Stucki The City of Moab will hold a Special City Council Meeting on Tuesday, May 6, 2014 at 5:00 PM. The purpose of this meeting will be: 1-1 1-2 1-3 Budget Workshop Between the Governing Body and City Staff for the 2014-2015 Fiscal Year Proposed Annual Budget Approval of Applying Unclaimed Property(Bicycles) to a Public Interest Approval of the Donation of Unclaimed Property(Bicycles) to the Grand County School District The meeting will be held in the Council Chambers at tie Moab City Center at 217 East Center Street, Moab, Utah. REC-M EM-14-05-001 First EPA Green Power Community in the Nation MOAB CITY COUNCIL MEETING May 6, 2o14 Agenda item #: 1-2 Title: Unclaimed Bikes being donated to the School District for the Bike Rodeo Fiscal Impact: n/a Staff Presenter(s): Michael Navarre Department: Moab City Police Department Applicant: Cindy Montague Background/Summary: Unclaimed bikes in evidence inventory; proposing to be donated to the School District for the Bicycle Rodeo the end of May. Options: Approve, Deny or Table. Staff Recommendation: Pursuant to Utah State Code Section 77-24a-5, the public notices for unclaimed bikes have been posted on the Utah government website, the City website, and in the Moab City Police Department waiting area. It is proposed that unclaimed bikes (at least 50 to 100) after the required time not being claimed, be donated for the Bike Rodeo event. David Olsen is the person of interest heading the bike rodeo event. It is requested to have the bikes be donated to the School District. In turn Westem Spirit Cycling has volunteered to repair and fix up the bicycles to be used for the Bicycle Rodeo. Disposition of unclaimed property. (1) (a) If the owner of any lost or mislaid property cannot be determined or notified, or if the owner of the property is determined and notified, and fails to appear and claim the property after three months of its receipt by the local law enforcement agency, the agency shall: (i) publish notice of the intent to dispose of the unclaimed property on Utah's Public Legal Notice Website established in Subsection 45-1-101(2)(b); (ii) post a similar notice on the public website of the political subdivision within which the law enforcement agency is located; and (iii) post a similar notice in a public place designated for notice within the law enforcement agency. (b) The notice shall: (i) give a general description of the item; and (ii) the date of intended disposition. (c) The agency may not dispose of the lost or mislaid property until at least eight days after the date of publication and posting. (4) Before: applying the lost or mislaid property to a public interest use, the agency having possession of the property shall obtain from the agency's II legislative body: (a) permission to apply the property to a public interest use; and (b) the designation and approval of the public interest use of the property. (5) Any person employed by a law enforcement agency who finds property may not claim or receive property under this section. Amendment Notes. — The 2013 amend- ment, effective July 1, 2013, substituted "lost or mislaid" for "unclaimed" in the introductory language of (1)(a), (2)(b), and (3) and in (1)(c) and (2)(a); rewrote (1)(a)(i), which formerly read: "publish at least one notice of the intent to dispose of the unclaimed property: (A) in a newspaper of general circulation within the county; and (B) as required in Section 45-1-101; and"; added (1)(a)(ii) and (4); substituted (3)(a) through (c) for "dispose of that property and any other property that is not claimed under this chapter as provided by Section 77-24-4"; and made related and stylistic changes. The bikes can legally be donated to the school district for use in a Bike Rodeo that will be held May 31, 2014 at the Transit Hub ribbon cutting event. Options: Approve, Deny or Table Staff Recommendation: Donate as many bikes as can be fixed up and given to children at the Bike Rodeo.
