RESOLUTION RESCINDING RESOLUTION 402 -21 AS TO THE RENEWAL OP
PLENARY RETAIL CONSUMPTION LIQUOR LICENSE NO. 1201 -33- 043 -004
FOR THE CARTE' RET REDEVELOPMENT AGENCY
WHEREAS, on June 25, 2021, the ABC Board of the Borough of Carteret, County of
Middlesex and State of New Jersey ( "ABC Board ") passed Resolution # 02 -21 approving
the renewal of the Plenary Retail Consumption Liquor License #1201 -33- 043 -004 held
by the Carteret Redevelopment Agency ( "CARA "), among others licenses, for the 2021 -
2022 license term; and
WHEREAS, it subsequently became apparent that the aforesaid license could not be
properly renewed by the ABC Board without a Special Ruling issued by the Director of
the New Jersey Division of Alcoholic Beverage Control pursuant to the provisions of
N.J.S.A. 33:1- 12.39; and
WHEREAS, as a result, the ABC Board must rescind the aforesaid renewal of the
CARA'License.
NOW, THEREFORE, BE IT AND IT IS HE RE, RESOLVED, by the ABC Board
of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
That the provision of Resolution #02-21, previously adopted by the ABC Board of the
Borough of Carteret, proLiding for the aforementioned renewal of ABC License
#1201 -33- 043 -004 is hereby rescinded only as to said License.
BE IT FURTHER RESOLVED, that the Municipal Clerk/ABC Bond Clerk is hereby
authorized and directed to take any and all action required to implement the within
Resolution according to applicable law.
