HomeMy Public PortalAboutRES2020-01_Local Disaster EmergencyInstrument I 1637126 Bonneville County~ Idaho Falls, Idaho 03/31/2020 03:39:~8 PM No. of ~a es: 3 Raoordad for: CITY OF IONA Pann Manning Fea: $0.00 Ex-Otfioio Raoordar Daputy ~~yn~------------------Index to: MISCELLANEOUS RECO~u N~ RESOLUTION NO. 2020-01 A Resolution Providing City Council Affirmation of Local Emergency Declaration relating to COVID-19 WHEREAS the President of the United States and the Governor of the state of Idaho have declared a health emergency related to the threat ofCOVID-19; and WHEREAS, pursuant to Idaho Code § 46-1011, the Mayor of the City of Iona, Idaho (the "Mayor") has declared a local disaster emergency in the Mayor's Declaration of Local Disaster Emergency issued on the 23 rd day March 2020 (the "Declaration"), due to the threat of COVID-19; and WHEREAS, the Declaration sets forth legal and factual considerations in support of such Declaration; and WHEREAS, the City Council of the City of Iona, Idaho (the "Council") recognizes the imminent threat of widespread and severe harm to the health of residents and visitors to the City of Iona as addressed by the Centers for Disease Control and by actions of the Governor of the state ofldaho; and WHEREAS, the Declaration activates the response and recovery aspects of applicable local or intergovernmental disaster emergency plans for the furnishing of aid and assistance; and WHEREAS, the emergency referenced herein exists because the contagious nature and potentially serious consequences of the virus that causes COVID-19 for residents and visitors to the City of Iona and requires state emergency assistance to supplement local efforts to protect life, health, and property; and WHEREAS, Idaho Code§ 67-2808 authorizes the Council to declare an emergency and that the public interest and necessity may demand the immediate expenditure of public money without compliance with formal bidding procedures; and WHEREAS, an emergency declaration must be filed with the county recorder's office and "given prompt and general publicity." Page 1 of2 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO: 1. The Council hereby declares that a Local Disaster Emergency exists and that all efforts will be made to protect the citizens and property of the City of Iona through activation of all local disaster emergency plans and state emergency assistance. 2. The Council hereby declares that this Local Disaster Emergency shall continue until the Centers for Disease Control and the Governor of the state of Idaho sound an end to the emergency and the Council expressly authorizes the discontinuance of such Declaration. 3. The Council hereby declares that pursuant to this Resolution the following steps are expressly authorized in furtherance of the foregoing disaster emergency declaration: a. Changing the method of holding Council meetings to utilize technology to allow for City meetings and public participation as provided by law; b. Restricting access to City buildings and other City facilities; c. Scheduling City staff as appropriate and necessary to minimize their exposure to and/or transmission of the virus that causes COVID-19; and d. The Council further authorizes the Mayor, in consultation with the Council President, to establish other administrative policies necessary to protect the public health and safety. 4. The Council directs that this Resolution declaring a local disaster emergency (this "Resolution") shall be promptly filed with the Bonneville County Recorder's Office. 5. The Council directs that prompt and general publicity shall be given by a press release notifying the public of this Resolution. 6. This Resolution, including the authorization described herein, shall become effective upon its passage, execution, and publication in the manner provided by law.
