HomeMy Public PortalAbout2021.08.27 Special Meeting Minutes MINUTES McCall City Council Special Meeting McCall City Hall -- Legion Hall VIA TEAMS Virtual August 27, 2021 Call to Order and Roll Call Work Session Adjournment CALL TO ORDER AND ROLL CALL Mayor Giles called the special meeting of the McCall City Council to order at 9:00 a.m. Mayor Giles, Council Member Maciaszek, Council Member Nelson, and Council Member Nielsen all answered roll call. Council Member Callan was absent City staff members present were Anette Spickard, City Manager; BessieJo Wagner, City Clerk; Michelle Groenevelt, Community Development Director; Brian Parker, City Planner; Rick Stein, Airport Manager; Nathan Stewart, Public Works Director; Chris Curtin, Information Systems Manager; Meredith Todd, Assistant Planner Valley County Commissioners present were Elt Hasbrouck, Sherry Maupin, Dave Bingaman, County Clerk Doug Miller, Valley County Planning and Zoning Administrator Cynda Herrick, McCall Area Planning & Zoning Commissioners - Robert Lyons, Johanna Krahn McCall Housing Advisory Committee - Nick Zello, Toni Curtis Also, in attendance was Elaine Clegg, Program Director at Idaho Smart Growth TRAINING & WORK SESSION AB 21-221 Joint Training and Work Session with McCall City Council, Valley County Commissioners and McCall Area Planning and Zoning Commission on McCall Area of Impact The purpose of this training and work session with the McCall City Council, Valley County Commissioners and McCall Area Planning and Zoning Commission is twofold. First, there will be training on how impact areas work and the purpose of these areas. The importance of long-range planning and the role of the McCall Area Comprehensive Plan will be reviewed. Administration of the same plans and codes and the joint Planning and Zoning Commission have made the McCall Area impact area a success. The Airport Manager will review recommendations for the Airport and surrounding land uses. MCCALL CITY COUNCIL Page 1 of 4 August 27, 2021 Special Meeting The second half of the meeting will be a facilitated discussion on various topics for the McCall Impact Area and provide the governing boards an opportunity dialogue on important planning topics such as housing and code enforcement. Elaine Clegg, from Idaho Smart Growth, provided the training and facilitation. She started the presentation with a brief history regarding the Local Land Use Planning Act. She explained the City of McCall’s Impact Area and what is required by Idaho Law for impact areas. She discussed the need to revisit the area of impact every 10 years to ensure what needs to be in the impact area is and what should not be included. Ms. Clegg fielded questions regarding whether cities had the ability to opt out of impact areas. It was clarified that the State of Idaho does not have an Office of State Planning, so enforcement of the local land use planning is up to the local jurisdictions through the court process. Some questions regarding authority for appeals and the process for in city limits and for those in the impact area. It was clarified that for those appeals in the impact area, the appeal goes to the County Commissioners and for the City limits, the appeal goes to City Council. It was also clarified that the Planning and Zoning Commission is made up of both City residents and area of impact residents that make recommendations to the appropriate governing body. Ms. Clegg covered the importance of adopting the same plans for the impact area that the City is adopting such as Comprehensive Plans and capital improvement plans. She explained that updates to land use plans start with the Planning and Zoning Commission. However, capital improvement plans start at the city or county levels and that is where there can be some disconnect between city and county priorities. Communication between the two governing bodies is key. She also stated that keeping the sewer district and fire districts in the loop are critical for successful planning. There was a comment that within city limits there is not room for more hotels so that is driving the need for more short term rentals. Short term rentals are impacting our local housing, how do the governing bodies overcome this issue. Ms. Clegg stated that it is important for cities and counties to pass ordinances that require short term rentals to be licensed and regulated to know where they are, who they are, and how many people they are serving. When looking at a need for more hotels it is important to communicate regionally to identify the need and where it best fits with land use planning. There was some discussion regarding development without infrastructure and how that infrastructure controls development, especially sewer infrastructure. With limited infrastructure, looking at redevelopment can address some of the issues. Community and Economic Development Director Groenevelt stated that code enforcement issues in the impact area take up a lot of City staff time. She stated that there is no mechanism for enforcement in the impact area. Staff tries to achieve voluntary compliance; however, the City’s Code enforcement officer does not have jurisdiction in the impact area. Valley County has budgeted for a code enforcement officer but has not advertised the position yet. It was clarified that Valley County and the City of McCall have been collaborating on code enforcement issues at the staff level. MCCALL CITY COUNCIL Page 2 of 4 August 27, 2021 Special Meeting Commissioner Maupin expressed concern with area of impact being primarily residential and, in the City limits, the downtown core is made up of primarily government and banking which makes it difficult for business growth. She stated that you cannot have residential growth without commercial growth. Commission Maupin stated that there are plans to establish zoning in the impact area and county for commercial growth. Community and Economic Development Director Groenevelt commented how do we encourage development that includes residential. She stated that staff is talking with the current banks and Albertsons with ideas on how to turn these commercial buildings into mixed use residential. Ms. Clegg commented that there should be areas focused on preservation and areas focus on development in the impact area. There was some discussion regarding zoning in the county. Robert Lyons, McCall Area Planning and Zoning Commissioner, recommended involving the two sewer districts in future land use planning discussions. The group had additional discussion regarding how to include the sewer districts and how important sewer is to new development. Director Groenevelt stated that the City of McCall is developing a Housing Action Plan to encourage housing and as part of that, working with the Sewer District, there is a goal to develop a Local Housing Sewer Policy. The plan will help to prioritize certain types of projects. Commissioner Maupin stated that she had been in contact with the sewer. districts regarding the ARPA funds and planning funds set aside for sewer infrastructure. She has learned that South Lake Sewer District is looking at it and that Payette Lakes Recreational Water and Sewer District have a plan. She emphasized the need to take advantage of the dollars available. There was some discussion about a sewer district does not have to be contiguous to expand. Council Member Maciaszek asked for discussion regarding the endowment lands. Do we need to revisit the future land use maps that have development at 1 home per 10 acres or look at 1 per 40 acres? It was recognized that the housing discussion needed to be continued as it will warrant a lot more time. Some questions for the group to consider at a future meeting are the future land use map for the area of impact shows the IDL land as AG Forest and not necessarily residential and recently a large development east of Woodlands was identified as an area of concern, should the endowment lands also be an area if concern. Council Member Nielsen would like all to consider a comprehensive plan between Lake Fork and the City of McCall to consider residential and commercial development and for the region to be all on the same page. AB 21-222 Airport Land Use Compatibility in Valley County Airport Manager Rick Stein presented. In the time that McCall Municipal Airport existed, the land immediately south of the airport (located in Valley County, outside of McCall city limits) has been open pastureland. This open land buffer allowed air traffic operations without incompatible land use such as homes, schools, and businesses. Now, with the McCall Ranch land sales, the 360° Ranch development, and individual houses (proposed and existing) concerns are that public safety will be compromised, and that undesirable living conditions will result in increasing numbers of property owner’s complaints. MCCALL CITY COUNCIL Page 3 of 4 August 27, 2021 Special Meeting The City of McCall desires to minimize incompatible land use in this area. To achieve this goal, the Airport has short-term and long-term recommendations for the Valley County Planning and Zoning Commission. The airport's short-term recommendations, for all construction within 5,000 feet of the runway end are: 1. Require additional soundproofing in the new construction, 2. Require that written notice to homeowners about the airport's existence, flight paths, and the possibility of noise generation, 3. Require a Form 7460-1 Notice of Proposed Construction or Alteration be submitted, and require compliance with the Federal Aviation Administration's (FAA) mitigation recommendations, and 4. Require an Avigation Easement be negotiated with the City of McCall. For the long term, McCall Municipal Airport requests that the Commission consider enacting zoning restrictions within Valley County in the area within 5,000 feet south of the Runway 34 end. The FAA has a recommended zoning template to assist local governments avoid incompatible land use near airports. Airport Staff will be available to assist writing zoning regulations for this area. The City urges Valley County to be proactive concerning incompatible land use near the airport, increase safety and decrease noise complaints from future citizens. Some discussion regarding the land south of the airport and the cost of acquiring land. Airport Manager Stein stated that he would make presentations to both the Valley County Board of Commissioners and the Valley County Planning and Zoning Commission on Airport Land use plans and work on updating the zoning maps. There was discussion regarding next steps which included meeting regularly, a regional meeting possibly every 2 months. Ms. Clegg stated that she would put out the survey and prepare the responses for the next meeting on October 28, 2021.
