A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA; DIRECTING THE
VILLAGE MANAGER TO IMMEDIATELY COMMENCE
NEGOTIATIONS WITH JAMES A. CUMMINGS, INC. FOR A
GUARANTEED MAXIMUM PRICE CONTRACT FOR THE
CONSTRUCTION OF THE VILLAGE COMMUNITY
RECREATIONAL CENTER AND DIRECTING THE
VILLAGE MANAGER TO IMMEDIATELY COMMENCE
NEGOTIATIONS WITH ROBERT A. CURRIE
PARTNERSHIP, INC. FOR AN AGREEMENT FOR THE
PREPARATION OF CONSTRUCTION/PERMIT PLANS FOR
THE COMMUNITY RECREATIONAL CENTER;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on July 23, 2002, the Village Council approved a site plan of development for
the Village Community Recreational Center to be constructed at 85 West McIntyre Street; and
WHEREAS, the Village Council wishes to proceed with the design and construction of the
Community Recreational Center.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS:
Section 1. Recitals Adopted. T hat t he r ecitals s tated above a re h ereby a dopted a nd
confirmed.
Section 2. Construction Agreement. The Village Manager is hereby directed to
immediately commence negotiations with James A. Cummings, Inc. on a guaranteed maximum price
contract for the construction of the Community Recreational Center and to present the proposed
contract to the Village Council for its approval.
Section 3. Construction/Permit Plans Agreement. The Village Manager is hereby directed
to immediately commence negotiations with Robert A. Curie Partnership, Inc. for an agreement for
the preparation of construction/permit plans for the Village Recreational Center and to submit that
agreement to the Village Council for its approval.
Section 4. Effective Date. This resolution shall be effective immediately upon adoption.
