To address all the safety and health risks to visitors and residents that have been discussed in the last two City Council workshops on STRs. The state law Under the Local and Land Use Planning Act (LUPA), Idaho Code 67-6523, a local government has authority to issue a temporary moratorium for up to 182 days if the governing board finds that an imminent peril to the public health, safety, or welfare requires the adoption of such an ordinance. We also need to know what additional demands STRs place on sewer and water. The law may be clear we cannot prohibit STRs, which I think can be challenged, but the direction is clear we can protect people. There is no support for Property management companies and vacation rental owners who ignore unsafe conditions, and we have a moral obligation to protect visitors and residents. What will the Moratorium solve? A moratorium would not prohibit STRs; it would be a pause to give city staff time to create new ordinances and regulations to protect people from the lack of rules for STRs that exist, which the city has acknowledged in the workshops. Moratorium Option 2 A moratorium on any subdivisions over four units. Why? Our present sewer capacity is not adequate for any more subdivision approvals. Continuing to add to the system will result in a sewer spill or additional costly temporary solutions. Temporary fixes by developers that seek approval may not be adequate until a new master plan is completed. The water treatment plant needs four pump updates. The plant cannot meet filtration ( treatment process) demand and do not have adequate storage for residents and visitors. The summer of 2021 confirmed this, and we are in a drought. The city's master plan of 2018 did not account for the new migration trends of the last three years of Covid or the unknowns of population increases or impact from the rise in STRs. Continuing with subdivision approvals that may become STRs would impact the community's safety, health, welfare, and visitors. The need to find solutions that may require Developers, investors, and STR owners to pay more for their impacts on the community and infrastructure. It would remove the risk of a sewer spill. It would remove the need to spend money on temporary repairs. It would give city staff and the Sewer district the time to complete a master plan and solve the water issues mentioned. It would lead to new conditions for investors, developers, and STR owners to pay for their greater impacts than the impacts from residents. Moratoriums would give the city staff time to be proactive rather than the need to be reactive to the issues that impact people in our community and our infrastructure. The moratorium pause would prevent adding to the problems we are now experiencing as a community and provide solutions. Moratoriums will not impact remodeling, maintenance, or any project that has started or has been approved. It will not significantly affect small local builders or businesses related to construction. Moratoriums are not anti-growth policies. Moratoriums are not anti-property rights. They are not the taking of property or land. Moratoriums implemented correctly solve issues and create smart, sustainable growth policies versus rampant uncontrollable growth that damages neighborhoods, infrastructure, and our natural world.
