A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, ORDERING A GENERAL ELECTION FOR
THE OFFICES OF CITY COUNCIL PLACES 1, 3, AND 5; SUCH
REGULAR ELECTION TO BE HELD ON SATURDAY, MAY 9, 2015;
ESTABLISHING PROCEDURES FOR THE ELECTION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, May 9, 2015, is designated as a uniform election day; and
WHEREAS, by this resolution, it is the intention of the City Council to call the 2015
General Election as required by the City Charter and by other law, designate a polling place for
the election, and establish and set forth procedures for conducting the election; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for General Election.
The City Council hereby orders that a general election shall be held in the City of
Richland Hills on Saturday, May 9, 2015, at which the following officials will be elected:
City Council, Place 1
City Council, Place 3
City Council, Place 5
Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to contract (the "Contract") with Tarrant County for
joint election services. In the event of a conflict between this Resolution and the Contract, the
Contract shall control.
Section 3. Polling Place.
The polling place for the Election shall be as follows:
Richland Hills Community Center
3204 Diana Drive
Richland Hills, Texas 76118
Other polling places may be provided as provided in the Contract. The polls shall be open from
7:00 a.m. to 7:00 p.m. on May 9, 2015, in accordance with and pursuant to the requirements of
the Texas Election Code.
The City shall constitute a single election precinct for said election.
Section 4. Filing Dates.
In accordance with Section 143.007 of the Texas Election Code, eligible persons wishing
to become candidates must file an application with the City Secretary of the City of Richland
Hills, Texas 76118, and may do so beginning Wednesday, January 28, 2015 and continue
through Friday, February 27, 2015, until 5:00 p.m. Each application shall be on a form meeting
the requirements of Section 141.031 of the Texas Election Code.
Section 5. Ballots and Election Method.
Combined ballots maybe utilized containing all of the offices and propositions to be voted on at
each polling place, provided that no voter shall be given a ballot or permitted to vote for any
office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance shall be conducted exclusively on Tarrant County's eSlate electronic voting system.
On Election Day, voters shall have a choice between voting on the eSlate electronic voting
system or by a paper ballot that is scanned at the polling place using Tarrant County's eScan
voting system. All expenditures necessary for the conduct of the election, the purchase of
materials therefore, and the employment of all election officials are hereby authorized, and shall
be conducted in accordance with the Contract and the Code. The order in which the names of
the candidates are to be printed on the ballot shall be determined by a drawing by the City
Secretary pursuant to state law. Notice of the time and place for such drawing shall be given in
accordance with the Code.
Section 6. Early Voting.
a. Early voting by personal appearance. Frank Phillips, Tarrant County Elections
Administrator, is hereby appointed as the Early Voting Clerk for the election, as so indicated in
the Contract. Early voting by personal appearance shall commence April 27, 2015 and shall
continue until May 5, 2015. The main early voting site shall be at Richland Hills Community
Center, 3204 Diana Drive, Richland Hills, Texas. Specific days, times and locations shall be
designated by the Elections Administrator and included in the Contract and shall be in
compliance with state law. On at least two weekdays during the early voting period, the location
for early voting shall be open for at least twelve (12) hours as mandated by state law.
b. Early voting by mail. The Elections Administrator shall be responsible for the Early
Voting applications and ballots. Applications for early voting by mail maybe delivered to Frank
Phillips, County of Tarrant, Elections Administrator, 2700 Premier Street, Fort Worth, Texas
76111, not earlier than March 10, 2015, and not later than close of business on Apri124, 2015, if
delivered in person, and April 30, 2015 if delivered by mail. Early voting by ballots shall be
mailed to the Elections Administrator at the same address. The City Secretary is directed to
forward applications and ballots she may receive to the Elections Administrator as provided in
the Contract.
c. Early voting ballot board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the
Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 7. Notice.
Notice of said election shall be given as required by the Texas Election Code.
Section 8. Election Officials.
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as permitted by law. The presiding judge shall appoint
elections clerks as may be necessary for the proper conduct of the election. The election judge, or
the alternate election judge in the absence of the election judge, and the election clerks shall
constitute the early voting ballot board. The election judge, and alternate election judge, and
election clerks shall be qualified voters of the city.
Section 9. Governing Law.
The election shall be held in accordance with the Constitution of the State of Texas and
the Texas Election Code, and all resident qualified voters of the City shall be eligible to vote at
the election.
Section 10. Submission to the United States Justice Department.
The City Secretary of the City of Richland Hills, Texas, or the City Attorney, is
authorized to make such submissions as are necessary to the United States Justice Department to
seek pre-clearance as required bylaw.
Section 11. Necessary Actions.
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, the City Charter, and the City Code in carrying out and conducting the election, whether
nor not expressly authorized by this Order.
Section 12. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 13. Notice and Publication
This Resolution shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the General
Election. A copy of the resolution shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 14. Effective Date.
This order shall be effective upon its adoption.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, QUE ORDENA LA CELEBRACION DE
LAS ELECCIONES GENERALES PARR LOS PUESTOS 1, 3 Y 5 DEL
CONCEJO MUNICIPAL; TALES ELECCIONES SE CELEBRARAN EL
SABADO 9 DE MAYO DEL 2015; SE ESTABLECERAN LOS
PROCEDIMIENTOS PARR LAS ELECCIONES; Y SE
PROPORCIONARA LA FECHA DE VIGENCIA.
POR CUANTO, el 9 de mayo se designa como el dia uniforme de elecciones; y
POR CUANTO, mediante esta resolucion, es la intencion del Concejo Municipal
convocar Las Elecciones Generales de 2015, tat como to requiere la Constitucion de la Ciudad y
la ley, designar un Lugar de votacion Para Las elecciones y establecer Los procedimientos Para la
realizacion de dichas elecciones; y
AHORA, POR LO TANTO, SE RESUELVE POR EL CONCEJO MUNICIPAL
DE LA CIUDAD DE RICHLAND HILLS, TEXAS QUE:
Seccion 1. Orden electoral Para Las Elecciones Generales.
El Concejo Municipal resuelve por la presente que Las elecciones generates se celebren en
la Ciudad de Richland Hills el sabado 9 de mayo del 2015 para elegir a Los siguientes
funcionarios:
Concejo Municipal, Puesto 1
Concejo Municipal, Puesto 3
Concejo Municipal, Puesto 5
Seccion 2. Contrato de administracion de eleccion conjunta
Se autoriza por la presente a la Secretaria de la Ciudad a contratar ("el Contrato") el Condado de
Tarrant para Los servicios de la eleccion conjunta. En caso de conflicto entre esta Resolucion y el
Contrato, el Contrato prevalecera.
Seccion 3. Lugar de votacion (Centro electoral).
El Lugar de votacion para Las elecciones sera el siguiente:
Richland Hills Community Center
3204 Diana Drive
Richland Hills, Texas 7611 S
Se pueden proporcionar otros lugares de votacion, Begun to dispuesto en el Contrato. Los centros
electorates estaran abiertos el 9 de mayo del 2015 de 7:00 a.m. a 7:00 p.m., de acuerdo con y en
cumplimiento de Los requisitos del Codigo Electoral de Texas.
La Ciudad constituira un solo precinto electoral para dichas elecciones.
Seccion 4. Fechas de Presentaci5n.
De acuerdo con la Seccion 143.007 del Codigo Electoral de Texas, Las personas elegibles
que deseen presentarse como candidatos deberan presentar una solicitud ante la Secretaria de la
Ciudad de la Ciudad de Richland Hills, Texas 76118 y pueden hacerlo a partir del miercoles 28
de enero de 2015 hasta el viernes 27 de febrero de 2015 a Las 5:00 p.m. Cada solicitud debera
llenar Los requisitos de la Seccion 141.031 del Codigo Electoral de Texas.
Seccion 5. Las papeletas y el metodo de la elecci5n.
Se podran utilizar papeletas combinadas que incluyan todos Los puestos y proposiciones por Los
que se va a votar en cada Lugar de votacion, siempre y cuando que no se le provea o permita a
ningun elector votar por un puesto o proposition para el que el elector no es elegible para votar.
La votacion temprana en persona debera llevarse a cabo solamente mediante el sistema electoral
electronico eSlate del Condado de Tarrant. El dia de Las elecciones Los electores tendran la
oportunidad de votar en el sistema electoral electronico de eSlate o en la papeleta que se
escaneara en el mismo Centro electoral y que utiliza el sistema electoral eScan del Condado de
Tarrant. Todos Los gastos necesarios para la realization de Las elecciones, la compra de Los
materiales, por to tanto, y el empleo de todos Los funcionarios electorates se autorizan por la
presente y se llevaran a cabo de conformidad con el Contrato y el Codigo. El Orden en que Los
nombres de Los candidatos apareceran en la papeleta se determinara mediante un sorteo realizado
por la Secretaria de la Ciudad de acuerdo con la ley estatal. El aviso de la hora y el Lugar para tat
sorteo se dara de acuerdo al Codigo.
Seccion 6. Votacion temprana.
a. Votacion temprana en persona. Frank Phillips, el Administrador Electoral del
Condado de Tarrant, es nombrado por la presente como el Official de Votacion Temprana para la
election, como se indica en el Contrato. La votacion temprana en persona se llevara a cabo desde
el 27 de abril de 2015 hasta el 5 de mayo de 2015. El Lugar principal de la votacion temprana
sera Richland Hills Community Center, ubicado en 3204 Diana Drive, Richland Hills, Texas.
Las fechas, horas y lugares especificos seran determinados por el Administrador Electoral y se
incluiran en el Contrato y estaran en conformidad con la ley estatal. Por to menos dos dias de la
semana durante el periodo de votacion temprana el Lugar de votacion estara abierto al menos
dote (12) horas, como to estipula la ley estatal.
b. Votacion temprana por correo. El Administrador Electoral estara a cargo de Las
solicitudes y Las papeletas de la votacion temprana. Las solicitudes para la votacion temprana por
correo se pueden entregar en persona a Frank Phillips, Condado de Tarrant, Administrador
Electoral, 2700 Premier Street, Fort Worth, Texas 76111, no antes del 10 de marzo de 2015 ni
despues del 24 de abril de 2015. Si se envian las solicitudes por correo, deben llegar no mas
tardar del 30 de abril del 2015. La votacion temprana por papeleta debe ser enviada por correo a
nombre del Administrador Electoral en la misma direccion. Se ha instruido a la Secretaria de la
Ciudad a enviar toda solicitud y papeleta que reciba en su oficina al Administrador Electoral, tal
Como to dispone el Contrato.
c. Junta de papeletas de votacion temprana. Los votos de la votacion temprana, en
persona y por correo, seran escrutados por la Junta de Papeletas de Votacion Temprana, que se
crea por la presente. De acuerdo al Contrato, el Condado de Tarrant nombrara la Junta de
Papeletas de Votacion Temprana pars tabular los resultados de la votacion temprana de esta
eleccion.
Seccion 7. Notificacion.
Aviso de dicha eleccion se dara como to exige el Codigo Electoral de Texas.
Seccion 8. Autoridades electorales.
El juez electoral, el juez electoral alterno y la junta de las papeletas seran nombrados por
el Administrador Electoral del Condado de Tarrant, Begun to permite la ley. El juez que preside
nombrara a los funcionarios electorales Begun sea necesario para que las elecciones se realicen
adecuadamente. El juez electoral, o el juez electoral alterno en ausencia del juez electoral, y los
funcionarios electorales constituiran la junta de papeletas de la votacion temprana. El juez
electoral, el juez electoral alterno y los funcionarios electorales deberan ser electores de la
Ciudad.
Seccion 9. Ley aplicable.
Las elecciones se llevaran a Cabo de conformidad con la Constitucion del Estado de
Texas y el Codigo Electoral de Texas, y todos los residentes calificados que residen en la Ciudad
seran elegibles para votar en las elecciones.
Seccion 10. Presentacion al Departamento de Justicia de los Estados Unidos.
La Secretaria de la Ciudad de Richland Hills, Texas o el Procurador de la Ciudad estan
autorizados a presentar estas propuestas, segue sea necesario, al Departamento de Justicia de los
Estados Unidos en busca de pre-certificacion como to exige la ley.
Seccion 11. Acciones necesarias.
El Alcalde y la Secretaria de la Ciudad, en consulta con el Procurador de la Ciudad, estan
autorizados y dirigidos y tomar las acciones necesarias para cumplir con las disposiciones del
Codigo Electoral de Texas, la Constitucion de la Ciudad y el Codigo de la Ciudad para la
realizacion de las elecciones, aunque no este expresamente autorizado por la presente Orden.
Seccion 12. clausula de divisibilidad.
Se declara por la presente que la intention del Concejo Municipal es que las secciones,
parrafos, oraciones, clausulas y frases de esta orden son divisibles y que si cualquier frase,
clausula, oracion, parrafo o Seccion se declara nula o inconstitucional por una sentencia valida o
decreto de cualquier tribunal de jurisdiction competente, tal nulidad o inconstitucionalidad no
afectara a ninguna de las restantes frases, clausulas, oraciones, parrafos y secciones de esta
orden, ya que la misma hubiese sido aprobada por el Concejo Municipal sin la incorporation en
esta orden de cualquier dicha frase, clausula, oracion, parrafo o Seccion nula o inconstitucional.
Seccion 13. Notification y publication.
Esta resolution servira como la Orden de Elecciones (como to requiere la Seccion 3.001
del Codigo) y como la Notification de Elecciones (como to requiere la Seccion 4.001 del
Codigo) para Elecciones Generales. Una copia de esta resolution se publicara en el tablon de
edictos que se utiliza para publicar los avisos de las juntas del Concejo Municipal, al menos
veintiun (21) digs antes de las secciones. Se publicara una notification el periodico de
conformidad con la ley estatal.
Seccion 14. Fecha de vigencia.
Esta orden entrara en vigor a partir de la fecha de su adoption.
