No. #22 -177 Date of Adootion August 25, 2022 AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT WITH CME ASSOCIATES, FEE ESTIMATE - FEMA FMA FEASIBILITY STUDY RE: NOES CREEK FLOOD MITIGATION WHEREAS, the Borough of Carteret is in need of specialized engineering services in connection with the FEMA Flood Mitigation Assistance Grant Noes Creek Flood Mitigation Feasibility Study; and WHEREAS, CME Associates, 1460 Route 9 South, Howell, New Jersey 07731, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $100,000.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Acct. # NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: I. The proposal from CME Associates for engineering services related to the FEMA Flood Mitigation Assistance Grant Noes Creek Flood Mitigation Feasibility Study at a cost not to exceed $100,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department, the Borough Director of Engineering and CME Associates. In 2020, CME Associates submitted a Flood Mitigation Assistance (FMA) grant application on behalf of the Borough for a planning study to determine appropriate measures to mitigate flooding associated with the inundation of Noes Creek from the Arthur Kill in the central low -lying areas of the Borough. In July 2022, the Borough executed a grant agreement with NJOEM for a $100,000 grant to fund this feasibility study. The terms of the grant Include a 75% federal / 25% local cost sharing agreement. Enclosed is a copy of the award letter and executed sub -grant agreement. The approved scope of work outlined In the application included assessing a holistic flood management solution to the 1,200+ structures Impacted in Zone A and Zone X due to coastal flooding emanating from Noes Creek. A system of preliminary engineering measures working In concert (flood barrier, pump station, and flood gate) are part of the proposed scope of work. Specifically, the project scoping phase will develop multiple mitigation solutions and assess all aspects of a potential mitigation project, focusing on three main areas: (A) engineering feasibility, (B) environmental feasibility, and (C) economic feasibility. Following these assessments, (D) community Input will be sought through public presentations, public meetings, and comment sessions on the proposed mitigation actions. All these factors will be summarized into a final project scoping report (E) which will be used for a future funding opportunity. Work would also be inclusive of work necessary to administer the grant, including quarterly NJOEM reporting, reimbursement processing, and grant closeout. A. Engineering Feasibility This task will Include collecting data, including topographic, hydraulic and hydrologic information, and historical storm event data to determine an appropriate level of protection (wall and flood gate elevations) and limits of mitigation measures. We will review and recommend types of construction and preliminary designs for flood barriers, gates, and stormwater pumping solutions. Environmental Assessment This task will include reviewing the impacts of the proposed mitigation actions on the local environment, including, but not limited to: wildlife, threatened and endangered species, riparian and wetland impacts, stream flow impacts, nolse pollution, planning, and aesthetics. This task would also include a review of permitting requirements for various scenarios from the NJDEP and USACE. Estimated Fee C. Economic Feasibility Assessment ................ .....................$20,000.00 Our office will prepare a preliminary construction cost estimate based on historical construction costs; maintenance costs; and final design costs, and a benefit -cost analysis for use in a subsequent application for federal funding to ensure project cost - effectiveness. Work in this phase would also include the identification of possible outside funding sources, including those available on the County, State, and Federal level, which may be available to supplement funding sources for the eventual implementation of the mitigation activity.
