AN ORDINANCE APPROVING A MAJOR CHANGE TO A PLANNED
DEVELOPMENT TO ALLOW K. HOVANIAN T & C HOMES AT ILLINOIS LLC
TO CONVERT THE MAJORITY OF FAIRFIELD RIDGE SUBDIVISION TO A
CONVENTIONAL, FRONT -LOADED, SINGLE-FAMILY DETACHED PRODUCT
WHEREAS, the Village of Plainfield has considered a request for a Major Change
to a Planned Development (hereinafter referred to as "PD") to allow K. Hovanian T & C
Homes at Illinois LLC to convert the majority of the Fairfield Ridge Subdivision to a
conventional, front -loaded, single-family detached product, including eliminating the
associated alleys and including new architectural elevations, and hereby adopts the
findings made by the Village Plan Commission based on the evidence presented in said
case that:
a. The special use will not be injurious to the use and enjoyment of other property
in the immediate area for the purposes already permitted in the immediate area,
nor substantially diminish property values within the neighborhood; and
b. The establishment of the special use will not impede the normal and orderly
development and improvement of the adjacent properties for uses permitted in
the subject zoning district.
C. The PD fulfills the objectives of the comprehensive plan and the land use
policies of the Village and presents an innovative and creative approach to the
development of land and living environments.
d. The proposed land uses fulfill, or can reasonably be expected to fulfill, a need or
demand for such uses within the Village.
e. The physical design of the PD efficiently utilizes the land, adequately provides
for transportation and public facilities, and preserves natural features of the site,
and that the property is suitable for the proposed purposes and land uses.
f. Any exceptions to bulk and density regulations of the underlying zoning shall be
solely for the purpose of promoting an efficient and coordinated site plan, no
less beneficial to the residents or occupants of such development, as well as
the neighboring property, than would be obtained under the bulk and density
regulations of this ordinance for buildings developed on separate zoning lots.
g. The PD meets the requirements and standards of the planned development
regulations.
h. Open spaces and recreational facilities are provided.
The PD is compatible with the adjacent properties and the neighborhood, and
along the periphery of the PD, yards or setbacks shall be provided that meet or
exceed the regulations of the district in which the PD is located.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES,
ILLINOIS, AS FOLLOWS:
Section 1: Recitals - The President and Board of Trustees of the Village of
Plainfield hereby adopt and incorporate as their own, the above findings recited.
Section 2: Approval - Subject to the conditions set forth below, the President
and Board of Trustees of the Village of Plainfield hereby approve a Major Change to the
Planned Development to aflow K. Hovaniian T & C Homes at Illinois LLC to convert the
majority of the Fairfield Ridge Subdivision to a conventional, front -loaded, single-family
detached product, including eliminating the associated alleys and including new
architectural elevations for the following tract of land, to -wit:
LOTS 17 THROUGH 73 BOTH INCLUSIVE, IN FAIRFIELD RIDGE
SUBDIVISION, BEING A SUBDIVISION OF PART OF THE
SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 35 NORTH,
RANGE 9, EAST OF THE THIRD PRINCIPAL MERIDIAN, NORTH AND
SOUTH OF THE INDIAN BOUNDARY LINE, ACCORDING TO THE
PLAT THEREOF RECORDED APRIL 6,2006 AS DOCUMENT NUMBER
R2006-58421, AND AS AMENDED BY AN INSTRUMENT OF
CORRECTION RECORDED JUNE 29, 2006 AS DOCUMENT NO.
R2006-106806 EXCEPT THAT PART OF LOT 73 LYING EASTERLY OF
THE EASTERLY LINE OF LOTS 7 THROUGH 12 BOTH INCLUSIVE,
ALSO THAT PART LYING WESTERLY OF THE WEST LINE OF LOTS 6
AND 13 THROUGH 16 BOTH INCLUSIVE, ALSO THAT PART LYING
SOUTH OF THE SOUTHERLY LINE OF LOTS 16 AND 17 AND THE
PROLONGATION THEREOF TO THE WEST LINE OF LOT 74, ALL IN
WILL COUNTY, ILLINOIS.
Section 3: Conditions - That said Major Change to the Planned Development
shall be subject to the following conditions:
Compliance with the requirements of the Village Engineer.
2. Compliance with the requirements of the Plainfield Fire Protection District.

Section 4: Severability — The various portions of this Ordinance are hereby
expressly declared to be severable, and the invalidity of any such portion of this
Ordinance shall not affect the validity of any other portion of this Ordinance, which shall
be enforced to the fullest extent possible.
Section 5: Repealer — All Ordinances or portions of Ordinances previously
passed or adopted by the Village of Plainfield that conflict with or are inconsistent with
the provisions of this Ordinance are hereby repealed.
Section 6: . Effective Date — This Ordinance shall be in full force and effect
from and after its passage and approval as required by law.
