HomeMy Public PortalAboutr 02:041No. 02-/41 Date of Adoption .January 26~ 200l RESOLUTION REFERRING TO THE PLANNING BOARD FOR RECOMMENDATION AN AMENDED AND RESTATED REDEVELOPMENT PLAN FOR LANDFILL RECLAMATION IMPROVEMENT DISTRICT PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW, N.J.S.A.40A:I 2A-l, et seq. AND THE LARGE SITE LANDFILL RFECLAMATION AND IMPROVEMENT LAW, N.J.S.A. 40A:I2A-50, et seq. WHEREAS, pursuant to Ordinance No. 95-40, on August 17, 1995, the Borough created a Landfill Reclamation Improvement District affecting certain properties in the Borough as referenced therein in accordance with the Large Site Landfill Reclamation and Improvement Laxv (codified at N.J.S.A. 40A:I2A-50 et seq.) (the "Landfill Law"); and WHEREAS, pursuant to Resolution No. 95-346, on November 2, 1995, the Borough approved a redevelopment agreement to which a redevelopment plan for the Landfill Reclamation Improvement District was an exhibit; and WHEREAS, pursuant to Ordinance No 96-14, on May 16, 1996, the Borough amended the boundaries of the Landfill Reclamation Improvement District, as referenced therein; and WHEREAS, subsequent to the adoption of the redevelopment plan for the District and the revision of the boundaries thereto, the Landfill Law was amended; and WHEREAS, as a result of the amendments, which took effect July 22, 1996 and which serve in part to relate the redevelopment provisions of the Landfill Law to the Redevelopment Laxv, and any redevelopment agreement a municipality may enter for the redevelopment of landfill reclamation improvement districts must satisfy the requirements of both the Landfill Law and the Local Redevelopment and Housing Law, N.J.S.A.40A: 12A-I, et seq. ("Redevelopment Law"); and WHEREAS, the Borough now xvishes to amend and restate the original redevelopment plan and adopt this Amended and Restated Redevelopment Plan to meet the statutory requirements and provide a guideline for the redevelopment of thc District in response to the findings of the Borough Council; and 02-41 PAGE 2 NO. WHEREAS, Section 7 of the Redevelopment Law provides that, prior to the adoption of a redevelopment plan, such plan is to be refeiTcd to the Planning Board for its recommendations. NOW, THEREFORE, BE IT RESOLVED that the Planning Board of the Borough of Carteret is directed to review the Amended and Restated Redevelopment Plan attached hereto as Exhibit A and prepare a report in conformance with Section 7 (e) of the Redevelopment Law.
