AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL
CODE RELATIVE TO THE APPLICATION FOR PERMIT TO
SELL FIREWORKS WITHIN THE CITY OF TEMPLE CITY
TO PERMIT LATE FILING OF APPLICATION WHERE GOOD
CAUSE IS SHOWN.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN
AS FOLLOWS:
SECTION 1. The municipal Code of the City of Temple City
is hereby amended by striking Section 3115 in its entirety.
SECTION 2. The Municipal Code is hereby amended by adding
Section 3115 to the Municipal Code to read as follows:
"1111. Applications for such a permit:
(a) Shall be made in writing.
(b) Shall be filed with the City Manager on or prior to
May 1 of each year, subject to the right of the City
Council to accept applications for any permit up to
and including June 15th, providing the applicant shall
file with the City Council, in addition to the applica-
tion meeting all the requirements of Sections 3112
through 3116 of this code, a written PETITION TO PERMI1
LATE FILING FOR PERMIT TO SELL FIREWORKS, which pe-
tition shall set forth a statement of facts upon which
the City Council can determine whether there is good
cause, based on sound equitable considerations, in-
cluding, but not limited to, inadvertence or excusable
neglect, to permit the petitioning applicant to file
after May 1 and on or before June 15th.
The City Council at its first regular or special meet+
ing after the filing of the Application and Petition
shall consider both the Application and the Petition
and shall hear any persons who shall desire to speak
on the matter, after which, at said meeting, the City
Council shall determine whether or not the Petition to
permit a late filing shall be allowed, and if allowed
whether the applicant should be issued a permit. The
decision of the City Council shall be final. No appeal
shall be made from the City Council's decision, either
as to the Petition or the application.
(c) Shall set forth the proposed location of any and all
fireworks stands applied for, and the length thereof.
(d) Shall be accompanied by an assurance that if the permit
is issued to applicant, applicant shall, at the time
of receipt of such permit, deliver to the City a
$25/$50,000 public liability and a $5,000.00 property

damage insurance policy, with a rider attached
to the policy, designating the City as an ad-
ditional assured thereunder.
(e) Shall be accompanied by a fee of Twenty -Five
Dollars ($25.00).
Applicants for any such permits shall be notified by the
City Manager of the granting or rejection of their application
for permit on or before the first day of June of each calendar
year, except for such applicants as shall be granted permission
to file between May 1 and June 15 pursuant to 3115 (b) above,
which applicants shall be notified of the City Council's deci-
sion by mail within forty -eight (48) hours: after the City
Council's decision."
SECTION 3. The City Council expressly finds that the
sale of fireworks by qualified persons is a matter of and
concerning the immediate preservation of the public peace,
health and safety and that hence this ordinance shall take
effect immediately upon its passage.

Temple City at a regular meeting thereof held this 28th day
of May 1962, by the following called vote:
