HomeMy Public PortalAbout08-11-22 AgendaAUGUST 11, 2022 The Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING Carteret, preceding the Regular Meeting August 25, 2022, was held Thursday, August 11, 2022, at approximately 6:00 p.m. remotely, via telephone call -in. The following were noted present: ROLL CALL Mayor Daniel J. Reiman Councilmember Vincent Bellino " Jorge Diaz " Dennis DiMascio " Ajmar Johal " Susan Naples Also noted present were Carmela Pogorzelski, Municipal Clerk and Robert J. Bergen, Esq., Law Director. The meeting was opened with a moment of silent prayer and the Pledge PRAYER, PLEDGE of Allegiance led by Councilmember Bellino. OF ALLEGIANCE The 2022 Annual Notice was emailed to The Home News Tribune, The STATEMENT OF Star Ledger and posted on the bulletin board and on the doors of the MEETING NOTICE Memorial Municipal Building on January 11, 2022. Notice was published in The Home News Tribune and The Star Ledger on January 14, 2022. All items being voted on tonight were posted on the Borough's website, www.carteret.net prior to tonight's meeting. Upon MMS &C, by Councilmembers Diaz and DiMascio and unanimous APPROVAL affirmative vote of the full membership present, the minutes of Judy 21, OF MINUTES 2022 were approved as transcribed and engrossed by the Clerk. Mayor Reiman said he wanted to amend the Agenda to include Ordinance #22 -23 to acquire Block 5003, Lot 12, 37 Louis Street, he said it was for flood control; it just went up for sale yesterday, then asked for a Motion to Amend the Agenda. AUGUST 11, 2022 (continued) AGENDA AMENDED Upon MMS &C, by Councilmembers Naples and Bellino and unanimous ORDINANCE #22 -23 affirmative vote of the Rill membership present, the Agenda was amended to include Ordinance #22 -23, Acquisition of Block 5003, Lot 12. ORDINANCE #22 -21 was introduced and adopted on First Reading and ORDINANCE #22 -21 the Clerk authorized and directed to advertise same for Public Hearing, CROSSING GUARDS upon MMS &C, by Councilmembers Diaz and Bellino. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. ORDINANCE #22 -21 "AN ORDINANCE TO AMEND ORDINANCE #71 -9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" ORDINANCE #22 -22 was introduced and adopted on First Reading and ORDINANCE #22 -22 the Clerk authorized and directed to advertise same for Public Hearing, FINANCIAL upon MMS &C, by Councilmembers Diaz and Bellino. Upon individual AGREEMENT roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and ROOSEVELT Naples voted in the affirmative. INVESTMENTS, LLC ORDINANCE #22 -22 "ORDINANCE AUTHORIZING THE EXECUTION AND DELIVERY OF A FINANCIAL AGREEMENT BY AND BETWEEN THE BOROUGH OF CARTERET AND ROOSEVELT INVESTMENTS, LLC OR ITS URBAN RENEWAL ENTITY AFFILIATE" AUGUST 11, 2022 (Continued) ORDINANCE #22 -23 was introduced and adopted on First Reading and ORDINANCE #22 -23 the Clerk authorized and directed to advertise same for Public Hearing, ACQUISITION upon MMS &C, by Councilmembers Bellino and DiMascio. Upon STORMWATER individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, FLOOD CONTROL Johal and Naples voted in the affirmative. ORDINANCE 422 -23 "AN ORDINANCE TO AUTHORIZE THE ACQUISITION OF CERTAIN REAL PROPERTY WITHIN THE BOROUGH OF CARTERET" The Municipal Clerk stated that Ordinance #22 -12 was introduced and adopted on First Reading on April 7, 2022. It was duly published in the Home News Tribune on July 29, 2022, with notice that it will be considered for final passage after Public Hearing to be held on August 11, 2022 at approximately 6:00 p.m. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS &C, by Councilmembers Naples and DiMascio and unanimous affirmative vote of the full membership present, Mayor Reiman declared the Public Hearing to be open. Mayor Reiman said this is the EMS Division and Management Salary Ordinance. ORDINANCE #22 -12 SALARY ORDINANCE EMS DIVISION & MANt1GEMENT PUBLIC HEARING There being no comments or objections to the Ordinance, Mayor HEARING CLOSED Reiman declared the Public Hearing to be closed, upon MMS &C, by Councilmembers Diaz and Bellino and unanimous affirmative vote of the full membership present. 3 AUGUST 11, 2022 (continued) Upon MMS &C, by Councilmembers Diaz and Naples ORDINANCE #22 -12 "ORDINANCE TO AMEND ORDINANCE #71 -9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" ADOPTED was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. APPROVED AND ADOPTED: AUGUST 11, 2022 INTRODUCED: APRIL 7 2022 Advertised as Adopted on First Reading with notice of Public Hearing: JULY 29, 2022 Hearing Held: AUGUST 11, 2022_ Approved By: MAYOR DANIEL J. REIMAN Advertised as Finally Adopted: AUGUST 17, 2022 ORDINANCE #22 -17 The Municipal Clerk stated that Ordinance #22 -17 was introduced and CAPITAL EQUIPMENT adopted on First Reading on July 21, 2022. It was duly published in the 5 YEAR LEASE Star Ledger on July 26, 2022, with notice that it will be considered for AGREEMENT MCIA final passage after Public Hearing to be held on August 11, 2022 at approximately 6:00 p.m. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. PUBLIC HEARING Upon MMS &C, by Councilmembers Diaz and Naples and unanimous affirmative vote of the full membership present, Mayor Reiman declared the Public Hearing to be open. Mayor Reiman said this is an annual capital equipment Ordinance for bonds for fire, police and maintenance vehicles; it is a five year lease purchase with the Middlesex County Utilities Authority. 0 There being no conuuents or objections to the Ordinance, Mayor Reiman declared the Public Hearing to be closed, upon MMS &C, by Councilmembers Bellino and Diaz and unanimous affirmative vote of the full membership present. Upon MMS &C, by Councilmembers Naples and Bellino ORDINANCE #22 -17 "ORDINANCE APPROVING AND AUTHORIZING THE ENTERING INTO, EXECUTION AND DELIVERY OF A LEASE AND AGREEMENT WITH THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY RELATING TO THE ISSUANCE OF COUNTY - GUARANTEED CAPITAL EQUIPMENT AND IMPROVEMENT REVENUE BONDS, SERIES 2022 OF THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY" was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. Mayor Reiman said this codifies what is in the union contracts with regard to the bonus college credit program for Masters' Degrees, etc. — it does not apply to lawyers, judges, CFOs, etc., who have to have specific licenses for their job titles. There being no comments or objections to the Ordinance, Mayor HEARING CLOSED Reiman declared the Public Hearing to be closed, upon MMS &C, by Councilmembers Diaz and Johal and unanimous affirmative vote of the full membership present. Upon MMS &C, by Councilmembers Bellino and Naples ORDINANCE #22 -18 "AN ORDINANCE CREATING GUIDELINES FOR IMPLEMENTATION OF COLLEGE INCENTIVE PROGRAM FOR MANAGERIAL AND NON -UNION EMPLOYEES" ADOPTED was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. Mayor Reiman said this has to do with the coming onslaught of 56; making sure we control the type, location and appearance of towers, poles, etc, in rights -of -way or on public property. Upon MMS &C, by Councilmembers Diaz and Naples ORDINANCE #22 -19 "AN ORDINANCE ESTABLISHING PROCEDURES AND STANDARDS REGARDIG DEPLOYMENT OF SMALL WIRELESS FACILITIES IN PUBLIC RIGHTS -OF -WAY IN THE BOROUGH" was finally adopted. Upon individual roll call vote, Councilmembers ADOPTED Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. PUBLIC HEARING Upon MMS &C, by Councilmembers Diaz and Naples and unanimous affirmative vote of the full membership present, Mayor Reiman declared the Public Hearing to be open. Mayor Reiman said this updates the Drug -Free Zone map. HEARING CLOSED There being no comments or objections to the Ordinance, Mayor Reiman declared the Public Hearing to be closed, upon MMS &C, by Councilmembers Diaz and Bellino and unanimous affirmative vote of the full membership present. Upon MMS &C, by Councilmembers Diaz and DiMascio "AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 121, ARTICLE I, `DRUG -FREE ZONES AND DRUNK - DRIVING -FREE SCHOOL CROSSINGS' OF THE CODE OF THE BOROUGH OF CARTERET" ADOPTED was finally adopted. Upon individual roll call vote, Councilmembers Bellino, Diaz, DiMascio, Johal and Naples voted in the affirmative. Inspection of Buildings — July 2022 Upon MMS &C, by Councilmembers Diaz and Bellino and unanimous affirmative vote of the full membership present, all reports were ordered to be received and placed on file. Councilmember Bellino said there are a lot of motorcycle /bicycles, little COUNCILMEMBER scooters moving along pretty fast, blowing through signs around town. BELLINO He said they don't stop and don't wear helmets, then asked the mayor if there was anything the town could do, because he felt they would hurt someone or themselves. 11 AUUUJ1 11, LULL (continued) MAYOR REIMAN Mayor Reiman said we can't stop them, but we can enforce the laws. IIe said the state allows slow moving vehicles 15 -20 mph; but they still have to adhere to the flow of traffic and laws like other vehicles. IIe said he felt they need to wear helmets and is working with the Office of Communications on a safety guide mail out for parents, he said he would also speak with the police department.
