June 8, 1943• The regular post- poned meeting of Council was held today at 6:30 P.M. and was attended by Mayor Jones who presided, Councilmen Walsh, Lovell, Biotin, Henry, Young, Leopold, Town Attorney Dutton, J.G. Hazelhurst of the F. W. A., Mr. J. G. Attaway and Mr. G. R. Vinson. The Mayor read an excerpt from a letter that Mr. 0. T. Ray, R.D.' FWA dated June 5, 1943 as follows: "In response to Invitation for Bids, May 31, 1943, four (4) proposals were received. An examination of these proposals shows that they are irregular and unsatisfactory in that the bids were unbalanced and there was a misunderstanding as tb the meaning and intent of the prices for materials under items 28 through 31 and also a misunderstanding as the meaning and intent of the specifi- cations for back - filling. It is suggested that all proposals be rejected by Resolution. Our Mr. J. G. Hazelhurst in expected to arrive in Savannah, Friday morning, June 11, 1943, and will immediately proceed to the Town Hall at Savannah Beach, arriving there aroung 11:00 o'olock A.M., to assist you in the negotiating of a oontraot for this project with the apparent low bidder, the J.Q+L Attaway Construction Company, It will be appreciated if you will immediately advise the J. G. Attaway Construction Company of your desire to negotiate and ask them to send a representative and also have your Resident Engineer, Mr. G. R. Vinson, present at this conference. In the event that the time and date, is not convenient, please immediately wire us. It is propc2sed at the conference to have the J. 0. Attaway. Con-. strdction uompany balance their bid prices and to submit a . revised proposal based on balanced bid prices and also to revise their prices for items 28 through 310. The time and date enumerated above has been changed by telephone to Tuesday June 8, 1943. Please have representative present at, 5 :00 o8clock P.M. for conference. This conference will be followed by a meeting of the Mayor and Councilmen. at 6 :30 P.M. June 8, 1943. Councilman Lovell asked .Why ,the J.a4 Attaway'Co. is allowed to negotiate bid without the other bidders. Councilman Walsh also wanted to know why the J. G. Attaway Co.. was allowed to submit the only bid when the others were not invited, if the rest were thrown out why not Attaways also, Mr. Hazelhurst stated it was done to save time as the low bidder had been determined, the contract time for finishing the job is 180 days, J. G. Attaway, Co.-agreed to complete the job in 150 days, which he stated was liberal. He .stated the Town could negotiate the bid, there were no changes in Attaways total prices, and it is what is called an irregular bid, the bid was based on items 1 -27, items 28 -31 not being included. The Mayor informed Council that in compliance with the suggestion made by Mr. Ray in his letter of June 5th that he would entertain a motion to reject all bids submitted in connection with the sewerage project, .where upon Councilman Walsh moved that the following resolution be adopted, Councilman Henry seconded and the motion passed. RESOLUTION 2 65 WHEREAS, on _ the 31st day Of May, 1943, at a special meeting of the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, after due notice of said meeting was given, sealed bids were opened in their presence and the the presence of a representative of the Federal Works Agency, Region No. 3, together with the various contractors, on a contract for the completion of the sanitary Sewerage System under a grant from the rederal Works Agency, Project No. aa.9 -244 (NF); and WHEREAS, after said bids were opened, they were submitted to the Federal Works Agency representative to be tabulated; and WHEREAS, after said tabulation it was found that the low bid, as well as all other bids, were irregular, unsound and unbalanced and apparently a misunderstanding as to the meaning and intent of the prices of materials under Items 28 through 31, and further a mis- understanding and intent of the specifications for back - filling; and WHEREAS, due to said bids being irregular and unbalanced, each one submitted should be rejected; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah Beaoh, Tybee Island, in Council assembled, that the sealed bids received at a special meeting of ounoil on the 31st day. of 4ay, 1943, for tlIie completion of the Sanitary Sewerage Projeot under a grant from the ederal Works Agency, Projeot No. Ga. 9- 21�.(NF), be and the same are hereby rejected in their entirety. Councilman Walsh stated that the board was responsible for the job and he wanted it done right, he did not understand the items 28 -31, Councilman Biotin wanted to know what the contractor was going to charge the town for the additional work to be done later on,and asked why the bid did not include this work also, the Mayor stated when the Town asked for Lanham Aot funds it could only ask for what W.P.A. had been doing, they were to request a supplemental project amounting to $9000.00, but never did, the F.W.A. instructed the Town to only consider what P.P.A. had been doing. Councilman Biotin asked what the town was going to have to pay relative to the extra oust of laying material etc., he felt.that the town should not get involved financially, it should be understood what the town is going to be charged to put. in the connections, the job should be done all at onoe and completely finished. The Mayor informed Council.Mr. Ray had stated in his letter that the cost of the project was not to go over $85,000.00 and the balance of the funds granted and not required must be cancelled. Mr. Vinson stated that the definition "not required" could cover many things, for example 439,000.00 for apurtenanoes covering items 28-31, certain work at i'reatment Plant, 45 man hole covers eto. The Mayor stated that the•Town furnish the additional pipe needed for t he.connections. The Attaway Co. would lay it for a reasonable price for around $15,000.00 for about 18,000.00 ft of pipe, also, unless we awarded them the contract today the F. W. A. would throw the whole thing out and make us advertise for new bids. As that part Mr. Ray's letter relative to the amount of $164,800.00 awarded for Construction in which he stated that the balance not required was to be cancelled, Mr Hazelhurst was called back into the meeting and asked to explain just what that meant, he stated it meant justthis, probably the J. G. Attaway Co. ran over there contract say 10% or about $8,000.00, it would cover a situation 266 of that kind, he was here to do two things, first to help_ the town negotiate its contract with the low bidder, and secondly to look over the job and see what is needed in the bid, and also things not in the bid, for instance he would estimate the disposal plant must be finished for so much, road to the plant would cost so much, he would then return and inform Mr. Ray what amount is needed additionally, whether it be $1,000.00.or #30,000.00, they must be liberal, as they could not go back to Washington for additional funds, in addition to the $85,000.00 some $30,000.00 worth of materials will be added to the allotment when the job is through, not much of the allotment will be cancelled, if any amount is left over that will be oanoelled, he stated the J. G. Attaway Co. might run.:: over about 10 %, Councilman Biotin asked could the Town request F.W.A. not to require any oanoellation, Mr. Hazelhurst stated the amount authorized is liberal enough to cover the job, he stated in connection with the present contract any amount to be cancelled will depend on what he finds down here, if he found he could save some money and use in some other place; Mr. Vinson asked,• would the 7 items in the original application be approved by the F' " Mr. Hazelhurst said yes, and the Town should go ahead and let the present contract. Mr. Vinson asked in connection with the Attaway Co. contract based on units shown on docket could any change be made by . change order, Mr. Hazelhurst siad yes, but a change order was not needed as the figures will vary, set figures could not be used. Councilman Young hen moved that the oontraot be awarded to the J. G. Attaway Co. for ;77,056.75 contingent upon approval of the Regional Office of the F.W.A. in Atlanta, and that the following resolution be adopted authori- zing same, Councilman Henry seconded and the motion passed. RESOLUTION. WHEREAS, at a regular meetinf of the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, held on the 8th day of June, 1943, a resolution was adopted rejecting all bids submitted at a special meeting of the Mayor and Councilmen on the 31st day of May, 1943, for the completion of the Sanitary Sewerage System under a grant from the Federal Works Agency, Project No. Ga. 9 -244 (NF); and WHEREAS, after said bids were rejected, the original bid submitted by J. G. Attaway Construction Company, Statesboro, Georgia, by J.G. Attaway, owner, was balanced on each unit price, making a total sum of $77,056.75; and WHEREAS, after the said bid of J. G. Attaway Construction Company, by J. G.- ..Attaway, owner,.was balanced same appeared to be the low bid; and WHEREAS, the Mayor and Counoilmen of t #e Town of Savannah Beach, Tybee Island, were given permission by the ederal Works Agency to negotiate a contract for the completion of the Sanitary Sewerage System With the said J. G. Attaway Construction Company; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, in Counoil assembled, that the bid for the completion of the Sanitary Sewerage System under a grant from the Federal Works Agenoy, Project No. Ga. 9 -24+4 (NF), be and the same is hereby awarded to the J. G. Attaway Construction Company, Statesboro, Georgia, for the total sum of $77,056.75, which is a revised and balanced bid made on the 8th day of June, 1943, said bid showing each item and the amount of each unit price in compliance with the specifications for the completion of the said Sanitary Sewerage System. Awarding of the oontraot, however, is made subject to the final approval of the F.W. A. W Councilman Henry moved:: that the J. G. ,Attaway Co. be requested to submit a proposal on laying pipe to the property lines, . Counollman Young seconded and toe motion passed. Mr. Attaway submitted an estimate . of '; per foot for 6" pipe the Town furnish .the pipe, he'"Iurnish the materials and the Yes and Bends. Councilman Lovell moved that the Town expend $650.00 for advertising and that the Mayor be authorized to disburse these funds, Councilman Henry seconded and the motion passed. The Mayor informed Council that he had been in conference with Dr. Hedges, Dr Lunceford and Capt Maury the U.S.P.H.S. in connection with maintaining a full time Health Clinic with a trained nurse, cost would be aroun4 $2,600.00 to $2,800.00 per year, the state would allow about $1,000.00 to $1,400.00 toward it, he stated the U.8.P,H. wanted to put in a Clinic, but the Town must have one, could request Federal funds for this purpose. Reoeived as information. Chief Stewart requested the use Of the southern part of the old Town`Hallifor his father's family, Councilman Henry moved that he be permitted to have it, providing he takes care of all expenses including water rent etc., the Town not charging him any rent, Councilman Walsh seconded and the motion passed. The Mayor informed Council that it is quite a problem to maintain the Police Force,adegnately at the present time, one man is resigning, and with the high wages paid elsewhere due to abnormal oonditions it is almost impossible to hold capable mem with the present salaries paid them. Counoilman Lovell moved that the Mayor and Chairman' of the Police Committee be authorized and empowered to use their disoretion in handling the situation confronting the Polioe Department, Councilman Young seconded and the motion passed. Counoilman Lovell asked to be informed who the employee was that was on the carpet for drinking,- he was told it was the Supt. of Pubiio Works Wall, who had been pit on notice that this will have to Stop. The Mayor informed Counoil that in connection with Mr. H,D. Breen who at a previous meeting was suggested as the Supt. to operate the Treatment Plant when it was finished was now employed by the J.B. McCrary Co. who want to keep him until the Sewer job is finished. 267- _ . The matter of purchasing a map case to house the maps of the Town Was brought up, the Mayor stated he would 'check up and get some prices covering this. Councilman Slotin Moved that bills for purchases made for the General Government during the month of May amounting to 3gl.o5 and also bills for purchases made for the Sewer Project for the Month of May amounting to 158.p3 be paid, Councilman Walsh seconded and the motion passed. A protest was read from R. M. Demere against paying for the Special Tax assessed against him to maintain the Groins and Sea Wall. The matter was referred to the Town Attorney for action. 268 Tybrisa Company submitted a cheek to cover the first half of their 1943-taxes, taking the discount, it was the opinion of Council if they paid the full years taxes at this time they would be allowed the discount. Mr. D. J. Sheehan partitioned for a refund of *5.00 covering a building-permit Which he took out several years ago to erect a structure on Lot #35-a Ward 6, this work never having been started, Councilman Slotin moved that it be refunded, Councilman Walsh seconded and the motion passed. There being no further business Council adjourned subject to the ball of the Meyer. Savannah Beach, Tybee Island, Ga., July 6, 1943. The regular meeting_ ©f Council was held today at g 430 P.M. and was attended by Mayor Jones, who presided, and Counoilmen Walsh, Young,. Henry, Biotin and Town Attorney Dutton. The minutes of the meetings of May 31st and June 8th were read and approved. Mayor ;ioneiinformed Council that it is expected that the Treatment Plant would be ready for Fort Soreven to tie into about the latter part of this''month. He, also, informed Council that he was again contacted by Mr. E. H. Abrahams in connection with repairing the groins in front of his property. It was the senee Of Council that with conditions as they are it will be impossible to repair these__groins at this time, but. an effort would be Made to correct the bad condition existing. The Mayor informed'Councii that la ia:necessary to change the oost of the Sewerage System from .176 800..00 to.00ver some un- finished business and also, that the $5,400.00 included in this as a government field expense, had been eliminated making the new total $171,g00.00,_ as shown in the New Grant Offer F.W.A. dated June 26, 1943, &he stated he would entertain a motion for the adoption of the esoltition of this New Grant Offer,. Councilman Biotin moved that the motion be adopted, Councilman Young seoonded and the motion passed.
