If the Council waives the fees, the impact would be a loss of $500. Staff Presenter(s): N/A Department: Special Events Applicant: Youth Garden Project Background/Summary: The Youth Garden Project has requested a waiver of the park use fee for Swanny City Park for the weekly Farmer's Market for events beginning on June 5 and ending on October 16, 2014. The fee is $25 per week and the total waiver would be for an amount not to exceed $500.00 A copy of the fee waiver policy is attached. 1 Ni Options: Approve, Approve with conditions, Deny or Postpone Staff Recommendation: There are costs associated with this event that would have to be absorbed by the City if the fee waiver is approved. Center Street Moab, UT 84532 Dear Council, I am writing to request a waiver of the Park Use Fee for the Moab Farmers' Market. As outlined in Resolution #19-2013, the Moab Farmers' Market meets the criteria to be considered for a fee waiver. The Moab Farmers' Market is run by the Youth Garden Project, a non-profit organization, as a program for the community. The general public is not charged to participate in the Farmers' Market. The Youth Garden Project collects nominal fees from vendors to help defray costs associated with running the market, however, these fees do not cover all the costs. YGP fundraiser to cover the remaining costs. A waiver of the Park Use fees would allow YGP to put more resources towards other educational programs for the Moab community. The Moab Farmers' Market is a weekly event for six months, beginning May 8{". Recognizing that this request is not being made one month prior to the first Farmers' Market, I would like the City to consider a fee waiver for the June 5th-October 16th Farmers' Markets. Page 6 of 71 Agenda City of Moab City Council Policy Regarding the Consideration of Fee Waiver Requests It is the general policy of the Moab City Council to not consider requests for fee waivers for city programs, services, permits and licenses. Further, the City Council has determined that exceptions to this general policy may be made at the sole discretion of the City Council, subject to certain conditions, as follows: 1. Requests for an exception to the fee waiver policy shall be made in writing at one month prior to the event or service for which the fee is charged. Such requests shall be submitted to the City Recorder's Office. If this timeframe is not met, the fee shall be paid in full, and the request will be considered as a request for a refund rather than a waiver. 2. The following fees are not subject to an exception under this policy: a. Fees related to public works, including but not limited to water and sewer fees, water and sewer impact fees, storm water drainage fees and solid waste fees. b. Fees related to planning and zoning, including but not limited to subdivision fees, annexation fees and permit fees. c. Fees related to recreation programs and services. d. Fees related to law enforcement, with the exception of traffic control and security fees associated with a special event. e. Fees related to alcohol. f. Other fees not provided for in this policy. 3. The City Council may consider an exception to the fee waiver policy for special -event - related fees, including special event permit fees, special event business license fees, park use permit fees, banner fees, and traffic control fees and security fees, if the organization requesting the exception meets at least one of the following criteria: a. The event, as its main function, is a fundraiser for a charitable organization that provides services to Moab residents. b. The organization sponsoring the event has in the past made and commits to continue to make in the future, a financial donation to the City that covers all or a portion of the costs associated with the event for which the organization is seeking an exception. c. The event organizer is a governmental entity. d. The event's primary purpose is to provide a school program or to benefit a school or school program. e. The primary purpose of the event is to provide a community -wide celebration or program that is offered free of charge to community members. f. The event is one that has been provided by the City in the past. 4. The City Council may consider an exception to the fee waiver policy for building permit fees only for requests made by Grand County or the City of Moab for county or city -owned facilities. The adjustment, if approved, will reduce Lot 2 from 2.5 acres to 1 acre. Lot 3 will increase from 3.58 acres to 5.08 acres. The amended lot sizes meet or exceed the zone lot area requirement of 1 acre. The request fully complies with State Code Chapter 10-9a-608(2) that allows a subdivision plat to be amended by the Land Use Authority (Council) without a public hearing if: (a) the petition seeks to: (i) join two or more of the petitioner fee owner's contiguous lots; (ii) subdivide one or more of the petitioning fee owner's lots, if the subdivision will not result in a violation of a land use ordinance or a development condition; (iii) adjust the lot lines of adjoining lots or parcels if the fee owners of each of the adjoining lots or parcels join in the petition, regardless of whether the lots or parcels are located in the same subdivision; (iv) on a lot owned by the petitioning fee owner, adjust an internal lot restriction imposed by the local political subdivision; or (v) alter the plat in a manner that does not change existing boundaries or other attributes of lots within the subdivision that are not: (A) owned by the petitioner; or (B) designated as a common area; and (b) notice has been given to adjacent property owners in accordance with any applicable local ordinance. (3) Each request to vacate or amend a plat that contains a request to vacate or amend a public street, right-of-way, or easement is also subject to Section 10-9a-609.5. THIS AGREEMENT is made and entered into based upon the following representations made by the parties to each other: 1. The City of Moab is a duly created and existing body politic of the State of Utah and has the legal authority and power to enter into this Agreement and to execute the same by and through the undersigned Mayor of the CITY. 2. HASU is a duly created and existing nonprofit corporation under the laws of the State of Utah and has the legal authority and power to enter into this Agreement and to execute the same. PURPOSE OF THIS AGREEMENT: This agreement is entered into as a result of a Community Development Block Grant (CDBG) awarded to the CITY for the 2014 calendar year on behalf of HASU, for the purpose of improving the Virginian Apartments (hereinafter referred to as the "PROJECT"). All provisions herein are subordinate to and in fulfillment of the contract between the Utah Department of Workforce Services, Housing and Community Development Division (herein after referred to as STATE) and the CITY for said Community Development Block Grant. AGREEMENT PERIOD: This agreement shall be effective after the signing of this agreement and shall terminate December 31, 2015, unless terminated sooner, in accordance with the terms and conditions of this agreement, or any other contract or agreement which may be entered into for the accomplishment of the above mentioned project. ADMINISTRATION OF FUNDS: The parties herby agree that CITY shall administer CDBG funds in the amount not to exceed $220,000. The Moab City Community Development Director shall act on behalf of the CITY as the primary contact and administrator of said funds. The Moab City Community Development Director shall coordinate funding for the PROJECT with HASU to ensure that the goals and requirements of the PROJECT as established by the terms of the Community Development Block Grant contract are achieved. ADMINISTRATION OF PROJECT: The parties agree that HASU will administer procurement and construction of the PROJECT in accordance with Community Development Block Grant procurement and purchasing polices and procedures. HASU shall be responsible for quality control of the PROJECT and to inspect and correct work of contractors as needed. HASU shall comply will all applicable federal regulations and provide the CITY with all documentation requested to fulfill the Community Development Block Grant requirements. The CITY assumes no responsibility or liability in case HASU neglects to meet said policies, procedures and regulations. MAINTENANCE OF AFFORDABILITY: HASU shall maintain affordability standards as set forth by the terms of the Community Development Block Grant for at least five years following the date of the close-out of the Community Development Block contract. Any lapse of the maintenance of affordability of the project shall be the sole responsibility of HASU and not the CITY. Any penalties assessed or funds returned to CDBG due to the lapse of affordability or any other reason shall be paid by HASU and not the CITY.
