walk Phase II Northern Section; and WHEREAS, Colliers Engineering & Design, 331 Newman Springs Road, Red Bank, New Jersey 07701, possesses the requisite experience and expertise to provide said services; and WHEREAS, Colliers Engineering & Design has submitted a proposal to provide said services at a total cost not to exceed $10,500.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Acct. # NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: I. The proposal from Colliers Engineering & Design for engineering services related to Phase 1.0 Construction Bid Administration for the River Walk Phase If Northern Section at a cost not to exceed $10,500.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.SA 40A:1 1- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Finance Department, the Borough Director of Engineering and Colliers Engineering & Design. Reiman, Mayor Borough of Carteret Memorial Municipal Building 61 Cooke Avenue Carteret, NJ 07708 Proposal for Professional Services River Walk - Phase II - Northern Section Borough of Carteret, Middlesex County, New Jersey Colliers Engineering & Design Proposal No.: 17001048P Dear Mayor Reiman, Colliers Engineering & Design, Inc, (DBA Maser Consulting) is pleased to submit this proposal to provide Construction Administration Services for a proposed new Northern walkway located at the Carteret Waterfront Park in the Borough of Carteret, Middlesex County, New Jersey. The project will have a Base Bid for Phase I of the Main Boardwalk and an Add Alternate Bid item for a secondary smaller Boardwalk. The section of the Main Boardwalk in the Base Bid is from the northern boundary of the ferry terminal parcel up to the boundary with the Basin Holding Corp. parcel. An Add Alternate Bid Item will be a secondary narrower boardwalk that projects out closer to the water's edge. This proposal is divided into four sections as follows: Section I - Scope of Services Section II - Business Terms and Conditions Section III - Technical Staff Hourly Rate Schedule and Reimbursable Expenses Section IV - Client Contract Authorization The order in which the following scope of services are presented generally follows the sequence in which the project will be accomplished; however, depending on the project, the various authorized services contained in this proposal may be performed in a sequence as deemed appropriate by Colliers Engineering & Design to meet project schedules. Section I ® Scope of Services Based on our conversations and information noted above, we propose to complete the following: Mast'r C0nsulting is now Colliers Engineering & Design -- — -- .� -- - --- ---� -- Acceleiating success, Engineer iri & Design PHASE 1.0 CONSTRUCTION BID ADMINISTRATION Once all construction documents, permitting and grant documents are complete, our office will compile the bid package and seek all necessary authorizations to bid the project. Our office will coordinate the bid and assist the Borough throughout the course of the bid, including bid questions and attendance at the bid opening. We will review all bids received and prepare a Recommendation of Award to be presented to the Borough. The scope of work under this phase generally includes the following: 1. Prepare bid package for advertising; 2. Advertise for bids; 3. Prepare and administer pre -bid meeting and site walk- through (if required); 4. Address RFI's by bidders; 5. Issue contract clarifications and /or addenda; 6. Attend bid opening; 7. Tabulate and analyze bid results; 8. Prepare a recommendation on the award of contract; and, 9. Assist in the preparation of formal contract documents for the award of contracts. Phase 1.0 Lump Sum Fee $10,500.00 PHASE 2.0 CONSTRUCTION ADMINISTRATION & CONSTRUCTION OBSERVATION SERVICES Our office will perform Construction Administration and Construction Observation services that will include the following tasks: 1. Provide general communication with the Borough and contractor throughout the duration of construction regarding such issues as progress, submittal status, construction issues and their resolution; 2. Provide communication and correspondence with the Borough; 3. Maintain project files, if required, for periodic inspection by the funding agencies; 4. Conduct pre- construction meeting, establish agenda, issue notice to proceed; 5. Review and approve Progress Schedule, Schedule of Submittals, Schedule of Values required to be submitted by the contractor; Proposal No. 17001048P April 8, 2022 Page 2 15 Engineering & Design 6. Provide minor plan changes based upon actual field conditions; Provide construction observation at a frequency necessary to ensure Contractor's compliance with the Contract Documents; Full time inspection /observation is needed during periods when the contractor is on site to monitor their progress and compliance with the contract drawings and specifications, including the contractor's environmental protection and restoration measures. It is anticipated that up to two (2) inspectors will be needed at various points in time due to multiple operations occurring simultaneously; 8. Provide photographs of work in progress; 9. Review other submittals as required to evaluate that the proposed materials and equipment conform to the contract documents; 10. Review shop drawings provided by the Contractor and /or provide engineering redesign, if needed, to adapt to actual field conditions; 11. Establish baselines and benchmarks for locating work; 12. Prepare daily inspection reports and monthly progress reports; 13. Hold scheduled progress meetings with the Contractor and Borough to discuss scheduled activities; 14. Review monthly and payment requests including the final payment requests; 15. Participate in the review and evaluation of potential change orders, including detailed review of cost proposals; 16. Participate in the resolution of issues involving unforeseen field conditions; 17. Prepare punchlist of remaining work items; and, 18. Evaluate substantial and final completion and issue certificates of substantial or final completion as appropriate. Coordination with the contractor's schedule will ensure that construction is receiving the necessary attention during all phases of construction. In addition, we will review and approve all payment vouchers submitted by the Contractor before they are presented to the municipality for payment. As the project approaches completion, the Contractor will also be presented with a detailed punch -list of the items requiring repair and /or correction. Our fee is based on a five (5) month contract period with an estimated four (4) months of full -time inspection for the Base Bid and an additional month of full -time inspection if the Add Alternate Bid is awarded. Please note, Colliers Engineering & Design accepts no responsibility for construction methodology utilized by the contractors and sub - contractors, including worker health and safety issues. Phase 2.0 Base Bid Lump Sum Fee Phase 2.0 Add Alternate Bid Lump Sum Fee Schedule of Fees $265,560.00 $ 41,780.00 For your convenience, we have broken down the total estimated cost of the project into the categories identified within the scope of services. PHASE 1.0 CONSTRUCTION BID ADMINISTRATION $ 10,500.00 PHASE 2.0 CONSTRUCTION ADMINISTRATION & CONSTRUCTION OBSERVATION SERVICES BASE BID $265,560.00 ADD ALTERNATE BID $ 41,780.00 TOTAL LUMP SUM FEE $317,840.00 This Contract and Fee Schedule are based upon the acceptance of Colliers Engineering & Design's Business Terms and Conditions contained in Section II of this Contract. Delivery, mileage, printing and reproduction, overnight mail service and postage costs are not included in the lump sum fees and will be added to each monthly invoice. Exclrisiorls and l ndorstandings Services relating to the following items are not anticipated for the project or cannot be quantified at this time. Therefore, any service associated with the following items is specifically excluded from the scope of professional services within this agreement. • Services not specifically outlined n Section I; • Environmental Remediation Services; • As -built survey; • Offsite utility design; • Exploratory or testing work, interpretations or conclusions related to determination of potential chemical, toxic, radioactive or other type of contaminants on the site; and, • Application fees and escrow deposits to any regulatory review agencies; If an item not listed herein, or otherwise not specifically mentioned within this agreement, is deemed necessary, Colliers Engineering & Design may prepare an addendum to this agreement for your review, outlining the scope of additional services and associated professional fees regarding the extra services.
