REGULAR MEETING
August 12, 2014
The Moab City Council held its Regular Meeting on the above date in the
Council Chambers at the Moab City Center, located at 217 East Center
Street, Moab, Utah.
Mayor David L. Sakrison called the Pre -Council Workshop to order at
6:30 PM. In attendance were Councilmembers Kyle Bailey, Heila
Ershadi, Gregg Stucki, Doug McElhaney and Kirstin Peterson. Also in
attendance were City Manager Donna Metzler, Deputy City Recorder
Danielle Guerrero, City Treasurer Jennie Ross, Assistant Engineer Eric
Johanson, Economic Development Specialist Ken Davey, Recreation
Director Chad Wright, City Planner Jeff Reinhart and Public Works
Director Jeff Foster.
Mayor Sakrison called the Regular City Council Meeting to order at 7:00
PM and led the pledge of allegiance. Four (4) members of the audience
and media were present.
Councilmember Stucki moved to approve the Regular City Council
Minutes for June 24, 2014. Councilmember Ershadi seconded the
motion. The motion carried 5-0 aye.
There were no Citizens to be Heard.

A Community Development Department Update was not given. COMMUNITY DEVELOPMENT
UPDATE
Under Engineering Department Update, Assistant City Engineer
Johanson stated he had met with Horrocks Engineering and the Utah
Department of Transportation on the 500 West Project and that the
project was proceeding. City Manager Metzler stated she had met with
Bowen Collins Engineering regarding the Waste Water Treatment Plant.
Under Planning Department Update, City Planner Reinhart reviewed the
upcoming Planning Commission Meeting Agenda. City Planner Reinhart
stated the General Plan was moving along.
A Police Department Update was not given.
Under Public Works Department Update, Public Works Director Foster
stated that the trail behind LaSal Oil had been closed but was still being
used. Public Works Director Foster stated Questar would have the main

lines complete by next week and that Questar would have the service
lines complete mid -September.
There was a Presentation Regarding Canyonlands National Park's 50tn
Anniversary. Discussion followed.
Councilmember Stucki moved to award the Dewatering Press
Equipment Purchase. Councilmember McElhaney seconded the motion.
The motion carried 5-0 aye.
Councilmember Ershadi moved to approve to enter into an agreement
with MSD Environmental Services Inc., for purchase of the existing
Dewatering Belt Press for the City of Moab Waste Water Treatment
Plant. Councilmember McElhaney seconded the motion. The motion
carried 5-0 aye by a roll -call -vote.
Councilmember Peterson moved to approve a Purchasing Exception in
the amount of $12,500.00 for the July Lease Payment for the
Dewatering Belt Press for the City of Moab Waste Water Treatment
Plant. Councilmember Bailey seconded the motion. The motion carried
5-0 aye.
Councilmember Ershadi moved to approve Resolution #31-2014 — A
Resolution approving a contract by and between the City of Moab and
the Governor's Office of Economic Development for the Business
Expansion and Retention (BEAR) Program. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.
Councilmember McElhaney moved to approve a request to send
proposed Ordinance #2014-08 — An Ordinance approving the vacation of
a portion of Colorado Avenue Public Right-of-way as platted in the
Palisades Subdivision, Plat "A", and amending Lot 6, Block 4, Lot 18,
Block 2, and Lots 17a and 17b and accepting a dedication of property to
maintain the right-of-way width of fifty feet and realigning the Colorado
Avenue Right-of-way to Public Hearing. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.

Gas Code, 2012 International Energy Conservation Code, 2012

Bailey seconded the motion. The motion carried 5-0 aye.
Council Stucki moved to approve Proposed Resolution #33-2014 — A
Resolution approving a Final Plat for the Poucher Two -Lot Minor
Subdivision located at 394 Loveridge Drive in the R-2 Residential Zone.
Councilmember Ershadi seconded the motion. The motion carried 5-0
aye.
Councilmember Peterson moved to approve a request by Judy Powers
for an Amplified Music Event at Old City Park on October 11, 2014.
Councilmember Ershadi seconded the motion. The motion carried 5-0
aye.
Under Mayor and Council Reports, Councilmember Ershadi referenced a
letter from Bill Love. Mayor Sakrison stated that he was working toward
using the Colorado River for dust control instead of culinary water.
Councilmember Peterson stated she would like to meet with Public
Works Director Foster on the current bike lanes that are in place and if
there are plans for more.
There was no Correspondence to be Read.
Under Administrative Report, City Manager Metzler stated that the
Police Lieutenant Job Description had been revised and would be
coming to City Council next meeting. City Manager Metzler stated that
there will also be a request from Community Rebuilds for a long term
lease at the MARC. City Manager Metzler advised the City Council not
to issue a letter of support for Matrimony Springs at this time. City
Manager Metzler stated there had been a lot of complaints on the
pedestrian lights on Main Street and that she would be working with
UDOT on a fix.
Under Report on City/County Cooperation, Mayor Sakrison stated there
would be a Joint Meeting on August 29, 2014.
Councilmember Ershadi moved to approve the bills against the City of
Moab in the amount of $613,516.72. Councilmember Bailey seconded
the motion. The motion carried by roll -call -vote 5-0 aye.
Mayor Sakrison adjourned the Regular Council Meeting at 7:50 PM.

Title: Call for a Public Hearing to Approve Ordinance #2014-08, an Ordinance Approving the Vacation of a
Portion of Colorado Avenue and Accepting Additional Property as Right -of -Way to Realign the Street
Seventeen Feet to the South

Background/Summary:
The proposed vacation of Colorado Avenue consists of seventeen (17) feet along the north side of the
street. This vacation will allow the adjacent three lots to develop as other lots in the area. In addition, a
dedication from Pat and Dennis Byrd of seventeen (17) feet on the south side of Colorado Avenue will be
dedicated to the city to maintain the appropriate right-of-way width.
The vacation and dedication result in a realignment of the Colorado Avenue right-of-way that will line up
with improvements made for Phase Two of the Preserve Subdivision and will allow the street to extend to
the west if necessary.
The City Council is the Land Use Authority for this action, which requires that the City Council hold a public
hearing.
Options:
Council may:
1. Send Ordinance #2014-08 to Public Hearing;
2. Send Ordinance #2014-08 to Public Hearing, with changes;
3. Not send Ordinance #2014-08 to Public Hearing
4. Postpone sending the ordinance to Public Hearing adoption if additional information is
needed.
Staff Recommendation: Staff recommends that the City Council send Ordinance #2014-08 to Public
Hearing.
Recommended Motion: "I move to approve agenda item #5-5."

COLORADO AVE RIGHT OF WAY RE -ALIGNMENT
I'm writing this brief explanation on my application to vacate and re align the
Colorado Ave. Right of Way. I am proposing, along with Justin Marcus, and Pete and
Pat Byrd, to vacate a 17' strip of R.O.W along the north side of Colorado Ave. on
Justin Marcus's, and my twin home lot. Then Pete and Pat Byrd are re dedicating 17'
along the south side of Colorado to bring the R.O.W. to the standard 50' which is
consistent with the intersecting roads on either end(Palisade, Rainbow Dr.) What
this does, is allows Colorado Ave. to run straight through to the West without hitting
my lot I'm on now (853 Rainbow Dr.) This will allow for connectivity to the
adjoining property to the west later on if necessary.

AN ORDINANCE APPROVING THE VACATION OF PORTION OF THE COLORADO AVENUE PUBLIC RIGHT-
OF-WAY AS PLATTED IN THE PALISADES SUBDIVISION, PLAT "A", AND AMENDING LOT 6, BLOCK 4, LOT
18, BLOCK 2, AND LOTS 17A AND 17 B AND ACCEPTING A DEDICATION OF PROPERTY TO MAINTAIN THE
RIGHT-OF-WAY WIDTH OF FIFTYFEET AND REALIGNING THE COLORADO AVENUE RIGHT-OF-WAY
WHEREAS, Benjamin and Melissa Byrd at 854 Rainbow Drive, Dennis and Patricia Byrd at 826 Colorado
Avenue, and Justin and Alisa Marcus at 818 Colorado Avenue in Moab, Utah 84532, and as the "Owners"
of record of the properties described as Lot 6, Block 4, Lot 18, Block 2 and Lots 17a and 17b of Palisades
Subdivision , Plat "A", have applied for an amended plat with a partial vacation of the platted but
undeveloped street right-of-way (ROW) known as Colorado Avenue; and
WHEREAS, Owners have negotiated an additional dedication of right-of-way for Colorado Avenue to the
City of Moab to maintain the required minimum right-of-way width of fifty (50) feet as described in
Attachment "B" and effectively realign the street to be in line with previously constructed
improvements; and
WHEREAS, the Moab City Council ("Council") held a duly advertised public hearing on August 26, 2014,
to hear public testimony and review the request to realign the described portion of the Colorado
Avenue right-of-way as shown on the attached plat (Attachment A); and
WHEREAS, Council has determined that the request for the realignment of the described portion of
Colorado Avenue is in keeping with the General Plan Elements for Transportation that "involves
planning for arterial, collector, and local traffic circulation", and found that the applicant has proven
"good cause" to support the requested vacation; and
WHEREAS, Council has found that the proposed vacation:
Does not conflict with adopted policies or plans,
Will not generate adverse impacts on the health, safety, and/or general welfare of the
community,
Will not result in future traffic problems,
Provides for an adequate street right-of-way width to accommodate projected traffic impacts
for future development, and
Will not cause streets and intersections in the neighborhood to see decrease in an appropriate
Level of Service (LOS)
WHEREAS, it has been determined that the amended ROW, as adjusted by the applicants, satisfies the
intended use of the street by the adjacent properties; and
WHEREAS, Council, after due deliberation based on the evidence and testimony presented at said public
hearing, has found that that the requested vacation of existing right-of-way, and dedication of additional
right-of-way for the realignment of Colorado Avenue satisfies with the goals of the General Plan
regarding transportation and circulation, "To achieve a safe, efficient, and convenient transportation
system that addresses the need for all levels of circulation"; and

NOW, THEREFORE, subsequent to consideration of Staff recommendations, and having reviewed the
technical aspects of the proposed right-of-way vacation and dedication, Council, by the adoption of
Ordinance #2014-08, hereby approves the request for the vacation of the right-of-way, accepts the
dedication of additional right-of-way and approves the realignment of the public right-of-way for the
currently platted Colorado Avenue as indicated on Attachment "A".

Background/Summary:
Community Rebuilds has been renting office space at the MARC on a month -to -month
basis. Community Rebuilds is a non-profit organization that helps low to moderate
income families replace their old trailers with new, energy efficient affordable housing.
They have been using space located in the downstairs area of the MARC shown in
yellow on Exhibit A of the attached lease agreement. The room they have been using
generally sees very low utilization. The month -to -month arrangement has worked well
for both Community Rebuilds and the MARC, but both Community Rebuilds and the
MARC would benefit from a longer -term arrangement. The attached lease agreement
is based on the lease agreement that we use for the tenants in the City Center building.
The lease would bring in $5,400 per year, which would assist the MARC in meeting their
revenue goals. It is a two-year lease, with an option for renewal.
Options: The City Council may approve, approve with conditions, deny or postpone
the item.
Staff Recommendation: City staff recommends approval of the proposed lease
with Community Rebuilds.

LEASE AGREEMENT FOR OFFICE SPACE
MOAB ARTS & RECREATION CENTER BUILDING
This Lease Agreement is entered into effective September 1, 2014, by and between
Emily Niehaus of Community Rebuilds, a non-profit organization (hereafter "Lessee"),
and the City of Moab, a municipal corporation (hereafter "Lessor").
RECITALS
A. Lessor warrants and represents that it owns a certain parcel of land located at
111 E.100 N. Street in Moab, Utah, and the building located on the Parcel
commonly referred to as the Moab Arts & Recreation Center (hereafter
"Building").
B. Lessor wishes to lease to Lessee, and Lessee wishes to lease from Lessor, under
the terms and conditions of this agreement, approximately 468 (four -hundred -
sixty -eight) square feet of finished space in the Building.
AGREEMENT
NOW, THEREFORE, in consideration of the foregoing, the parties agree as follows:
1. The Premises. Lessor hereby agrees to lease to Lessee, and Lessee hereby
leases from Lessor, the following described premises:
A certain 468 (four -hundred -sixty-eight) square feet of floor space on the
ground floor of the Building, as shown in yellow on Exhibit A.
2. Term. The term of this lease shall commence on September 1, 2014 and shall
continue for a period of two (2) year thereafter, unless sooner terminated as
provided for in this Lease. This lease shall expire on August 30, 2016.
3. Rent. Lessee agrees to pay Lessor a monthly rent during the term of this Lease.
The amount of $450.00 per month is payable on the first of each month
beginning on September 1, 2014, for a total annual payment of $5,400.00.
Payments shall be made by personal delivery or mailing by U.S. Mail to the
Moab City Treasurer's Office, located at 217 East Center Street, Moab, Utah.
a. A late charge of 10% shall be paid as additional rent for any rental
payment hand delivered or received more than five (5) days after the

payment due dates specified in Paragraph 3 above. Any checks not paid
by the bank upon first presentment shall not constitute payment of any
of the sums due under this lease.
4. Notice. Wherever in this lease it is required or permitted that notice or demand
be given or served by either party on the other, such notice or demand shall be
deemed given or served when written and hand delivered, or deposited in the
United States Mail, certified, return receipt requested, postage prepaid,
addressed as follows:

6. Parking. Parking immediately adjacent to the facility is not guaranteed. Lessee
understands that parking may be filled periodically by other users. Parking in
front of Southeast Utah Title Company and residences on 100 North Street is
not permitted.
7. Possession. Lessor promises to place Lessee in peaceful possession of the
Premises, and Lessee, by taking possession of the Premises, will have
acknowledged that the Premises are in satisfactory and acceptable condition.
8. Use. Lessee shall use the Premises for the day-to-day office functions of
Community Rebuilds, and shall not use or permit the Premises to be used for
any other purpose without written consent of Lessor. Lessee agrees that no use
consuming abnormally high utility or other service costs, such as computer use
not customary of an office of the size and type contemplated in this lease, shall
be permitted in the Premises.
9. Compliance with Laws and Regulations. Lessee agrees to observe all laws and
governmental regulations applicable to its use of the Premises, together with all
reasonable rules and regulations that may be promulgated by Lessor from time
to time.

10. Alterations by Lessee. Lessee will make no alterations to the Premises without
the prior written consent of the Lessor.
11. Hazards. Lessee shall not use the Premises, nor permit them to be used, for any
purpose which shall increase the existing rate of insurance upon the Building,
or cause the cancellation of any insurance policy covering the Building, or sell
or permit to be kept, used, or sold in or about the Premises, any article that may
be prohibited by Lessor's insurance policies.
a. Lessee shall not produce any waste upon the Premises, nor cause any
public or private nuisance or other act that may disturb the quiet
enjoyment of any other tenant, nor shall Lessee allow the Premises to be
used for any improper, immoral, unlawful, or unsafe purpose, including,
but not limited to, the storage of any flammable materials.
b. Lessee shall no use any apparatus, machinery or device in or on said
Premises that shall make any noise or cause any vibration that can be
detected by other tenants, or that shall in any way be a detriment to the
Building.
c. Lessee will not install or construct within the Premises or Building
electrical wires, water or drain pipes, machinery, or other permanently
installed devices, including, but not limited to, alarm systems, private
music systems, or special ventilation, without the prior written consent
of Lessor.
12. Care of the Premises. Lessee agrees to take good care of the Premises and lock
the building after normal business hours or if they are the last ones in the
building.
13. Liability. Lessee agrees that Lessor shall not be liable for any damage or injury
to persons or property arising out of the use of the Premises by Lessee, its
agents and employees, invitees, or visitors except that occasioned by the
negligence or act of Lessor, its agents, employees, servants, contractors, or
subcontractors.
a. Lessee will indemnify and save Lessor harmless from all liability and
loss on account of any such damage or injury; but Lessee shall not be
liable for any damage or injury occasioned by any failure of Lessor to
comply with its obligations under this Lease or by reason of the
negligence of the Lessor, its agents, servants, employees, contractors, or
subcontractors.
b. Tenant shall be responsible, at its expense, for fire and extended
coverage insurance on all of its personal property, including

removable trade fixtures, located in the leased Premises. Lessee shall,
at its own expense, maintain a policy or policies of comprehensive
general liability insurance with respect to its particular activities
within the Building. Such insurance policy shall afford minimum
protection of not less than $1,000,000 combined single limit coverage
of bodily injury, property damage or combination thereof. Lessee shall
provide Lessor with current Certificates of Insurance evidencing
Lessee's compliance with this Paragraph.
14. Lessor's Right to Inspect. Lessee agrees to permit Lessor and its authorized
representatives to enter the Premises at all reasonable times during usual
business hours for the purpose of inspection, or for the making of any
necessary repairs for which the Lessor is responsible or feels necessary for the
safety and preservation of the Premises or for the performance of any work on
the premises that may be necessary to comply with any laws or regulations of
any public authority.
15. Fixtures and Personal Property. Any trade fixtures, equipment, or personal
property installed in or attached to the Premises, Building, or Parcel by or at the
expense of Lessee shall be and remain the property of Lessee, including
Lessee's sign, and Lessor agrees that Lessee shall have the right to remove any
and all of such property prior to the expiration or termination of this Lease
Agreement, so long as no default exists under this Lease. Lessee agrees that it
will, at its expense, repair any damage occasioned to the Premises by reason of
the removal of any of its trade fixtures, equipment, or other permanently
affixed personal property as described above.
16. Repairs and Maintenance. Lessor agrees that it shall, at its cost and expense,
maintain the parcel on which the Premises are located, the Building in which
the premises are located, and the Premises, and every part of them, in good
condition, except that Lessee shall make any repairs or replacements
necessitated by damage caused by the Lessee or its employees, agents, invitees,
or visitors.
17. Utilities. Lessor agrees to provide, at its expense, to or for the Premises,
adequate heat, electricity, water, sewage disposal, air conditioning,
replacement light tubes, trash and recycling removal service, and wireless
internet services in such quantities and at such times as is necessary to Lessee's
comfortable and reasonable use of the Premises. Lessee shall provide for its
own use telephone, other services not provided for herein. Swamp coolers will
be supplied to cause the temperature in the interior of the Premises to be not
greater than 78 degrees at all times and heat will be supplied as necessary to
cause the temperature to be not less than 68 degrees at all times.
18. Janitorial Service. Lessor agrees to provide in the Premises, at Lessor's
expense, the following janitorial services: cleaning five (5) days per week; trash

disposal five (5) days per week; vacuuming of carpets twice per week; cleaning
of lighting fixtures twice per year; cleaning of windows (interior and exterior)
three (3) times per year; replacement of light tubes and bulbs as required.
19. Use of Conference Facilities. The parties agree that Lessee shall be entitled to
use additional MARC meeting and conference rooms free of charge on a space
available basis, provided that special events and other uses that require
advance reservation of greater than two weeks shall be paid for at the non-
profit rate. Reservations for the use of said facilities and rooms shall be made
through the Moab Art & Recreation Center Administrative Offices. Any room
preparation or setup shall be the responsibility of the entity utilizing the
facilities.
20. Interruption in Service. In the event of any interruption or malfunction for any
reason of any utility or service to the Premises or Building, Lessor shall use
reasonable diligence to restore the utility or service. Should any of the
equipment or machinery break down, or for any cause beyond the reasonable
control of Lessor cease to function properly, Lessor shall use reasonable
diligence to repair the machinery or equipment promptly, but Lessee shall have
no claim for rebate of rent or damages on account of any interruptions in
service occasioned by or resulting from any such breakdown or cessation for
the length of time reasonably required for repair.
21. Destruction of Premises. If at any time during the term of this lease, the
Premises or any part of the Building or Parcel shall be damaged or destroyed by
fire in a way that does not render the premises unfit for the conduct of Lessee's
business or that does not injure Lessee's business, Lessor shall promptly and
through the exercise of reasonable diligence repair the damage and restore the
premises, at Lessor's expense, to a condition comparable to the condition in
which the premises existed prior to the damage or destruction. In such case
there shall be no abatement of rent.
22. Assignment and Subletting. Lessee may not sublet or assign its interest under
this Lease.
23. Refund of Prepaid Rent. In the event that this Lease is terminated as permitted
under the terms of this Lease, Lessor shall refund to Lessee any prepaid rent
accrued as of the date of damage or destruction, less any sum then owing
Lessor by Lessee.
24. Default by Lessee. Should Lessee at any time be in default with respect to
payment of rent for a period of ten (10) days after written notice from Lessor;
or should Lessee be in default in the performance of any other of its obligations
under this Lease for thirty (30) days after written notice from Lessor specifying
the particulars of the default; or should Lessee vacate and abandon the
Premises; or if a petition in bankruptcy or other insolvency proceeding is filed

by or against Lessee, without dismissal within thirty (30) days of filing; or if
Lessee makes any general assignment for the benefit of creditors or
composition; or if a petition or other proceeding is instituted by or against the
Lessee for the appointment of a trustee, receiver, or liquidator of Lessee or of
any of Lessee's property pursuant to laws for the benefit of creditors; or if a
proceeding is instituted by any governmental authority for the dissolution or
liquidation of Lessee; then and in any such events, Lessor, in addition to other
rights or remedies it may have, shall have the immediate right of reentry in the
Premises, and after five (5) days prior written notice to Lessee, may remove all
persons and property from the premises.
a. The property may be removed and stored in a public warehouse or
elsewhere at the cost of, and for the account of, Lessee.
b. Should Lessor elect to reenter, this lease shall be deemed terminated;
provided, however, that Lessor shall be entitled as against Lessee to the
measure of damages provided by law, namely the difference between
the rent for the balance of the term of this lease following the day of
reentry and the amount of rent Lessor receives during that period from
any subsequent tenant of the Premises.
c. Lessor shall in such event have no obligation to relet the Premises.
25. Recovery of Damages. Should Lessor at any time terminate this lease under
Lessor's express rights set forth in this Lease for any breach, Lessor may, in
addition to any other remedy it may have, recover from Lessee all damages
incurred by reason of the breach, including the cost of recovering the Premises.
26. Redelivery of Premises. Lessee agrees to redeliver to Lessor the physical
possession of the Premises at the end of the term of this Lease, or any extension
of this Lease, in good condition, excepting reasonable wear and tear, and
damage by fire or from any other cause not attributable to the willful or
negligent act of the Lessee, or its employees, agents, invitees, or visitors.
27. Holding Over. Any holding over after the expiration of the term of this lease
shall be deemed to constitute a tenancy from month to month only, and shall be
on the same terms and conditions as specified in this Lease, so far as applicable,
and at a monthly rental equal to twice the rentals and other charges stated in
this Lease for the primary term of this lease.
28. Attorneys' Fees. If either party is required to place the enforcement of all or
any part of this Lease, the recovery of possession of the Premises, or damages
in the hands of an attorney, or if legal proceedings are commenced by either
party against the other party to protect or enforce rights or obligations under
this Lease, the prevailing party, whether as Plaintiff or Defendant, shall be
entitled to recover its reasonable attorneys' fees and costs.

29. Mutuality. All covenants and conditions in this Lease are mutually dependent.
31. Refurbishments. Lessor shall not be responsible for repainting the Premises or
for replacement of the carpeting unless repainting or replacement is made
necessary by the negligence of Lessor or its agents, employees, servants,
contractors, or subcontractors, or by the breach of any other obligation of
Lessor under this lease.
32. Option to Renew. Lessee is hereby given an option to renew this lease for an
additional term of two (2) years by giving Lessor written notice on or before
ninety (90) days before the expiration of the primary term of this lease. The
renewal lease is to be upon the same terms, covenants, and conditions
contained in this Lease except as to Rent as provided in Paragraph 3 above.
33. Termination. This lease may be terminated at any time with 30 days written
notice to the other party.

As you may know, the Police Lieutenant position has been vacant for several months.
One of the reasons for keeping the position vacant was to allow the Police Department
to analyze the requirements of the position and the ability of staff within the
department to perform the required duties. Based on this analysis, staff has revised the
Lieutenant job description to accurately reflect the duties of the position, an
appropriate organizational structure, and the skills and abilities needed for the position.
Both the proposed job description and the existing job description are attached. A
strike -out revision has not been provided, as the number of revisions made the strike-
out document too confusing. The following provides a summary of the important
changes:
i. The salary range for the position would stay the same as it is now.
2. The Police Lieutenant would have direct supervision over the Police
Sergeants and the Animal Control Supervisor. Currently, the Animal Control Supervisor
reports directly to the Police Chief, but this arrangement is not consistent with the
overall structure of the department and is a hold -over from when the current Police
Chief was the Assistant Police Chief and had the supervision of Animal Control as one of
his duties.
3. The Police Lieutenant would not have the managing of investigations as a
primary function. With the new Sergeant position handling these duties, the
Lieutenant would act in a policy direction and oversight function over investigations
rather than as a day -today investigator.
4. The Lieutenant would have more responsibility for staff interaction, training
and morale building than in the past. These duties require leadership and supervision
skills and experience.

5. The proposed job description calls for the Police Lieutenant to work
cooperatively with the Police Chief, Police Department staff and others in the
development and implementation of the department's vision and goals. It also calls for
more leadership involvement with the public and outside agencies.
Once the new job description is approved, we will advertise for the position both
outside and within the Police Department. It has become apparent that the duties of
the position cannot be absorbed by existing staff, and that we need a skilled and
experienced law enforcement professional to fill the position and help us meet the
demands of a busy Moab City Police Department.
Options: The City Council may approve, approve with conditions, deny or postpone
the item.
Staff Recommendation: City staff recommends approval of the proposed Police
Lieutenant Job description.
