HomeMy Public PortalAboutOrdinance 3137ORDINANCE NO. 3137 AN ORDINANCE APPROVING A MAJOR CHANGE TO A PLANNED DEVELOPMENT TO ALLOW SPEEDWAY LLC TO DEVELOP A FUELING STATION AT THE SOUTHEAST CORNER OF ROUTE 30 (JOLIET ROAD) AND RENWICK ROAD, PLAINFIELD, ILLINOIS WHEREAS, the Village of Plainfield has considered a request for a Major Change to a Planned Development (hereinafter referred to as "PD") to allow Speedway LLC to develop a fueling station on approximately 5.6 acres at the southeast comer of Route 30 (Joliet Road) and Renwick Road, and hereby adopts the findings made by the Village Plan Commission based on the evidence presented in said case that: a. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted in the immediate area, nor substantially diminish property values within the neighborhood; and b. The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent properties for uses permitted in the subject zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS, AS FOLLOWS: Section 1: Recitals - The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings recited. Section 2: Approval - Subject to the conditions set forth below, the President and Board of Trustees of the Village of Plainfield hereby approve a Major Change to the Planned Development for Speedway LLC to develop a fueling station at the southeast corner of Route 30 (Joliet Road) and Renwick Road for the following tract of land, to -wit: LOT 1 IN HERON POINT PLAT OF CONSOLIDATION P.U,D., BEING A PART OF THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 36 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN WILL COUNTY, ILLINOIS. Section 3: Conditions - That said Major Change to the Planned Development shall be subject to the following conditions: Compliance with the requirements of the Village Engineer. 2. Compliance with the requirements of the Plainfield Fire Protection District. Section 4: Severability — The various portions of this Ordinance are hereby expressly declared to be severable, and the invalidity of any such portion of ! 1 this Ordinance shall not affect the validity of any other portion of this Ordinance, which shall be enforced to the fullest extent possible. Section 6: Repealer — All Ordinances or portions of Ordinances previously passed or adopted by the Village of Plainfield that conflict with or are inconsistent with the provisions of this Ordinance are hereby repealed. Section 6: Effective Date — This Ordinance shall be in full force and eff,ect from and after its passage and approval as required by law. PASSED THIS 6TH DAY OF JANUARY, 2014.
