A RESOLUTION DELEGATING AUTHORITY To THE MAYOR To MEDIATE AND ARBITRATE
WITH HAWKEYE PAVING CORPORATION REGARDING DISPUTED PROJECT COSTS
WHEREAS,the City of Riverdale and Hawkeye Paving Corporation entered into an
agreement for the paving of certain roadways;
WHEREAS,the City of Riverdale and Hawkeye Paving Corporation dispute the
quality, quantity and cost of certain work performed by Hawkeye Paving Corporation;
WHEREAS,the agreement between the City of Riverdale and Hawkeye Paving
Corporation requires both parties to participate in dispute resolution including mediation and,
if necessary, to arbitration to settle any contractual disputed costs
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF RIVERDALE, IOWA, that the Mayor and the City Attorney are authorized to represent
the City of Riverdale in mediation, for the purpose of settling Contractual disputes.
PASSED, APPROVED AND ADOPTED THIS 19 March 2013, by the following
vote:
