CITY OF RICHLAND HILLS RESOLUTION NO.
A RESOLUTION OF THE CITY OF RICHLAND HILLS, TEXAS
ENCOURAGING THE TEXAS STATE LEGISLATURE TO EXPAND THE
PERMITTED USES FOR HOTEL OCCUPANCY TAX REVENUE;
PROVIDING FOR NOTICE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Richland Hills has recently amended an occupancy tax pursuant to
Chapter 351 of the Texas Tax Code in anticipation of the construction and opening of two hotels
within the City;
WHEREAS, Chapter 351 provides numerous limitations on the use of Hotel Occupancy Tax
revenue, essentially limiting such funds to the development of tourism within the City;
WHEREAS, the City of Richland Hills, as a small city without significant tourism within
the City, has limited opportunities to expend funds on the authorized purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
SECTION 1.
REQUEST TO THE TEXAS LEGISLATURE
The City Council hereby requests that the Texas State Legislature revise Chapter 351 of the
Texas Tax Code to expand the uses and purposes for which municipalities may expend revenue
generated from hotel occupancy tax, to specifically include improvements to existing City
infrastructure, including streets, sidewalks, parks, and community facilities.
SECTION 2.
AUTHORIZATION OF NECESSARY ACTIONS
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized and
directed to take all actions necessary to effectuate this resolution.
SECTION 3.
EFFECTIVE DATE
This Resolution shall be effective upon its adoption.
