SPECIAL MEETING
June 5, 2014
Moab City Council held a Special Meeting on the above date in the Council
Chambers at the Moab City Center, located at 217 East Center Street,
Moab, Utah. Mayor David L. Sakrison called the Special Meeting to order
at 6:04 PM. In attendance were Councilmembers Doug McElhaney, Kirstin
Peterson and Gregg Stucki. Also in attendance were City Manager Donna
Metzler, City Recorder/Assistant City Manager Rachel Stenta and Police
Chief Mike Navarre. No members of the audience and media were present.
A presentation was made regarding the proposed 2013-2014 Fiscal Year
Budget. Discussion followed between City Staff and the Governing Body.
A presentation was made regarding the amended 2014-2015 Fiscal Year
Budget. Discussion followed between City Staff and the Governing Body.
Councilmember Peterson moved to Enter an Executive Session for a
Strategy Session to Discuss Pending or Reasonably Imminent Litigation.
Councilmember Stucki seconded the motion. The motion carried 3-0 aye.
An Executive Session was entered at 6:17 PM.
Councilmember Stucki moved to close the Executive Session.
Councilmember McElhaney seconded the motion. The motion carried 3-0
aye.
The Executive Session was closed at 6:29 PM.
Councilmember Peterson moved to adjourn. Councilmember Stucki
seconded the motion. The motion carried 3-0 aye.
Mayor Sakrison adjourned the Special Meeting at 6:29 PM.

The Moab City Council held its Regular Meeting on the above date in the
Council Chambers at the Moab City Center, located at 217 East Center
Street, Moab, Utah.
Mayor David L. Sakrison called the Pre -Council Workshop to order at
6:30 PM. In attendance were Councilmembers Heila Ershadi, Gregg
Stucki and Kirstin Peterson. Also in attendance were City Manager
Donna Metzler, City Recorder/Assistant City Manager Rachel Stenta, City
Treasurer Jennie Ross, Planning Director Jeff Reinhart, Community
Development Director David Olsen, City Engineer Rebecca Andrus,
Police Chief Mike Navarre and Public Works Director Jeff Foster.
Mayor Sakrison called the Regular City Council Meeting to order at 7:00
PM and led the pledge of allegiance. Seven (7) members of the audience
and media were present.
Councilmember Stucki moved to approve the Regular Meeting Minutes
of May 27, 2014. Councilmember Ershadi seconded the motion. The
motion carried 3-0 aye.
Under Citizens to Be Heard, J.R. Oakes of B. Jackson Construction spoke
on behalf of the Questar Project and stated that the project was 75%
finished and he thanked the City and City Crews for all of their help on
the project.
A Community Development Department Update was not given.
Under Engineering Department Update, City Engineer Andrus stated
that she was working on a transition plan and including other staff for
overlap. City Engineer Andrus stated that she had met with Grand
County regarding the Bicycle Advisory Committee and would meet with
USGS regarding the proposed water study.
A Planning Department Update was not given.
A Police Department Update was not given.
Under Public Works Department Update, Public Works Director Foster
stated that enhancements had been made to the pedestrian signals on
Main Street including new signage, cameras and stop bars.

Mayor Sakrison proclaimed June 30 to July 6, 2014 as Independent's
Week in Moab.
Mayor Sakrison opened a public hearing on Proposed Ordinance #2014-
05 — An Ordinance Amending the City of Moab Classified Hourly Pay Rate
Schedule and Exempt and Elected Officials' Salaries at 7:11 PM.
No public comment was given.
Mayor Sakrison closed the public hearing at 7:16 PM.
Councilmember Peterson moved to approve Proposed Resolution #23-
2014 — A Resolution Adopting the Fiscal Year 2014-2015 Annual Budget.
Councilmember Stucki seconded the motion. The motion carried 3-0 aye
by a roll -call -vote.
Councilmember Ershadi moved to approve Proposed Resolution #27-
2014 — A Resolution of the Governing Body Declaring Certain City
Property as Surplus. Councilmember Peterson seconded the motion.
The motion carried 3-0 aye.
Councilmember Stucki moved to Send Proposed Resolution #25-2014 — A
Resolution Amending the Fiscal Year 2013-2014 Annual Budget to Public
Hearing. Councilmember Ershadi seconded the motion. The motion
carried 3-0 aye.
Councilmember Peterson moved to approve Proposed Resolution #28-
2014 — A Resolution Adopting Changes in the City of Moab Sewer Rate
Structure. Councilmember Ershadi seconded the motion. The motion
carried 3-0 aye.
Councilmember Ershadi moved to approve Proposed Resolution #29-
2014 — A Resolution Amending the City of Moab Health Reimbursement
Account (HRA) Plan. Councilmember Peterson seconded the motion.
The motion carried 3-0 aye.
Councilmember Ershadi moved to approve Proposed Resolution # 26-
2014 — A Resolution Approving a Petition for a Boundary Line
Adjustment to Lots 5, 6, and 7 of the Bowen Subdivision.
Councilmember Stucki seconded the motion. The motion carried 3-0
aye.
Under Mayor and Council Reports, Mayor Sakrison stated that he had
been appointed to the State Drinking Water Board and that he attended

the Governor's Rural Partnership Board Meeting and that the
Governor's Office of Economic Development was looking at funding the
water study and that Spencer Eccles was resigning from the Governor's
Office.
Councilmember Ershadi stated that she had received a stack of letters
from citizens on community concerns that are awaiting action.
Councilmember Peterson stated that she had attended the Transit Hub
opening and accepted a plaque from the State on behalf of the City and
that it had been a very good ceremony.
Councilmember Sakrison stated that he had attended the unveiling of
the Arches National Park Quarter and that the Lieutenant Governor and
the Deputy Treasurer had also attended. Mayor Sakrison stated that
over $20,000 of quarters were sold at the unveiling.
Councilmember Ershadi stated that there is a land workshop at the
Grand County Courthouse every Tuesday for those interested in
attending.
There was no Correspondence to be Read.
Under Administrative Report, City Manager Metzler stated that staff had
been working on the year-end budget closing and had been monitoring
the budget closely. City Manager Metzler also stated that staff were
working on transition plans for the Recreation Coordinator and the City
Engineer. City Manager Metzler stated that Engineering candidates
would be interviewed the next week and Recreation candidates the
following week.
A Report on City/County Cooperation was not given.
Councilmember Ershadi moved to pay the bills against the City of Moab
in the amount of $338,746.54. Councilmember Stucki seconded the
motion. The motion carried 5-0 aye by a roll -call -vote.
Mayor Sakrison adjourned the Regular Council Meeting at 7:25 PM.

Title: Approval of Permits for the Moab Pride Festival
Fiscal Impact: Impacts should be minimal. City staff is currently reviewing the traffic
control requirements for the Visibility March component of the event. The march has
not required additional law enforcement staff in the past, but the projected increase in
the number of participants may require a fee, which the organizers have been notified
of.

Applicant: Moab Pride — Sallie Hodges
Background/Summary:
This event is an established event. However, it does entail a change in venue for the
festival portion of the event, along with a request for a Special Event Beer License for a
beer garden. The march will follow the same route as in the past, but the event is being
proposed for Swanny Park instead of Old City Park. The march will start at 11 am and
the Festival will run from 12 noon until 5:0o p.m. The applicant has provided
information about the Pride Festival's providing benefits to the community. Staff
concur that the event has a large number of local participants and a community focus,
therefore meeting the criteria for use of Swanny Park. The relocation of the event to
Swanny Park from Old City Park actually gives the city more oversight of the event,
since it would now be within City limits. With the event previously at Old City Park, all
event licensing was under the auspices of Grand County, even though the event took
place at Old City Park. We have met with event organizers and do not foresee any
problems with this event. This event entails approval of the following permits:
1. Approval of a Special Business Event License
2. Approval of a Class IV Special Event Beer License
3. Approval of Local Consent for a state -issued Special Event Beer Permit
4. Approval of a Special Use of City Parks Permit for Swanny Park
5. Approval of a Park Alcohol Permit

Options: For each item, the Council may approve, approve with conditions, deny or
postpone the item.
Staff Recommendation: Staff recommends approval of all items, subject to the
state required approvals, abidance by all park policies, and the following conditions:
1. No parking shall be allowed on the lawn at Swanny Park, with the exception of the
loading and unloading of vehicles. All food vendors must be either located off the lawn
or provide heat protection under cooking units.
2. The event organizer will coordinate with the Police Department on specific traffic
control needs.
3. The event organizer will pay all park fees at least two weeks prior to the event. The
fee is $Zoo plus a $5oo refundable damage deposit. Any required traffic control fees will
be paid two weeks prior to the event. Notification for required fees will be provided to
the applicant by July 15, 2o14.
4. The event organizer will provide a list of event vendors to the City Treasurer prior to
the event, and an updated list after the event.
5. The event organizer will provide two porta-potties, to be placed on a non -grassy
area.
6. The event organizer will provide for event clean-up and recycling.
7. The event organizer will provide information about the no -dog policy in event
materials and will remind participants of the policy during the event.
8. Event organizers will ensure that there is no parking in red zones around the park.

PRIDE
Moab Pride is a Non-profit organization whose mission is to foster understanding,
acceptance and support for the LGBTQ community living in Moab and beyond. The
Pride Festival serves as a beacon in South Eastern Utah where people are invited to
come together regardless of age, gender, religious or political affiliation. It serves as a
way to bring the community to a greater understanding of difference and diversity.
Now in its fourth year it has continued to grow with the help and support of many Salt
Lake organizations who see our festival as an important outreach post for issues
concerning the LGBTQ community. As well as Salt Lake, our festival has grown to
attract many people from all over South Eastern Utah and Colorado, benefitting local
businesses and the overall economy. The festival is a celebration of diversity, a way to
entertain, engage and delight not only the LGBTQ community but the friends, families
and allies, who also share the same idea that one day all people will be treated as
equal.
Moab Prides vision was to set up a year round presence offering information, help and
support to those identifying as LGBTQ within the Moab community. We have finally
achieved our goal by partnering with the Moab Valley Multicultural Center who have
generously donated a space to serve as a drop in. Both our organizations seek to serve
the needs of often overlooked minorities within our community, and we see the
partnership as a way to educate, bridge gaps and to assess what the LGBTQ
community needs and how best to facilitate those needs. Of course with any
organization we need money to sustain our program and the Moab Pride Festival is our
biggest fundraiser, as well as standing as a symbol of visibility and awareness to all
people struggling with LGBTQ issues.

Swanny Park, located, between 100 and 200 West from 30 to 400 North, is a non -reservation park that is meant to be open to the
public on a first -come, first served basis. Special Use of Swanny Park and other non -reservation parks within the City is subject to
approval by the Moab City Council. The City Council may approve use applications for events that provide clear benefits to the
community. Requests for usage by private businesses that serve a limited clientele will not be approved. This application must be

A RESOLUTION APPROVING A BOUNDARY LINE ADJUSTMENT FOR PROPERTY LOCATED
IN THE C-4, GENERAL COMMERCIAL ZONE AT 1133 MILLCREEK DRIVE AND OWNED BY
ALHEATON
WHEREAS, Al and Toni Heaton at 1078 S. Murphy land, Moab, Utah 84532, are the "Owners" of 1133
Millcreek Drive, Moab, and Utah have applied for a Boundary Line Adjustment of said described property;
and
WHEREAS, the Owners submitted to the City of Moab the appropriate application and documents for
review and approval of the proposed Boundary Line Adjustment; and
WHEREAS, the Owners desire to create two lots consisting of 1.50 acres and 2.37 acres; and
WHEREAS, the Moab City Council ("Council"), in a regularly scheduled public meeting held on July 8,
2014, reviewed the proposal for compliance with the Moab Municipal Code and State Code Chapter 10-
9a-608(2) that allows an amendment of a subdivision plat without a public hearing if:
(a)the petition seeks to:
(i) join two or more of the petitioner fee owner's contiguous lots;
(ii) subdivide one or more of the petitioning fee owner's lots, if the subdivision will not result in a
violation of a land use ordinance or a development condition;
(iii) adjust the lot lines of adjoining lots or parcels if the fee owners of each of the
adjoining lots or parcels join in the petition, regardless of whether the lots or parcels are
located in the same subdivision;
(iv) on a lot owned by the petitioning fee owner, adjust an internal lot restriction imposed by the
local political subdivision; or
(v) alter the plat in a manner that does not change existing boundaries or other
attributes of lots within the subdivision that are not owned by the owner..."; and
WHEREAS, the application does not include a request to vacate or amend a public street, right-of-way, or
easement; and
WHEREAS, the proposed amended lot sizes exceed the minimum lot size requirement for the C-4,
General Commercial Zone; and
WHEREAS, subsequent to the consideration of a Staff recommendation and having reviewed the
technical aspects of the pertinent code sections, Council hereby finds, that the code requirements have
been met.
NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL:
THAT, the application for the boundary line adjustment for Parcels 1 and 2 of the Al and Toni Heaton
properties is hereby approved without conditions.

This application is a request for relocating a property line to create two parcels consisting of 1.50
acres and 2.37 acres. The adjustment, if approved, will create a separate lot for the bowling alley. The
amended lot sizes exceed the C-4 Zone lot area requirement.
The request fully complies with State Code Chapter 10-9a-608(2) that allows a subdivision plat to be
amended by the Land Use Authority (Council) without a public hearing if:
(a) the petition seeks to:
(i) join two or more of the petitioner fee owner's contiguous lots;
(ii) subdivide one or more of the petitioning fee owner's lots, if the subdivision will not result in a

A short narrative describing the reason for the amendment is required and is part of a complete
application. Failure to submit a narrative will delay review of the application.
This section of the Utah Code allows for the vacation, alteration or amendment to a subdivision plat
without a public hearing if the petition seeks to:
i. Join two or more of the petitioner fee owner's contiguous lots;
ii. Subdivide one or more of the petitioning fee owner's lots, if the subdivision will not
result in a violation of a land use ordinance or a development condition;
Adjust the lot lines of adjoining lots or parcels if the fee owners of each of the adjoining
lots or parcels joins in the petition, regardless of whether the lots or parcels are located
in the same subdivision;
iv. On a lot owned by the petitioning fee owner, adjust an internal lot restriction imposed
by the local political subdivision; or
v. Alter the plat in a manner that does not change existing boundaries or other attributes
of lots within that subdivision that are not:
(A) Owned by the petitioner; or
(B) Designated as a common area; and
vi. The vacation, alteration or amendment is approved by the Moab City Council; and,
vii. An amended plat showing the vacation, alteration, or amendment is submitted, signed
by the City Council and recorded in the office of the county recorder in which the land is
located; and
viii. The document having satisfied all of the above conditions is to be recorded at the Grand
County Recorders Office, 125 East Center, Moab, Utah, within thirty (30) days of
approval by the Moab City Council.
