ACCEPTING RELEASE AND SETTLEMENT
WHEREAS, Complaint No. S-2001-000626-1201 was filed against
Theodore Surick in the Carteret Borough Municipal Court; and
WHEREAS, the Borough of Carteret has instituted formal Disciplinary
Action against Mr. Surick based upon the charges contained in said
complaint; and
WHEREAS, Mr. Surick was ultimately found not guilty of said charges in
the Woodbridge Municipal Court; and
WHEREAS, based upon this determination by the Woodbridge Municipal
Court, Counsel for the Borough and Mr. Surick have negotiated a
settlement and resolution of the corresponding disciplinary charges with
said settlement being formalized in a Release being given by Mr. Surick to
the Borough; and
WHEREAS, the Governing Body has considered the terms of said
Release and has determined that it is in the best interest of the Borough to
accept the same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret, County of Middlesex, State of New Jersey that the
above described Release, a copy of which is attached hereto and made a
part hereof, is hereby approved and accepted.
BE IT FURTHER RESOLVED that the appropriate Borough officials are
hereby authorized to implement the terms of the Release and Settlement.

and certified as a true copy of the
original on February 1, 2002.
