Aezoluflon of the of garf, zef, N, 0C No. #22-'166 Dale of Ado August 11, 2022 ption RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, DESIGNATING CONDITIONAL REDEVELOPER FOR PORTION OF PROPERTY IN THE WATERFRONT REDEVELOPMENT AREA WHEREAS, pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A ;12A -1 el seq. the Borough designated the properties formerly known as Block 4, Lots I, 2 (C.O. 100, C.O. 200, C.O. 300 and C.O. 400), 3 and 4, Block 5. 1, Lots 1, 1.02, 1.03, 2, 5 and 6, Block 5.02, Lots 1.0 1, 1.02, 1.03 and 2. 1, Block 6.1, Lot I and Block 6.2, Lot 12, and various parcels within Block 500 on the Borough's tax maps (the "Redevelopment Area ") as an area in need of redevelopment and adopted a redevelopment plan for said area; and WHEREAS, J Bez iaie Incorporated ( "Bez one ") proposes to redevelop the portion of the Redevelopment Area consisting of Block 304, Lot 2.01 and a portion of Block 304, Lot I (collectively, the "Project Area "); and WHEREAS, on October 28, 2021, the Borough adopted a resolution conditionally designating Beuone as the redeveloper of the portion of the Project Area consisting of Block 304, Lot 2.01; and WHEREAS, on November 1, 2021, the Borough and Beuone entered into an Interim Costs Agreement (the "Interim Costs Agreement "), under which Boz2one funded an escrow account to cover the Borough's costs associated with the redevelopment of the Project Area; and WHEREAS, the Borough desires to renew and expand Beuone's conditional designation as redeveloper OF the Project Area for the purpose of facilitating preliminary negotiations regarding the redevelopment thereof. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED by the Mayor and Council of Borough of Carteret, in the County of Middlesex and the State of New Jersey, as follows: Section I. The aforementioned recitals are incorporated herein as though fully set forth at length herein. Section 2. Bezzone is conditionally designated as the redeveloper of the Project Area. This designation shall apply to Berzon and/or to any special purpose entity the principals of Bezzone may elect to form, so long as the principals in and of Bezzone hold a controlling interest in such special purpose entity. Section 3. The within designation is hereby made for a limited period of one hundred twenty (126) days from the date of adoption hereof and the Interim Costs Agreement will remain in effect in accordance with the terms thereof and will apply to the Project Area, Section 4.
