The regular meeting of Towh Council was held to -dgy at 5 :00 p.m., in the Council Romm add was attended by Mayor Jones, who presided, and Councilmen Walsh, Henry, Young, Slotin and Lovell and Town Attorney Dutton. The minutes of the meeting of Fbbruary 10th were read and approved. The Mayor informed Council that relativeto the Library he had re quested MissWyeth, Librarian of the Savannah Public Library, to ac .se him if it could be operated as a branch of the Savannah Library and she informd him that it could not, thothgh the Savannah Library would be willing to supervise it if it is operated. It was suggested that volunteers be used to continue its activity, at least several days a week. The Mayor informed Council that application h€t.db ae for Lanham Act funds for the ^ewer System, and that all requirments had been com- plied with, the Atlanta office of the FWA had approved it; the area engineer of the PHS had also approved it; but that it had been held up at another source, Councilman Slotin stated that the Mayor should go to Was #ington in an effort to straighten the matter out. Council was informed of the condition of the forme that had been built for the erection of the Clarifier and the fligester at Disposal Plant, they having been exposed to the weather for some time. It was decided that if work was not resumed within the next several weeks that the Town would employe the necessary labor E•n d pour the concrete so as to save the work that had already been done, at an estimated cost of $500.00. The Mayor informed Council that W.S.Marchbanks had been released from Military Service and would be given his former position as police officer. Councilman Leopold moved that effective March 1st the Police Dept. consist of three men, including the Chief, Coun- cilman Slotin seconded and the motion passed. Councilman Henry brought 9tp the matter of establishing a curfew for children on the island no action was taken. Council was advised that the mule were sold and that the shed formerly used to house them would used to store other equipment. The matter of the'Tybrisa Company's encroachment of lots 91 -92 -93 ward 4, was brought up but Council was informed that the Commitee still handling it. Councilman Slotin moved that bills for the month of February covering materials purchased for Gen. Councilman Walsh seconded and the motion passed. ^ ouncilman Henry moved that the following resolution quit claiming part of the old CRR right of way to A.C.Carter be adopted. Councilman Mash seconded and the motion passed; SOLUTION. 1 1 23 7 RESOLUTION WHEREAS, the Centrals of Georgia Railway and H. D. Pollard, Receiver of the Central of eorgia Railway, successors in title to the Savannah and Tybee Railway Company, did on the 23rd day of June, 1933, permanently abandon the use of the Central of Georgia Railway right - of -way; and WHEREAS, the Central of Georgia Railway and H. D. Pollard, as Receiver of the Central of Georgia Railway, conveyed to the Town of Savannah Beach, Tybee Island, by deed dated March 2, 193+, and recorded in the Clerk's Office of the Superior Court of Chatham County, Georgia, in Record Book 29 S +s, folio 383, the right -of -way which was used by said railroad; and WHEREAS, the Town of Savannah Beach, Tybee Island, as successor in title to the Savannah and Tybee Railway Company, and as the result of said abandonment of said right -of -way, as aforesaid, did not obtain title to said right -of -way legally or equitably; and WHEREAS, in law and in equity A. C. Carter, of Savannah Beach, Tybee Island, holds legal and equitable title to that said part of the right -of -way which is hereinafter described in detail; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah, Tybee Island, in Council assembled, that the Mayor be and he is hereby authorized to execute in the name and in behalf of the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, a quit -claim deed unto the said A. C. Carter, conveying the following described property, to wit: All that certain lot, tract or parcel of land situate, lying and being in the State of Georgia, County of Chatham, on Tybee Island, Georgia, being more fully described as follows: Beginning at the point where the southern boundary line of the old Central of Georgia Railway right -of -way intersects Lazaretto Creek, thence in an easterly direction along the southern boundary line of said right -of -way a distance of 285 feet, more or less,to a pipe marker, theroe North 70 degrees West across said right -of -way a distance of 100 feet, more or less, to the northern boundary line of said right- of- way,thenee westwardly along the northern boundary line of said right -of -way a distance of 300 feet, more or less, to Lazaretto Creek, thence along Lazaretto Creek in a southerly direction to the point of beginning; being a portion of said right -of -way as shown upon a map made by M. F. Smith, C. E., in October, 1932, for the Tybee Beach Company, of property adjoining Lazaretto Creek, in Tybee Island, "Chatham County, Georgia, which map is attached to and made a part of that certain warranty deed dated October 24th, 1932, from Tybee Beach Company to A. C. Carter, to-which is recorded in the Clerk's Office of the Superior Court of Chatham County, Georgia, in record book 38 P's, folio 354, to which especial reference is hereby made. The Clerk of Council is authorized to attest said deed and attach thereto the corporate seal. 238 Councilman Slotin moved that the following Ordinance be adopted. Councilman Walsh seconded and the motion passed: ORDINANCE AN ORDINANCE REPEALING the following item in Section #4 of AN ORDINANCE passed by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island in meeting assembled on April 6th 1942 "Any person, firm or corporation selling, offering for sale or giving away intoxicating liquors $250.00 and inserting in lieu therefore the following license; Any person,firm or corporation selling, offering for sale or giving away intoxicating liquors $350.00 And for other pur- poses. SECTION #1- Be it Ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, in Council Assembled and it is hereby ordained by the authority of the same, that the following item in Section four (4) of the License Ordinance passed by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island in meeting assembled on April 6th 1942. "Any person, firm or corporation selling, offering for sale or giving away intoxicating liquors $250.00 be and the same is hereby repealed, and inserting in lieu therefore the following license, "Any person, firm or corporation selling, offering for sale or giving away intoxicating liquors $350.00. SECTION #2- All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed. There being no further business Council adjourned subject to the call of the Mayor. ' Mayor Savannah Beach, Tybee Island, Georgia. April 1st, 1943. The Assessment Committee submitted to Council the Assessments of all Real Estate and Improvements for the year becoming due May 1st, 1943, as follows; Real Estate Land: r.g7g,252.00 Imps.
