HomeMy Public PortalAboutResolution No. 355-10 01-26-2010 RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT RESOLUTION NO. 355-10 CITY OF RICHLAND HILLS RESOLUTION NO. 355-10 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT IMPOSING A SALES TAX ON SALES OF GAS AND ELECTRIC UTILITY SERVICES WITHIN THE DISTRICT; AND A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, CONFIRMING THE IMPOSITION OF A SALES TAX ON SALES OF GAS AND ELECTRIC UTILITY SERVICES WITHIN THE DISTRICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 363 of the Texas Local Government Code authorizes a municipality that is partially or wholly located in a county with a population of more than 5,000 to propose the creation of a crime control and prevention district; and WHEREAS, the City of Richland Hills has so created the Richland Hills Crime Control and Prevention District; and WHEREAS, Section 363.1055 of the Texas Local Government Code was recently amended by the passage of Senate Bill No. 575 to permit crime control and preventlon districts to impose a tax on receipts from the sale, production, distribution, lease, or rental of, and the use, storage, or other consumption within the district's boundaries of, gas and electricity for residential use, and establishes procedures for doing so; WHEREAS, on January 26, 2010, the Board of Directors of the Richland Hills Crime Control and Prevention District held a public hearing on the issue of whether the District should impose such a tax, and considered whether to authorized the imposition of such a tax at a rate equal to the tax rate adopted by the District on all other sales of taxable items by majority vote following a public hearing; and WHEREAS, also on January 26, 2010, the City Council considered whether to confirm and ratify the Order of the Board of Directors of the Richland Hills Crime Control and Prevention District authorizing the imposition of such a tax at a rate equal to the tax rate adopted by the District on all other sales of taxable items by majority vote following a public hearing; NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE BOARD OF DIRECTORS OF THE RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT AND THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. Following a public hearing held on January 26, 2010, by unanimous vote, the Board of Directors of the Richland Hills Crime Control and Prevention District hereby orders the imposition of a tax on receipts from the sale, production, distribution, lease, or rental of, and the use, storage, or other consumption within the district's boundaries of, gas and electricity for residential use, such tax to be at the rate equal to the tax rate adopted by the District on all other sales of taxable items. The City Council hereby unanimously confirms and ratifies the Order of the Board of Directors of the Richland Hills Crime Control and Prevention District authorizing the imposition of such a tax at a rate equal to the tax rate adopted by the District on all other sales of taxable items. SECTION 3. This resolution and order shall be effective immediately upon adoption, publication and any other steps required by law to effectuate this resolution and order.
