Re: Failure of the City to comply with Public Meetings notice requirements
I am writing to notify you that the City failed to clearly identify on its published agenda for its May 13,
2021 meeting the action items that would be considered regarding the conditional use permit being
considered for the building at the NE corner of 2"d and Park Avenues.
As reported in the newspaper today the solar panels that increased the already too high height of the
proposed building had been disapproved by the Planning Commission during its last public meeting held
on this development. The developer agreed to remove the awning of the solar panels and have them
placed directly on the roof top (no awning). The Commission approved it with that condition.
And then, there is a separate action item on your last Council meeting to add this awning back to the
height of the building.
The agenda as published in the newspaper did not include this as an action item so that citizens could be
reasonably expected to know this change would be considered.
In addition, I believe your notice about this meeting was inadequate and non-compliant with the law as
it appeared in the newspaper on the day of the Council meeting, not the five days(or 48 hours—not
clear which applies here) required.
I intend to pursue this until a meeting is conducted to re-hear this entire development proposal that
gives th e of us who are oppo d to have an opportunity to appear and testify about it.
