RESOLUTION RESCINDING RESOLUTION 402 -21 AS TO THE RENEWAL OF
PLENARY RETAIL CONSUMPTION LIQUOR LICENSE NO. 1201 -33- 009 -008
FOR THE CARTE' RE'T BUSINESS PARTNERSHIP, INC.
WHEREAS, on June 25, 2021, the ABC Board of the Borough of Carteret, County of
Middlesex and State of New Jersey ( "ABC Boatel ") passed Resolution # 02 -21 approving
the renewal of the Plenary Retail Consumption Liquor License #1201 -33- 009 -008 held
by the Carteret Business Partnership, Inc., ( "CBP "), among others licenses, for the 2021-
2022 license term; and
WHEREAS, it subsequently became apparent that the aforesaid license could not be
properly renewed by the ABC Board without a Special Ruling issued by the Director of
the New Jersey Division of Alcoholic Beverage Control pursuant to the provisions of
N.J.S.A. 33:1- 12.39; and
WHEREAS, as a result, the ABC Board must rescind the aforesaid renewal of the CBP
License:
NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED, by the ABC Board
of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
That the provision of Resolution # 02 -21, previously adopted by the ABC Board of
the Borough of Carteret, providing for the aforementioned renewal of ABC License
#1201 -33- 009 -008 is hereby rescinded only as to said License.
BE IT FURTHER RESOLVED, that the Municipal Clerk/ABC Board Clerk is hereby
authorized and directed to take any and all action required to implement the within
Resolution according to applicable law.
