A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, ORDERING A GENERAL ELECTION FOR
THE OFFICES OF CITY COUNCIL PLACES 1, 3, AND 5; SUCH
REGULAR ELECTION TO BE HELD ON SATURDAY, MAY 4, 2019;
ESTABLISHING PROCEDURES FOR THE ELECTION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, May 4, 2019, is designated as a uniform election day; and
WHEREAS, by this resolution, it is the intention of the City Council to call the 2019
General Election as required by the City Charter and by other law, designate a polling place for
the election, and establish and set forth procedures for conducting the election; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for General Election.
The City Council hereby orders that a general election shall be held in the City of
Richland Hills on Saturday, May 4, 2019, at which the following officials will be elected:
City Council, Place 1
City Council, Place 3
City Council, Place 5
Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to execute the contract (the "Contract") with
Tarrant County for joint election services. In the event of a conflict between this Resolution and
the Contract, the Contract shall control.
Section 3. Polling Place.
The polling place for the Election shall be as follows:

Other polling places may be established as provided in the Contract. The polls shall be
open from 7:00 a.m. to 7:00 p.m. on May 4, 2019, in accordance with and pursuant to the
requirements of the Texas Election Code. The City shall constitute a single election precinct for
the election.
Section 4. Filing Dates.
In accordance with Section 143.007 of the Texas Election Code, eligible persons wishing
to become candidates must file an application with the City Secretary of the City of Richland
Hills, Texas 76118, and may do so beginning Wednesday, January 16, 2019 and continue
through Friday, February 15, 2019, until 5:00 p.m. Each application shall be on a form meeting
the requirements of Section 141.031 of the Texas Election Code.
Section 5. Ballots and Election Method.
Combined ballots may be utilized containing all of the offices and propositions to be
voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote
for any office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance shall be conducted exclusively on Tarrant County's eSlate electronic voting system.
On Election Day, voters shall have a choice between voting on the eSlate electronic voting
system or by a paper ballot that is scanned at the polling place using Tarrant County's eScan
voting system. All expenditures necessary for the conduct of the election, the purchase of
materials therefore, and the employment of all election officials are hereby authorized, and shall
be conducted in accordance with the Contract and the Code. The order in which the names of
the candidates are to be printed on the ballot shall be determined by a drawing by the City
Secretary pursuant to state law. Notice of the time and place for such drawing shall be given in
accordance with the Code.
Section 6. Early Voting.
a. Early voting by personal appearance. Heider Garcia, Tarrant County Elections
Administrator, is hereby appointed as the Early Voting Clerk for the election, as so indicated in
the Contract. Early voting by personal appearance shall commence April 22, 2019 and shall
continue until April 30, 2019. The main early voting site shall be at the Richland Hills Public
Library, 6724 Rena Drive, Richland Hills, Texas. Specific days, times and locations shall be
designated by the Elections Administrator and included in the Contract and shall be in
compliance with state law. On at least two weekdays during the early voting period, the location
for early voting shall be open for at least twelve (12) hours as mandated by state law.
Applications for a ballot by mail may be submitted throughout the calendar year, beginning
January 1 and must be received by our office no later than the close of business on the eleventh
day before Election Day. If the eleventh day before Election Day falls on a weekend, the
deadline is the close of business on the first preceding business day. All voted ballots that are
returned on or before Election Day will be counted. Voted ballots received on the next business
day after Election Day will also be counted if they have been postmarked by Election Day.
Voted ballots mailed from U.S. citizens residing outside the United States may be counted if
clearly postmarked on or before Election Day and received by the Elections Administrator not
later than the fifth day after Election Day.
b. Early voting by mail. Applications for a ballot by mail may be submitted throughout the
calendar year, beginning January 1 and must be received by Tarrant County Elections no later
than the close of business April 23, 2019. All voted ballots that are returned on or before
Election Day will be counted. Voted ballots received on the next business day after Election Day
will also be counted if they have been postmarked by Election Day. Voted ballots mailed from
U.S. citizens residing outside the United States may be counted if clearly postmarked on or
before Election Day and received by the Elections Administrator not later than the fifth day after
Election Day. Completed applications may be submitted by mail, contract or common carrier,
fax, or you may submit by email a completed, signed with the voter's original signature and
scanned application to the Early Voting Clerk. Under Senate Bill 5, it is now required for an
applicant submitting an application for ballot by mail via fax or e-mail to also submit an
application for ballot by mail via mail. In order for a faxed or email application for ballot by
mail to be effective, the accompanying mailed application for ballot by mail must be received
within 4 days of the submission of the application by fax or email.

c. Early voting ballot board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the
Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 7. Notice.
Notice of said election shall be given as required by the Texas Election Code.
Section 8. Election Officials.
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as permitted by law. The presiding judge shall appoint
elections clerks as maybe necessary for the proper conduct of the election. The election judge, or
the alternate election judge in the absence of the election judge, and the election clerks shall
constitute the early voting ballot board. The election judge, and alternate election judge, and
election clerks shall be qualified voters of the city.
Section 9. Governing Law.
The election shall be held in accordance with the Constitution of the State of Texas and
the Texas Election Code, and all resident qualified voters of the City shall be eligible to vote at
the election.
Section 10. Necessary Actions.
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, the City Charter, and the City Code in carrying out and conducting the election, whether
nor not expressly authorized by this Order.
Section 11. Severability Clause.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 12. Notice and Publication
This Resolution shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the General
Election. A copy of the resolution shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 13. Effective Date.
This order shall be effective upon its adoption.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, QUE ORDENA UNA ELECCION GENERAL
PARA LOS CARGOS DE LOS LUGARES 1, 3 Y 5 DEL CONCEJO
MUNICIPAL. ADEMAS, ESTABLECE QUE DICHA ELECCION REGULAR
SE LLEVARA A CABO EL SABADO, 4 DE MAYO DE 2019, DETERMINA
LOS PROCEDIMIENTOS PARR LA ELECCION Y PROPORCIONA UNA
FECHA DE ENTRADA EN VIGENCIA.
POR CUANTO, se establece el 4 de mayo de 2019 Como el Dia de la Eleccion uniforme, y
POR CUANTO, mediante esta resolution, el Concejo Municipal tiene la intention de
convocar a la Eleccion General de 2019, segun to dispuesto por la Carta Organica Municipal y por
otra legislation, designar un centro electoral para la Eleccion, establecer y exponer Los
procedimientos para su realization, y
AHORA, POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, RESUELVE:
Section 1. Orden de Eleccion para la Eleccion General.
Por la presente, el Concejo Municipal ordena la realization de una Eleccion General en la
Ciudad de Richland Hills el sabado, 4 de mayo de 2019 para elegir a Los siguientes funcionarios:
Concejo Municipal, Lugar 1
Concejo Municipal, Lugar 3
Concejo Municipal, Lugar 5
Section 2. Contrato de Administration de Eleccion Conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a celebrar el Contrato (el "Contrato")
con el Condado de Tarrant para Los servicios de la election Conjunta. En caso de conflicto entre la
presente Resolution y el Contrato, este ultimo prevalecera.
Section 3. Centro electoral.
El centro electoral para la election sera el siguiente:

Se podran establecer otros centros electorates segun to dispuesto en el Contrato. Las
elecciones se llevaran a Cabo desde Las 7:00 a.m. hasta Las 7:00 p.m., el 4 de mayo de 2019, de
conformidad con Los requisitos establecidos en el C6digo Electoral de Texas. La Ciudad constituira
un solo distrito electoral para la Eleccion.
Section 4. Fechas de Presentation de Solicitudes.
De acuerdo con la Section 143.007 del Codigo Electoral de Texas, las personas calificadas
que deseen postularse como candidatos deben presenter una solicitud a la Secretaria de la Ciudad de
Richland Hills, Texas 76118, a partir del miercoles 16 de enero de 2019 haste el viernes 15 de
febrero de 2019, a las 5:00 p.m. Cade solicitud debera cumplir con los requisitos de formato
establecidos en la Seccion 141.031 del Codigo Electoral de Texas.
Seccion 5. Boletas y Metodo de Eleccion.
Se pueden utilizer boletas electorates combinadas que contengan todos los cargos y
propuestas que se votaran en cede centro electoral, siempre y cuando ningun elector reciba una boleta
electoral o el permiso Para voter por un cargo o propuesta pare los cuales no sea elegible pare voter.
Las Votaciones Anticipadas en persona deben ser llevadas a cabo exclusivamente mediante el
sistema de voto electronico eSlate del Condado de Tarrant. El Dia de la Eleccion, los electores
podran voter a traves del sistema de votacion electronics eSlate o con una boleta electoral que se
escanea en el centro electoral a traves del sistema de votacion eScan del Condado de Tarrant. Por la
presente, se autorizan todos los gastos necesarios pare la realization de la election, la compra de los
materiales a tat efecto y la contratacion de todos los funcionarios electorates; dichos gastos se
realizaran conforme al Contrato y al Codigo. El Orden en que se imprimiran los nombres de los
candidatos en la boleta electoral se determinara a traves de un sorteo que realizara la Secretaria de la
Ciudad conforme a la legislation del estado. La Nora y la fecha del sorteo se notificaran de acuerdo
con to dispuesto en el Codigo.
Seccion 6. Votacion Anticipada.
a. Votacion Anticipada en Persona. Por la presente, se designs a Heider Garcia,
Administrador de las Elecciones del Condado de Tarrant, como Secretario de la Votacion Anticipada
pare la Eleccion, Begun to indicado en el Contrato. La Votacion Anticipada en persona comenzara el
22 de abril de 2019 y finalizara el 30 de abril de 2019. El centro electoral principal de Votacion
Anticipada sera en Richland Hills Public Library, 6724 Rena Drive, Richland Hills, Texas. La
Administration Electoral determinara los lugares, los digs y los horarios especificos, que se incluiran
en el Contrato y que cumpliran con to dispuesto en la legislation del estado. Mientras dure el
periodo de Votacion Anticipada, el centro electoral de Votacion Anticipada esters abierto, como

votos enviados por correo de ciudadanos estadounidenses que residen fuera de los Estados Unidos se
computaran si muestran claramente un sello postal con la fecha del Dia de la Eleccion, o una fecha
anterior, y siempre que el Administrador de las Elecciones los reciba, como maximo, el quinto die
posterior al Dia de la Eleccion.
b. Votacion Anticipada por Correo. Se pueden presenter solicitudes pare votacion por correo
a to largo del ano calendario a partir del 1 de enero. EI personal de las Elecciones del Condado de
Tarrant debe recibir estas solicitudes antes del cien e de las actividades laborales el 23 de abril de
2019. Se computaran todos los votos que se envien antes del Dia de la Eleccion, o ese mismo die.

mensajeria contratada o comun, o fax; o se puede enviar la solicitud escaneada completada y con la
firma original del elector por correo electronico al Secretario de la Votacion Anticipada. Conforme
al Proyecto de Ley 5 del Senado, ahora se requiere que el solicitante que envie una solicitud para
votacion por correo por fax o correo electronico, tambien la envie por correo postal. Para que una
solicitud para votacion por correo enviada por fax o correo electronico sea efectiva, la solicitud
enviada por correo que acompana la solicitud para votacion por correo deber ser recibida dentro de
los 4 dias del envio de la solicitud por fax o correo electronico.

c. Junta para la Votacion Anticipada. Por medio de la presente, se crea una Junta para la
Votacion Anticipada, que se ocupara de escudrinar la votacion anticipada que se realice tanto en
persona Como por correo. Conforme al Contrato, el Condado de Tarrant nombrara a la Junta para la
Votacion Anticipada a fin de que procese los resultados de la votacion anticipada de la eleccion.
Secci6n 7. Aviso.
El aviso de la eleccion se realizara segun to dispuesto por el Codigo Electoral de Texas.
Seccion 8. Funcionarios electorales.
La Administracion Electoral del Condado de Tarrant designara al juez electoral, al juez
electoral suplente y a la junta para la votacion, segun to permitido por la ley. El juez responsable
nombrara a los secretarios electorales, segun sea necesario, para el correcto desarrollo de la eleccion.
El juez electoral o, en su ausencia, el juez electoral suplente y los secretarios electorales constituiran
la Junta para la Votacion Anticipada. El juez electoral, el juez electoral suplente y los secretarios
electorales seran electores calificados de la Ciudad.
Seccion 9. Legislacion aplicable.
La eleccion se realizara de conformidad con la Constitucion del Estado de Texas y el Codigo
Electoral de Texas, y todos los residentes de la cudad que Sean electores calificados seran elegibles
para votar en la eleccion.
Seccion 10. Medidas Necesarias.
Se autoriza y ordena al Alcalde y a la Secretaria de la Ciudad, en consulta con la Procuradora
de la Ciudad, a tomar todas las medidas necesarias para cumplir con las disposiciones del Codigo
Electoral de Texas, la Carta Organica Municipal y el Codigo Municipal para llevar a cabo la
Eleccion, independientemente de que esten o no expresamente autorizados por esta Orden.
Seccion 11. Clausula de Divisibilidad.
Por la presente, se declara que el Concejo Municipal tiene la intencion de que las secciones,
los parrafos, las oraciones, las clausulas y las frases de esta Orden sean divisibles, y que si alguna
sentencia o decreto validos de un tribunal con jurisdiccion competente declarara la nulidad o
inconstitucionalidad de alguna frase, clausula, oracion, parrafo o Seccion, dicha nulidad o
inconstitucionalidad no afectaran a ninguna de las frases, las clausulas, las oraciones, los parrafos y
las secciones restantes de esta Orden, dado que estos hubieran sido promulgados por el Concejo
Municipal sin la incorporacion en esta Orden de ninguna de dichas frases, clausulas, oraciones,
parrafos o secciones nulos o inconstitucionales.
Seccion 12. Aviso y Publicacion
Esta Resoluci6n constituira la Orden de Eleccion (segun to dispuesto por la Seccion 3.001 del
Codigo) y el Aviso de Eleccion (segun to dispuesto por la Seccion 4.001 del Codigo) para la
Eleccion General. Al menos veintiun digs (21) antes de la eleccion, se publicara una copia de la
Resolucion en la pizarra de anuncios que se utiliza para la publicacion de los avisos de las reuniones
del Concejo Municipal. El aviso se publicara en el periodico, de acuerdo con to dispuesto por la
legislacion del estado.
Seccion 13. Fecha de Entrada en Vigencia.
Esta Orden entrara en vigencia a partir del momento de su adopcion.
