Mayor Giles led the audience in the Pledge of Allegiance. APPROVE THE AGENDA Council Member Nielsen moved to approve the agenda as submitted. Council Member Nelson seconded the motion. In a voice vote all members voted aye, and the motion carried. All matters which are listed within the consent section of the agenda have been distributed to each member of the McCall City Council for reading and study. Items listed are considered routine by the Council and were enacted with one motion. 1. Council Special Meeting Minutes – June 25, 2021 2. Council Regular Meeting Minutes – July 8, 2021 3. Payroll Report for period ending October 1, 2021 4. Warrant Register – GL 5. Warrant Register – Vendor 6. AB 21-257 City Licenses Report to Council Per McCall City Code: Per McCall City Code Title 4 Chapter 9, the City Council has determined the City Clerk shall be delegated the authority to process and grant or deny all alcoholic beverage license applications, other than certain circumstances involving catering permits, which the City Clerk shall review the application for catering permit for completeness and forward said application to the Police Chief. The Police Chief upon receipt of the application shall make a recommendation to the City Clerk to approve or deny the application. Whenever the City Clerk shall determine that an application for alcoholic beverage license transfer or renewal is complete, the City Clerk shall approve or deny such application. All decisions of the City Clerk shall be reported to the City Council at the next regularly scheduled City Council meeting after such decision. The City Clerk is also responsible for all processing of business, taxi, snow removal, pawnbroker, child daycare licenses, vendor permits, and public event applications. Action: Council to review the License report. 7. AB 21-260 Treasurer’s Report as Required by IC 50-208: Treasurer’s report of accounts and activity of office during the month of September 2021 regarding care, management or disposition of moneys, property, or business of the City. Action: The Council shall examine the report and determine whether additional information from the Treasurer is required. 8. AB 21-254 Request for Approval of Resolution 21-29 to declare Surplus Personal Property: Idaho Code §67-5732A allows for the disposal of surplus personal property, provided that when sales will be offered to the public and sold to the highest responsible bidder, notice of such sale shall be published in the newspaper for at least two (2) weeks prior to such offering. Annually City staff identifies several items as surplus property. Consistent with prior years, the resolution authorizes the City Clerk to conduct a bid auction for the purposes of selling the surplus property to the highest bidder. The City has partnered with Public Surplus, an online auction to auction our surplus items. The public auction on the Public Surplus auction website will be noticed in the Star-News for two consecutive weeks. Action: Adopt Resolution 21-29 declaring and authorizing the sale of personal property as surplus and authorize the Mayor to sign all necessary documents. 9. AB 21-253 Request to Ratify the Mayor’s Signature on a Letter of Support for Treasure Valley Transit Grant Application to Idaho Department of Transportation: Treasure Valley Transit, operators of McCall Transit, requested a letter of support from the City for their grant application to Idaho Department of Transportation. To meet the grant application deadline, the City Manager recommended the Mayor sign the letter with the understanding that the request would be brought to the Council at the next meeting for their ratification. The City has provided similar letters of support to Treasure Valley Transit for this same grant process MCCALL CITY COUNCIL Page 2 of 9 October 21, 2021 Regular Meeting for many years. Action: Ratify the Mayor’s signature on a letter of support for Treasure Valley Transit grant application to Idaho Department of Transportation. 10. AB 21-259 Request for Acceptance of Grant Award and Approval of Memorandum of Understanding (MOU) between City of McCall and Imagine Idaho: In August 2021, Council approved the submittal of a grant application to Imagine Idaho Foundation to support technical engineering for RAPID. Imagine Idaho has awarded the City of McCall the grant. This grant will go toward engineering, planning and design for the City’s fiber infrastructure, reducing future troubleshooting and planning needs. The MOU is in support of the project and has been reviewed by the City Attorney. Action: Approve Memorandum of Understanding between the City of McCall and Imagine Idaho to accept grant award and authorize the Mayor to sign all necessary documents. Council Member Nielsen moved to approve the Consent Agenda as submitted. Council Member Nelson seconded the motion. In a roll call vote Council Member Callan, Mayor Giles, Council Member Maciaszek, Council Member Nielsen and Council Member Nelsen all voted aye, and the motion carried. PUBLIC COMMENT Mayor Giles called for public comment at 5:35 p.m. 3 written comments were received and will be included as Attachment A. Hearing no comments, Mayor Giles closed the comment period at 5:36 p.m. PUBLIC HEARING AB 21-251 Request to Approve Minor Plat Amendment SUB-21-03 at 1502 Mill Road for the Mill Park Condominiums Owner’s Association Mayor Giles called for the opening of the public hearing at 5:36 p.m. Council Member Nelson moved to open the public hearing. Council Member Council Member Nielsen seconded the motion. In a voice vote, all were in favor and motion carried. City Planner Brian Parker presented the legal notices and packet documents for SUB-21-03 at 1502 Mill Road for the Mill Park Condominiums Owner’s Association. Mayor Giles polled the Council for any conflict or ex-parte contact declarations of which there were none given. Planner Parker presented the staff report for the Minor Plat Amendment SUB-21-03 at 1502 Mill Road for the Mill Park Condominiums Owner’s Association. The minor plat amendment is to add common area to the existing platted common area. During their regularly scheduled September 7, 2021 meeting, the McCall Area Planning and Zoning Commission held a properly noticed public hearing and unanimously recommended approval of the application to the McCall City Council without a second public hearing. MCCALL CITY COUNCIL Page 3 of 9 October 21, 2021 Regular Meeting The Conditions of Approval are as follows: 1. Prior to recordation of the final plat, the applicant shall submit digital files of the amended plat in accordance with the McCall Digital Data Submission Standards (DDSS) for City of McCall review and approval. 2. Prior to recordation of the final plat, the applicant shall obtain final engineering approval from the McCall City Engineer. 3. The applicant shall provide the City of McCall with a .PDF copy of the recorded plat immediately upon recordation. Council Member Nelsen asked if there was any consideration for that property to enhance the adjacent City park. Planner Parker mentioned that no change of use was proposed for the property. Parks & Recreation Supervisor Kurt Wolf commented that if that property ever came up for sales the City would have interest in it but at this time there is a pathway easement on the property with positive conversations with the Mill Park Condominium Owners Association. Council Member Nielsen asked about the potential risk of losing access to Brown Park. Planner Parker noted that there is an existing platted easement with the City in perpetuity. The applicant did not present during the Public Hearing as they agree with the Findings of Facts provided by staff. Mayor Giles called for public comment at 5:52 p.m. No written or verbal comments given. Mayor Giles closed the public comment at 5:53 p.m. There were no further questions, additional witnesses, or rebuttals given. Council Member Nielsen moved to close the public hearing and proceed to deliberation. Council Member Nelson seconded the motion. In a voice vote, all voted aye, and the motion carried. Mayor Giles gave a summary of the proceedings and polled the Council for further comment. The Council did not have any further comments and were ready to move forward with a motion to approve the staffing report findings and recommendations. Council Member Nielsen moved to approve Minor Plat Amendment application SUB-21-03 for the Mill Park Condominiums Owner’s Association as recommended by the McCall Area Planning and Zoning Commission and authorize the Mayor to sign all necessary documents. Council Member Nelson seconded the motion. In a roll call vote Council Member Nielsen, Council Member Nelson, Mayor Giles, Council Member Callan, and Council Member Maciaszek all voted aye, and the motion carried. MCCALL CITY COUNCIL Page 4 of 9 October 21, 2021 Regular Meeting REPORTS AB 21-252 Tree Advisory Committee Annual Accomplishment Report John Lillehaug, Chair of the Tree Advisory Committee (TAC), presented Council with its annual accomplishment report for discussion on questions, concerns, or goals and objectives for 2022. The Tree Advisory Committee is responsible for the location, selection, and identification of any trees, which qualify as a landmark tree or stand, of identifying and inventorying street trees, of reviewing development proposals that may affect landscaping and provide comment to the Planning and Zoning Commission and City Council. th Mr. Lillehaug went over the year’s highlights which include the 20 annual Tree City USA Award, th the modified virtual Arbor Day event and receiving the 15 annual Tree City USA Growth Award. The Council expressed their gratitude for Mr. Lillehaug and the Tree Advisory Committee’s dedication. Covid-19 Update and Review of Mask Metrics Status Police Chief Justin Williams gave the Covid-19 update. Valley County’s case count is at 33 which is down from 38 at the last meeting. Valley County is still in a high transmission rate and the positivity rate is at 18%, down from 22%. Statewide, Covid-19 hospitalizations account for 23% of all hospitalizations. 43% of ICU patients in the St. Luke’s system are Covid-19 related and there are 15 ICU beds available and 641 ventilators available. Forecast from the CDC is at 33 weekly cases, 1 week ahead 24 cases, 2 weeks ahead 27 cases and 3 weeks ahead 17 cases. The county is on a steady decline of Coivid-19 cases. The Council did not have any questions and thanked staff for the report. AB 21-255 McCall Redevelopment Agency Annual Report Rick Fereday, Chairperson of the McCall Redevelopment Agency (MRA), presented the Board’s annual report to Council for the Urban Renewal District. In 1965, the State of Idaho created the Idaho Urban Renewal Law to allow a city or county governing board to designate areas for urban renewal projects aimed at eliminating or preventing deteriorated or deteriorating areas and developing and revitalizing underutilized areas. An urban renewal agency, governed by a board of commissioners appointed by the Mayor and confirmed by the City Council, is responsible for overseeing implementation of urban renewal plans that outline the necessary projects for specific areas. The McCall Redevelopment Agency was formed in 1990, and the currently oversees two Urban Renewal Districts in the downtown area. The MRA meets on the third Tuesday every month and consists of (7) seven members each serving a (3) three-year term. Mr. Fereday shared the highlights, challenges, and the last small projects that will be finished in the spring. He was specially connected and proud of the Mill Whistle project as he remembers the mill in its heyday and remembers the day the mill blew its whistle for the last time. The Council expressed gratitude to Mr. Fereday for his long-standing service, Legal Counsel Meghan Conrad, the committee members who have served, and recognized the importance the mill had in the community over the decades while it was in service. MCCALL CITY COUNCIL Page 5 of 9 October 21, 2021 Regular Meeting Community and Economic Development Director Michelle Groenevelt noted that Mr. Fereday has served on the McCall Redevelopment Agency since the mid-1990s and has been instrumental in many projects. BUSINESS AGENDA AB 21-256 Request Authorization for the City to Accept the Conveyance of land on Davis Avenue by quitclaim deeds from the McCall Redevelopment Agency (MRA) with Restrictive Covenant Agreements to the City of McCall Meghan Conrad, McCall Redevelopment Agency Attorney presented the authorization for the City to accept the Conveyance of land on Davis Avenue by quitclaim deeds from the McCall Redevelopment Agency (MRA) with Restrictive Covenant Agreements to the City of McCall. With the closing out of the 1990s Urban Renewal District, the McCall Redevelopment Agency (MRA) is transferring ownership of parcels they own to the City of McCall. The MRA Board issued Requests for Proposals on the two parcels and received submittals, but no development ever occurred on these properties due to numerous reasons. The documents were drafted by the MRA Attorney, Meghan Conrad, and have been reviewed by the City Attorney. The following items are included: 1. Adopted MRA Resolution 06-2021 approving conveyance for 1614 Davis Avenue parcel (RPM0000009110) and vacant lots on Pine Street (RPM017201100A and RPM0172011009A) 2. Quitclaim Deed for 1614 Davis Avenue 3. Quitclaim Deed for Pine Street Lots 4. Restrictive Covenant Agreement for 1614 Davis Avenue 5. Restrictive Covenant Agreement for Pine Street Lots 6. Warranty Deeds Community & Economic Development Director Michelle Groenevelt clarified that both parcels had Requests For Proposals put out for development, but the proposals did not move forward. Council Member Nielsen moved to authorize the City to Accept the Conveyance of the parcel of land located at 1614 Davis Avenue, Parcel No. RPM0000009110, and the parcels of land with no street address, identified as Parcel Nos. RPM017201100A and RPM0172011009A, by quitclaim deeds from the McCall Redevelopment Agency (MRA) with Restrictive Covenant Agreements to the City of McCall and authorize the Mayor to sign all necessary documents. Council Member Callan seconded the motion. In a roll call vote Council Member Nielsen, Council Member Callan, Mayor Giles, Council Member Maciaszek, and Council Member Nelson all voted aye, and the motion carried. AB 21-250 Request Approval of the Infield Development Utilities Sewer Line Project Airport Manager Rick Stein presented the Infield Development Utilities Sewer Line Project. Staff has requested a price for an Infield Development Area sewer line extension as this sewer line extension will service three new hangars, tentatively planned for construction the Summer of 2022 – and for future growth in the Infield Development Area. Staff met with T-O Engineers’ and Payette Lakes Recreational Water & Sewer District’s (PLRWSD) representatives for project. MCCALL CITY COUNCIL Page 6 of 9 October 21, 2021 Regular Meeting PLRWSD provided a tentative project agreement, subject to a drawing and specifications review. Estimated construction costs are approximately $50,000. PLRWSD has a review fee of $2,000. Funding is available at 100% through AIP 29 (CARES Grant - $11,203.23 available), AIP 30 (CRSSA Grant - $13,000 available) and AIP 32 (ARPA Grant - $32,000 available). Total available AIP funds are: $56,203.23. The Infield Development Utilities Project is listed on the FY 2023 CIP plan. Staff requests to move the project to FY2022 as funding, and customer demand, are currently in place. Ground leases for the three hangars will provide $15,000 to $20,000 in additional annual revenue. The Airport Advisory Committee has recommended this project. Staff clarified grant numbers and answered questions regarding the taxiway Alpha. The original plan was to burrow under the taxiway, but the cost was double the cost of the entire project, so staff advised T-O Engineers to look for other options. Council Member Nelson moved to approve the Infield Development Utilities Sewer Line Project for FY2022 and to authorize the Mayor to sign all necessary documents. Council Member Callan seconded the motion. AB 21-249 Request Approval of the ARPA/ARGP Act Grant Application to provide economic relief to the airport in response to the COVID-19 pandemic Airport Manager Rick Stein presented the ARPA/ARGP Act Grant Application to provide economic relief to the airport in response to the COVID-19 pandemic. As announced by the Secretary of Transportation on June 22, 2021, McCall Municipal Airport is eligible for $32,000 in funding under the American Rescue Plan Act 2021 (Public Law 117-2) (ARPA). The purpose of these funds is to provide economic relief to airports in response to the COVID-19 pandemic. The FAA will distribute these grants under the new Airport Rescue Grant Program (ARGP). These funds are to be used for costs related to operations, personnel, cleaning, sanitization, janitorial services, combating the spread of pathogens at the airport, and debt service payments. The deadline to apply for these funds is November 30, 2021. Council Member Nelson asked how the pandemic has impacted the airport budget. Airport Manager shared that most of the budget is made up of ground leases and items that were not impacted by Covid. Manager Stein noted that the airport ended the year in a surplus, but Covid did slow down traffic at the airport in the beginning of 2021, but traffic picked back up in July of 2021. Council had no further questions. Council Member Callan moved to approve the ARPA/ARGP Act Grant Application and to authorize the Mayor to sign all necessary documents. Council Member Maciaszek seconded the motion. MCCALL CITY COUNCIL Page 7 of 9 October 21, 2021 Regular Meeting AB 21-261 Request an Assignment of Interest in a Concession Use Agreement from Chuck and Peggy Whitescarver, dba Cheap Thrills Rentals to Cheap Thrills LLC, an Idaho Limited Liability Company for the remainder of agreement term Parks & Recreation Director Kurt Wolf presented the Assignment of Interest in a Concession Use Agreement from Chuck and Peggy Whitescarver, dba Cheap Thrills Rentals to Cheap Thrills LLC, an Idaho Limited Liability Company for the remainder of agreement term. Cheap Thrills Rentals is in the process of closing on the sale of their business to new owners and would like to transfer the current concession agreement term to the new owners upon purchase of the business. This transfer would only be finalized upon closing of the transaction for the business. It is staff’s recommendation that council review and approve the transfer of the remaining year on the existing concessional use agreement between the City of McCall and Cheap Thrills Rentals to the new owner’s name of Cheap Thrills LLC and to include the new owners’ names upon the final sale of the business. The Assignment of Interest and Concession Agreement have been reviewed by the City Attorney. There were no questions from Council. AB 21-258 Council Guidance for Content of the Annual Report/State of the City Communications Manager Erin Greaves presented the discussion regarding the Annual Report/State of the City. Staff is moving to a modern reporting process for annual reports. She gave a brief history of current process. In lieu of individual annual department reports, one unified piece will be developed and presented to the public. The goal is a more relevant and citizen- friendly presentation. She shared some of the ideas being considered for the State of the City document such as highlighting committees, businesses, accomplishments of the City, photos of the Council members, and projects. Staff would like guidance as to what type of content the Council would like to see as a part of the report. City Manager Anette Spickard clarified that staff is interested in changing the annual report to one comprehensive report as opposed to 12 individual repetitive department annual reports. In the past there has not been an annual report based on focusing on City Council. The report would include a segment on City Council and any highlights the Council would like to have included. Council Member Nielsen asked if the department heads will be at the retreat. Manager Spickard noted that the retreat has not been scheduled at this time but at the request of Council the department heads can be present at the retreat. Council Member Nielsen commented that an overall report is fine for out outward facing document but would still like individual reports from departments as well. MCCALL CITY COUNCIL Page 8 of 9 October 21, 2021 Regular Meeting Communication Manager Greaves clarified that the overall report will still include all the information from the department reports except there will be one document instead of 12 or 13 individual documents. Council Member Callan asked if a sample could be provided to Council. Manager Spickard noted that the document would still be the same information included in previous annual reports,but the information would be consolidated.The goal is not to remove information but clean up the process, consolidate the information and add a section about the Council. The community would have a more user-friendly document instead of having to go to each department report to find the information. Mayor Giles would like to see a report on the Streets LOT project as is it nearing its end and would like the report to include the progress on the project put on the Streets LOT schedule. It would be helpful if the City decided to go after a high tax in the future and gains the community trust with transparency. Mayor Giles is also very open to the new format and the vision staff has. Council Member Nielsen would like to capture the challenges as well as the successes. Communication Manager Greaves outlined the opportunity to make the annual report a tab on the website that is easy for the community to access and see the highlights and successes as well as the challenges faced over the past year. Staff will reach out to Council with samples. Council Member Nelsen thinks the idea to recognize ideas is great and the direction the staff is going with the report is the right direction. Council Member Maciaszek echoed Council Member Nelsen's comment. Upcoming Meetings Schedule Discussion Council discussed upcoming meetings. The last Friday in January is tentative set aside for the Council retreat and City Manager Anette Spickard asked Council to check their schedules to verify that date would be amenable to them. Mayor Giles asked Council would consider it possible for all members of Council to plan to attend in person when there is a land use public hearing. A popular phrase comes to mind - Follow the Science. What science was used to fear monger and abuse residents and business owners for the last 18 months? Questions Why did the McCall City Council put in several Mask Mandates and restrict local business operations which resulted in hardship both financial and personal to residents and businesses. Why did McCall Donnelly Schools close and then open with Mask Mandates still in effect. Why did Governor Little ban the off label use of hydroxychoroquine which has been in use for over 40 years? What testing was used to determine ""cases"" IN McCall and what cycle threshold was used for each positive Are any entities in McCall receiving funding of any type/sources for Sars CoV cases? Agenda Item 2: Full Financial Disclosure for decisions regarding Sars CoV to the City of McCall or the McCall Donnelly School District I request full disclosure of any/all money, payments, grants, and other compensation offered by NGOs, organizations, private individuals/companies or government agencies for with mask mandates, any and all other restrictions/requirments related to Sars-Cov (Covid) be enumerated in detail in the next financial report at a board meeting to include amounts, organizations/entities as well as stipulations for receipt of funds and if any, funds that were given from organizations to members personally, their families, or their business interests or other less known funding to outside interests regarding this issue. Chuck & Peggy Whitescarver’s have owned and operated Cheap Thrills Rentals in McCall for 25 years and have become a staple within the community along with providing visitors access to all that McCall has to offer in the great outdoors. It is their wish to retire this year and are currently under contract to sell the company to a local family vs. the several offers received from out of town and out of State buyers. Their commitment to support local businesses and youth groups through the years has been commendable. For the past 15 years, Whitescarvers have had a great working relationship with the City of McCall, by not only providing needed revenue for the city, but by providing ambassadorship at Legacy Beach. The proposed new ownership, Cheap Thrills, LLC owned by Gerry & Rachael Ikola wish to continue working with the City of McCall and Parks & Rec in a mutually beneficial agreement by not only transferring the current concession to new ownership but opting to create a new agreement for 3 years with the option to renew. This will give the City ample time to evaluate new ownership to determine if they want to continue the working relationship for a longer term. The current agreement is very clear, stating that the public has priority to use and enjoy the portion of the beach where Cheap Thrills operates, and we will ensure this continues to happen. We believe that if there is any confusion about the public not being able to access the proposed portion of the beach it is because the area is designated as a motorized section and not a swim area. It’s our opinion that if Cheap Thrills didn’t have a presence in the motorized area, then more guests would be using the docks for swimming, kayaking, and paddleboarding, which is highly dangerous next to a busy marina & launch area. Leaving ample space for the public to use the beach for their private boats and jet skis. With the fleet returning periodically between 4 & 6:30pm, the watercraft will be pulled out as quickly as possible to ensure the public has access to use the beach and boat launch. As Cheap Thrills, LLC is making a significant investment into the purchase of the business, and in order to close on the purchase we are needing to obtain at a minimum, a 3 year agreement with the City of McCall. We agree with the proposed contract and the new lease amount of approx... $10,000 per year with an agreed upon increase every year. We live here, our kids attend local schools, and we are very involved in local youth sports, so it’s in our interest to help preserve what is so great about McCall. We believe the amount is fair and we hope to see the funds go to more improvement of our parks and lake access for people to enjoy. Our intent is to continue to support local businesses and programs that benefit the area that we live in and love. There won’t be changes to how we operate the business at Legacy Beach, so it will remain relatively the same as what the Whitescarvers have done in the past. We may look to expanding offerings in the future to include paddleboards. We are honored to be given this opportunity from the Whitescarvers and are grateful for your time and consideration to move towards a mutually beneficial working partnership with the City of McCall.
