AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT
WITH COLLIERS ENGINEERING & DESIGN
RIVER WALK PHASE HB — NORTHERN SECTION
WHEREAS, the Borough of Carteret is in need of additional specialized engineering services in
connection with the NJDEP ORR Grant River Walk Phase IIB - Northern Section; and
WHEREAS, Colliers Engineering & Desigy 331 Newman Springs Road, Red Bank, New Jersey
07701, possesses the requisite experience and expertise to provide said services; and
WHEREAS, Colliers Engineering & Design has submitted a proposal to provide said services at
a total cost not to exceed $26,100,00;, and
WHEREAS, the Mayor and the Council have reviewed said proposal; and
WHEREAS, the Chief Financial Officer has certified that funds are or will he available for said
purpose. Acct. H
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of
Carteret, County of Middlesex, State of New Jersey, as follows:
1. The proposal from Colliers Engineering & Design for additional
engineering services related to the ORR Grant River Walk Phase
JIB - Northern Section at a cost not to exceed $26,100.00 is hereby
approved.
2. This action is approved as an award of a professional services
contract pursuant to N.J.S.A 40AA 1- 5(1)(a) in accordance with the
Borough's Fair and Open Process as authorized by law.
3. A copy of this Resolution be forwarded to the Borough's
Finance Department, the Borough Director of Engineering
and Colliers. Ingineering & Design.

Dear Mayor Reiman,

& Design
Colliers Engineering & Design, Inc. (DBA Maser Consulting) is pleased to submit this proposal to
provide additional Professional Engineering services for the development of the proposed new
Northern walkway located at the Carteret Waterfront Park, Carteret, New Jersey. The project scope
Is for the revisions to the currently approved River Walk alignment,
This proposal Is divided into four sections as follows:
Section I - Scope of Services
Section 11 - Business Terms and Conditions
Section III - Technical Staff Hourly Rate Schedule and Reimbursable Expenses
Section IV - Client Contract Authorization
The order in which the following scope of services are presented generally follows the sequence in
which the project will be accomplished; however, depending on the project, the various authorized
services contained in this proposal may be performed in a sequence as deemed appropriate by
Colliers Engineering & Design ICED) to meet project schedules.
Section I - Scope of Services
Based on our conversations and Information noted above, we propose to complete the following:

PHASE 1.0 ADDITIONAL ENGINEERING DESIGN & CONSTRUCTION DOCUMENTS
CED will revise the previously approved River Walk alignment and elevation in accordance with the
conceptual alignment as shown on plans entitled "Carteret Waterfront Park', dated June 6, 2022
prepared by Melillo Bauer Carman (MBC), consisting of two (2) sheets.
The original River Walk has been separated Into three (3) phases. Phase IIA is along the entire
eastern boundary of Lot 2.01 of Block 5.02, approximately 1,070 feet in length. Phase IIB is south of
Phase IIA and fronts the length of the Ferry Terminal Parcel,
Phase IIB will be bid with the Ferry Terminal Improvements. The horizontal and vertical alignment of
Phase IIB will be revised to blend with the current construction drawings for the ferry terminal as
only permit plans were previously available and the parking lot access which has been modified and
shown on MBC plans. Additional Structural Design and details are required as the height of the
River Walk will be Increased to approximately 11 feet above grade from the 3 -4 feet previously
proposed.
Phase 1.0 Lump Sum Fee
PHASE 2.0 ADDITIONAL PERMITTING /APPROVALS
$15,400.00
CED previously secured an Upland Waterfront Development Permit from the NJDEP for the
installation of a trail /boardwalk on this project site, The Borough is now proposing to re -align a
portion of the boardwalk so that It will now cross freshwater wetlands.
This proposed boardwalk is eligible for authorization under an NJDEP Coastal Zone General Permit
No. 13 (construction of recreational facilities at public parks) and an NJDEP Freshwater Wetland
General Permit No. 17A (Non- motorized, multiple use paths). To qualify for authorization under
these two general permits, the width of the boardwalk as it crosses the wetlands must be in
accordance with the American Association of State Highway and Transportation Officials (AASHTO)
"Guide for the Development of Bicycle Facilities ". The boardwalk is 20 feet wide and, based on the
guide, may have to be reduced to 10 feet over the wetlands.
CED will prepare applications to the NJDEP for a Coastal Zone General Permit No. 13 and a
Freshwater Wetland General Permit No. 17A utilizing the previously approved wetland delineation
for the site. This application will be prepared in accordance with the standards described at N.J.A.C.
7:7 -23 and 24 of the Coastal Zone Management Rules. This scope excludes any permits to the U.S.
Army Corps of Engineers since the wetlands are located above the mean high -water line and
regulated under Section 404 of the Clean Water Act which only regulates the discharge of dredged
or fill material and not structures.

PHASE 3.0 REIMBURSEABLES
Delivery, printing and reproduction, overnight mail service, certified mail service and postage costs
are not included in the Phase 1.0 & 2.0 fee and will be added to each monthly invoice. Our office
recommends the following budget.

For your convenience, we have broken down the total estimated cost of the project Into the categories
identified within the scope of services.
PHASE 1.0 CONSTRUCTION BID ADMINISTRATION $15,400.00
PHASE 2.0 WATERFRONT DEVELOPMENT PERMIT $ 9,200.00
PHASE 3.0 REIMBURSABLES $ 11500.00
TOTAL FEE $26,100.00
This Contract and Fee Schedule are based upon the acceptance of CED's Business Terms and
Conditions contained in Section II of this Contract. Delivery, mileage, printing and reproduction,
overnight mail service and postage costs are not included in the lump sum fees and will be added to
each monthly invoice.
Exclusions and Understandings
Services relating to the following items are not anticipated for the project or cannot be quantified at
this time. Therefore, any service associated with the following items is specifically excluded from the
scope of professional services within this agreement.
• Services not specifically outlined In Section 1.
• Wetland delineation.
• Environmental Remediation Services.
• Exploratory or testing work, interpretations or conclusions related to determination of
potential chemical, toxic, radioactive or other type of contaminants on the site.
If an item not listed herein, or otherwise not specifically mentioned within this agreement, is
deemed necessary, CED may prepare an addendum to this agreement for your review outlining the
scope of additional services and associated professional fees regarding the extra services.

The 2022 Rate Schedule Is on file with the Borough.

If you find this proposal acceptable, please sign where indicated above in Section IV, and return one
signed copy to this office. Alternatively, please provide a copy of a Municipal Resolution or
Purchase Order approving this proposal, which shall constitute authorization. Payment
terms are NET30 of receipt of invoice. This proposal is valid until September 26, 2022.
