RESOLUTION OF THE BOROUGH OF CARTE' RE IN THE
COUNTY OF MIDDLESEX, NEW JERSEY DESIGNATING
PROPERTY IDENTIFIED AS BLOCK 402, LOTS 11 AND 12 ON
THE BOROUGH'S TAX MAP AS AN AREA IN NEED OF
REDEVELOPMENT
WHEREAS, the Borough of Carteret (the "Borough ") is authorized under the Local
Redevelopment and Housing Law, N.JS.A. 40A:12A -1 el seq. (the "Redevelopment
Law ") to determine whether certain property within the Borough constitutes an area in
need of redevelopment; and
WHEREAS, by Resolution No. 22 -26, adopted on January 31, 2022, the Borough
Council authorized and directed the Borough's Planning Board (the "Planning Board ")
to conduct an investigation to determine whether the properties identified as Block 402,
Lots I1 and 12 on the Official Tax Maps of the Borough (collectively, the "Study Area ")
constitute an area in need of redevelopment according to criteria set forth in the
Redevelopment Law; and '
WHEREAS, the aforesaid resolution authorized the Planning Board to investigate the
Study Area as a Condemnation Redevelopment Area (as defined in Section 6(a) of the
Redevelopment Law), within which the Borough may use all of those powers provided
under the Redevelopment Law for use in a redevelopment area, including the power of
eminent domain; and
WHEREAS, Beacon Planning and Consulting Services, LLC (the "Planning
Consultant ") conducted a preliminary investigation to determine whether the Study Area
should be designated as an area in need of redevelopment; and
WHEREAS, the Planning Board received a report and Wrap depicting the Study Area
prepared by the Planning Consultant, entitled "76 -78 Romanowski Street Redevelopment
Area Assessment ", dated March 2022 (the "Report "); and
WHEREAS, on May 18, 2022, the Planning Board reviewed the Report, heard testimony
from a representative of the Planning Consultant, and conducted a public hearing
concerning the potential designation of the Study Area as an area in need of
redevelopment; and
WHEREAS, the Planning Consultant concluded in the Report and testified to the
Planning Board on May 18, 2022 that the properties in the Study Area satisfy certain
criteria for redevelopment area designation set forth in the Redevelopment Law; and
WHEREAS, after the conclusion of the public hearing described above, the Planning
Board determined that the Study Area satisfies the criteria set forth in the Redevelopment
Law for designation as an area in need of redevelopment and determined that it would
recommend that the Borough Council so designate the Study Area; and
WHEREAS, on May 18, 2022, the Planning Board adopted a resolution memorializing
its findings and setting forth its recommendations; and
WHEREAS, the Borough Council agrees with the conclusions of the Planning Board
that the Study Area satisfies the criteria for redevelopment area designation set forth in
the Redevelopment Law and the Borough Council finds that such conclusion is supported
by substantial evidence; and
WHEREAS, the Borough Council now desires to designate the Study Area as a
Condemnation Redevelopment Area, pursuant to N.JS.A. 40A: 12A-6.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
Section I. The foregoing recitals are incorporated herein as if set forth in full.
Section 2. The Borough Council accepts the recommendations and
conclusions of the Planning Board.
Section 3. Based upon the findings and recommendations of the Planning
Board, and the Borough Council's conclusion that such findings
and recommendation are supported by substantial evidence, the
Study Area is hereby designated as a Condemnation
Redevelopment Area and, thus, the Borough may use
all of those powers set forth in the Redevelopment Law with
respect to the Study Area for use in a redevelopment area,
including the power of eminent domain.
Section 4. This resolution shall take effect in accordance with applicable law..
