A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, ORDERING A GENERAL ELECTION FOR
THE OFFICES OF CITY COUNCIL PLACES 1, 3, AND 5; SUCH
REGULAR ELECTION TO BE HELD ON SATURDAY, MAY 6, 2017;
ESTABLISHING PROCEDURES FOR THE ELECTION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, May 6, 2017, is designated as a uniform election day; and
WHEREAS, by this resolution, it is the intention of the City Council to call the 2017
General Election as required by the City Charter and by other law, designate a polling place for
the election, and establish and set forth procedures for conducting the election; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for General Election.
The City Council hereby orders that a general election shall be held in the City of
Richland Hills on Saturday, May 6, 2017, at which the following officials will be elected:
City Council, Place 1
City Council, Place 3
City Council, Place 5
Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to execute the contract (the "Contract") with
Tarrant County for joint election services. In the event of a conflict between this Resolution and
the Contract, the Contract shall control.
Section 3. Polling Place.
The polling place for the Election shall be as follows:

Other polling places may be established as provided in the Contract. The polls shall be
open from 7:00 a.m. to 7:00 p.m. on May 6, 2017, in accordance with and pursuant to the
requirements of the Texas Election Code. The City shall constitute a single election precinct for
the election.
Section 4. Filing Dates.
In accordance with Section 143.007 of the Texas Election Code, eligible persons wishing
to become candidates must file an application with the City Secretary of the City of Richland
Hills, Texas 76118, and may do so beginning Wednesday, January 18, 2017 and continue
through Friday, February 17, 2017, until 5:00 p.m. Each application shall be on a form meeting
the requirements of Section 141.031 of the Texas Election Code.
Section 5. Ballots and Election Method.
Combined ballots may be utilized containing all of the offices and propositions to be
voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote
for any office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance shall be conducted exclusively on Tarrant County's eSlate electronic voting system.
On Election Day, voters shall have a choice between voting on the eSlate electronic voting
system or by a paper ballot that is scanned at the polling place using Tarrant County's eScan
voting system. All expenditures necessary for the conduct of the election, the purchase of
materials therefore, and the employment of all election officials are hereby authorized, and shall
be conducted in accordance with the Contract and the Code. The order in which the names of
the candidates are to be printed on the ballot shall be determined by a drawing by the City
Secretary pursuant to state law. Notice of the time and place for such drawing shall be given in
accordance with the Code.
Section 6. Early Voting.
a. Early voting by personal appearance. Stephen Vickers, Tarrant County Chief Deputy
Elections Administrator, is hereby appointed as the Early Voting Clerk for the election, as so
indicated in the Contract. Early voting by personal appearance shall commence April 24, 2017
and shall continue until May 2, 2017. The main early voting site shall be at the Richland Hills
Public Library, 6724 Rena Drive, Richland Hills, Texas. Specific days, times and locations shall
be designated by the Elections Administrator and included in the Contract and shall be in
compliance with state law. On at least two weekdays during the early voting period, the location
for early voting shall be open for at least twelve (12) hours as mandated by state law.
b. Early voting by mail. Applications for a ballot by mail maybe submitted throughout the
calendar year, beginning January 1 and must be received by Tarrant County Elections no later
than the close of business April 25, 2017. All voted ballots that are returned on or before
Election Day will be counted. Voted ballots mailed from outside the United States may be
counted if clearly postmarked on or before Election Day and received by the Elections
Administrator not later than the fifth day after Election Day. Completed applications may be
submitted by mail, contract or common carrier, fax or (Effective September 1, 2015, you may
submit by email a completed, signed with the voter's original signature and scanned application
to the Early Voting Clerk.):

c. Early voting ballot board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the
Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 7. Notice.
Notice of said election shall be given as required by the Texas Election Code.
Section 8. Election Officials.
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as permitted by law. The presiding judge shall appoint
elections clerks as maybe necessary for the proper conduct of the election. The election judge, or
the alternate election judge in the absence of the election judge, and the election clerks shall
constitute the early voting ballot board. The election judge, and alternate election judge, and
election clerks shall be qualified voters of the city.
Section 9. Governing Law.
The election shall be held in accordance with the Constitution of the State of Texas and
the Texas Election Code, and all resident qualified voters of the City shall be eligible to vote at
the election.
Section 10. Runoff.
In the event no candidate receives a majority of the votes cast, a runoff election is hereby
ordered for June 10, 2017. Early voting shall be conducted for the runoff May 30th through June
6, 2017. Polling place for the runoff election shall be:

Other polling places maybe established as provided in the Contract.
Section 11. Necessary Actions.
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, the City Charter, and the City Code in carrying out and conducting the election, whether
nor not expressly authorized by this Order.
Section 12. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 13. Notice and Publication
This Resolution shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the General
Election. A copy of the resolution shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 14. Effective Date.
This order shall be effective upon its adoption.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, QUE ORDENA UNA ELECCION GENERAL
PARA LOS CARGOS DE LOS LUGARES 1, 3 Y 5 DEL CONCEJO
MUNICIPAL. ADEMAS, ESTABLECE QUE DICHA ELECCION
REGULAR SE LLEVARA A CABO EL SABADO, 6 DE MAYO DE 2017,
DETERMINA LOS PROCEDIMIENTOS PARR LA ELECCION Y
PROPORCIONA UNA FECHA DE ENTRADA EN VIGENCIA.
POR CUANTO, se establece el 6 de mayo de 2017 Como la fecha de eleccion uniforme, y
POR CUANTO, mediante esta resolucion, el Concejo Municipal tiene la intencion de
llamar a la Eleccion General de 2017 segun to dispuesto por la Carta Organica Municipal y por
otra legislation, designar un centro electoral para la eleccion, establecer y exponer Los
procedimientos para su realizacion, y
AHORA, POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, RESUELVE:
Seccion 1. Orden de Eleccion para la Eleccion General.
Por la presente, el Concejo Municipal ordena la realizacion de una eleccion general en la
Ciudad de Richland Hills el sabado, 6 de mayo de 2017 para elegir a Los siguientes funcionarios:

Concejo Municipal, Lugar 5
Seccion 2. Contrato de administration de eleccion conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a celebrar el Contrato (el
"Contrato") con el Condado de Tarrant para Los servicios de la eleccion conjunta. En caso de
conflicto entre la presente Resolution y el Contrato, este ultimo prevalecera.
Seccion 3. Centro electoral.
El centro electoral para la eleccion sera el siguiente:

Se podran establecer otros centros electorates Begun to dispuesto en el Contrato. Las
elecciones se llevaran a Cabo desde Las 7:00 a.m. hasta Las 7:00 p.m., el 6 de mayo de 2017
conforme a Los requisitos establecidos en el Codigo Electoral de Texas. La Municipalidad
constituira un solo distrito electoral para la eleccion.
Seccion 4. Fechas de presentation de solicitudes.
De acuerdo con la Seccion 143.007 del Codigo Electoral de Texas, las personas elegibles
que deseen postularse Como candidatos deben presentar una solicitud a la Secretaria de la Ciudad
de la cudad de Richland Hills, Texas 76118, a partir del miercoles, 18 de enero de 2017, y hasta
el viernes, 17 de febrero de 2017, a las 5:00 p.m. Cada solicitud debera cumplir con los
requisitos de forma establecidos en la Seccion 141.031 del Codigo Electoral de Texas.
Seccion 5. Boletas y metodo de eleccion.
Se pueden utilizar boletas combinadas que contengan todos los cargos y propuestas que
se votaran en cada centro electoral, siempre que ningun elector reciba boletas o el permiso de
votacion de un cargo o propuesta para los cuales no sea elegible para votar. La votacion
anticipada en persona se realizara exclusivamente a traves del sistema de votacion electronica
eSlate del Condado de Tarrant. El dia de la eleccion, los electores podran votar a traves del
sistema de votacion electronica eSlate o con una boleta electoral que se escanea en el centro
electoral a traves del sistema de votacion eScan del Condado de Tarrant. Por la presente, se
autorizan todos los gastos necesarios para la realization de la eleccion, la compra de los
materiales a tal efecto y la contratacion de todos los funcionarios electorales; dichos gastos se
realizaran conforme al Contrato y al Codigo. El Orden en que se imprimiran los nombres de los
candidatos en la boleta se determinara a traves de un sorteo que realizara la Secretaria de la
Ciudad conforme a la legislacion del estado. La hora y la fecha del sorteo se notificaran de
acuerdo con to dispuesto en el Codigo.
Seccion 6. Votacion anticipada.
a. Votacion anticipada en persona. Por la presente, se designa a Stephen Vickers, Jefe
Adjunto del Administrador Electoral del Condado de Tarrant, Secretario de Votacion Anticipada
para la eleccion, segun to indicado en el Contrato. La votacion anticipada en persona comenzara
el 24 de abril de 2017 y finalizara el 2 de mayo de 2017. El principal centro electoral de
votacion anticipada estara en Richland Hills Public Library, 6724 Rena Drive, Richland Hills,
Texas. El Administrador Electoral determinara las ubicaciones, los Bias y los horarios
especificos, que se incluiran en el Contrato y que cumpliran con to dispuesto en la legislacion del
estado. Mientras dure el periodo de votacion anticipada, el centro electoral de votacion
anticipada estara abierto, como minimo, dote (12) horas durante al menos dos dias de la semana,
segun to dispuesto por la legislacion del estado.
b. Votacion anticipada por correo. A to largo del ano calendario y a partir del 1 de enero,
se pueden presentar solicitudes de voto por correo, y el personal de las Elecciones del Condado
de Tarrant debe recibir estas solicitudes antes del cierre de las actividades laborales el 25 de abril
de 2017. Se computaran todos los votos que se envien antes del Dia de la Election, o ese mismo
dia. Los votos que se envien por correo desde un lugar fuera de los Estados Unidos se
computaran si muestran claramente el matasellos con la fecha del Dia de la Election, o una fecha
anterior, y siempre que el Administrador Electoral los reciba, como maximo, el quinto dia
posterior al Dia de la Election. Las solicitudes completadas se pueden enviar por correo,
mensajeria contratada o comun, o fax (a partir del 1 de septiembre de 2015, se puede enviar una
solicitud completada con la firma original del elector que debera escanearse y enviarse al
Secretario de Election Anticipada por correo electronico) a las siguientes direcciones:

c. Junta Para la Votacion Anticipada. Por medio de la presente, se crea una Junta para la
Votacion Anticipada, que se ocupara de escudriiiar la votacion anticipada que se realice tanto en
persona Como por Correo. Conforme al Contrato, el Condado de Tarrant nombrara a la Junta
para la Votacion Anticipada a fin de que procese los resultados de la votacion anticipada de la
election.
Section 7. Aviso.
El aviso de la election se realizara Begun to dispuesto por el Codigo Electoral de Texas.
Section 8. Funcionarios electorates.
El Administrador Electoral del Condado de Tarrant designara al juez electoral, al juez
electoral suplente y a la junta para la votacion, Begun to permitido por la ley. El juez responsable
nombrara a los secretarios electorates, segun sea necesario, para el correcto desarrollo de la
election. El juez electoral o, en su ausencia, el juez electoral suplente y los secretarios electorates
constituiran la Junta para la Votacion Anticipada. El juez electoral, el juez electoral suplente y
los secretarios electorates seran electores calificados de la Ciudad.
Section 9. Legislation aplicable.
La election se realizara de conformidad con la Constitution del Estado de Texas y el
Codigo Electoral de Texas, y todos los residentes de la Ciudad que Sean electores calificados
seran elegibles para votar en la election.
Section 10. Segunda vuelta.
Por la presente, se ordena una Segunda vuelta electoral el 10 de junio de 2017 en caso de
que ningun candidato obtenga la mayoria de los votos emitidos. Para la segunda vuelta, la
votacion anticipada se realizara desde el 30 de mayo hasta el 6 de junio de 2017. El Centro
electoral para la election de la Segunda vuelta sera:

Se podran establecer otros centros electorales segun to dispuesto en el Contrato.
Seccion 11. Medidas necesarias.
Se autoriza y ordena al Alcalde y la Secretaria de la Ciudad, en consulta con la
Procuradora de la Ciudad, a tomar todas las medidas necesarias para cumplir con las
disposiciones del Codigo Electoral de Texas, la Carta Organica Municipal y el Codigo Municipal
para llevar a cabo la eleccion, independientemente de si estan o no expresamente autorizados por
esta Orden.
Seccion 12. Clausula de divisibilidad.
Por la presente, se declara que el Concejo Municipal tiene la intention de que las
secciones, los parrafos, las oraciones, las clausulas y las frases de esta Orden Sean divisibles, y
que si alguna sentencia o decreto validos de un tribunal con jurisdiction competente declarara la
nulidad o inconstitucionalidad de alguna frase, clausula, oration, parrafo o Seccion, dicha nulidad
o inconstitucionalidad no afectaran a ninguna de las frases, las clausulas, las oraciones, los
parrafos y las secciones restantes de esta Orden, dado que estos hubieran sido promulgados por
el Concejo Municipal sin la incorporation en esta Orden de ninguna de dichas frases, clausulas,
oraciones, parrafos o secciones nulos o inconstitucionales.
Seccion 13. Aviso y publicacion.
Esta Resolucion constituira la Orden de Eleccion (segun to dispuesto por la Seccion
3.001 del Codigo) y el Aviso de Eleccion (segun to dispuesto por la Seccion 4.001 del Codigo)
para la Eleccion General. Al menos veintiun dias (21) antes de la eleccion, se publicara una
copia de la Resolucion en la pizarra de anuncios que se utiliza para la publicacion de los avisos
de las reuniones del Concejo Municipal. El aviso se publicara en el periodico de acuerdo con to
dispuesto por la legislation del estado.
Seccion 14. Fecha de entrada en vigencia.
Esta Orden entrara en vigencia en el momento de su adoption.
