AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL
CODE SECTIONS RELATING TO THE BUILDING CODE TO
BRING THE TEMPLE CITY BUILDING CODE UP TO CUR-
RENT PROVISIONS OF THE LOS ANGELES COUNTY BUILD-
ING CODE
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 8100 of the Temple City Municipal Code
is hereby repealed.
SECTION 2. Section 8100 is hereby added to the Temple
City Municipal Code to redd as follows:
"8100. Except as hereinafter provided that certain
building code known and designated as the Los Angeles County
Building Code, 1962 Edition, as published in the 1962 Edition
of the Los Angeles County Building Laws, pages 19 through 435
inclusive, and such code shall be and become the Building Code
of the City of Temple City, regulating the erection, construc-
tion, enlargement, alteration, repair, moving, removal, demo-
lition, conversion, occupancy, use, height, area, maintenance
of all structures and certain equipment therein specifically
regulated and grading within the City of Temple City, and pro-
viding for the issuance of permits and the collection of fees
therefor, providing penalties for violation of such code, de-
claring and establishing fire zones.
Three copies of said Los Angeles County Building Laws have
been deposited in the office of the City Clerk of the City of
Temple City, and shall be at all times maintained by said clerk
for use and examination by the public."
SECTION 3. Section 8100.5 is hereby added to the Temple
City Municipal Code to read as follows:
"8100.5. No fee shall be required for the issuance
of a permit to build a structure designed and used exclusively
as an emergency fallout shelter."
SECTION 4. Section 8101 of the Temple City Municipal Code
is hereby repealed.
SECTION 5. Section 8101 is hereby added to the Temple
City Municipal Code to read as follows:
".8101. Whenever any of the following names or terms
are used in said Los Angeles County Building Code or in this
ordinance, each such name or term shall be deemed and construed
to have the meaning ascribed to it in this section as follows:
"Building Department" shall mean the "Building and
Safety Division" of the Department of County Engineer.
"Building Official" shall mean County Engineer of the
County of Los Angeles.
"City" shall mean the City of Temple City except in
Section 103 of said Building Code.

"County," "County of Los Angeles" or "unincorporated'
territory of the County of Los Angeles" shall mean the City of
Temple City.
"General Funds" shall mean the City Treasury of the
City of Temple City.
"Health Officer" shall mean the Health Officer of the
City of Temple City.
"Ordinance No. 7583, an ordinance adopting a Health Code"
shall mean The City Health Ordinance of the City of Temple City."
SECTION 6. Sections 8101.1, 8101.2, 8101.3, 8101.4 and
8101.5 are hereby added to the Temple City Municipal Code to
read as follows:
"8101.1 Section 207 of the said Los Angeles County
Building Code is amended to read:
"Section 207. Rehabilitation Board. In order to
hear appeals provided for in Chapter 99 regarding substandard
buildings the City Council shall sit as the Rehabilitation
Board. Hearings for demolition or repair of substandard build-
ings shall be heard by the City Council sitting as the Rehabili-
tation Board. The City Council shall render a written decision
to the Building Official with a duplicate copy to the Appellant
and the City Council shall take such action in the adoption of
new legislation as shall be consistent with its decision."
"8101.2. Section 208 of the Building Code of the
City of Temple City shall read as follows:
"Section 208 (a) Compliance with Code. A person
shall not erect, construct, enlarge, alter, repair, move, im-
prove, remove, convert, demolish, equip, use, occupy or main-
tain any building or structure or perform any grading in the
City, or cause the same to be done, contrary to, or in violation
of any of the provisions of this Code.
(b) Penalty. Any person, firm or corporation vio-
lating any of the provisions of this Code shall be deemed guilty
of a misdemeanor, and each such person shall be deemed guilty
of a separate offense for each and every day or portion thereof
during which any violation of any of the provisions of this Code
is committed, continued or permitted, and upon conviction of any
such violation such person shall be punishable by a fine or not
more than $500, or by imprisonment for not more than six months,
or by both such fine and imprisonment."
"8101.3. Said Los Angeles County Building Code is
amended by deleting Section 307 therefrom."
"8101.4. Section 5105(f) of said Los Angeles County
Building Code is amended by deleting paragraphs 4 and 5 there-
from."
"8101.5. Section 5109 of said Los Angeles County
Building Code is amended to read as follows:
"Section 5109. Miscellaneous Domestic Appliances.
(a) Clearances.
1. Vertical clearance above cooking top. Domestic

free-standing or built -in ranges shall have vertical clearance
above the cooking top of not less than thirty inches (30 ") to
combustible material or metal cabinets. When the underside of
such combustible material or metal cabinets is protected with
asbestos millboard at least one - fourth inch (1/4 ") thick
covered with sheet metal of not less than No. 28 U. S. gauge,
the distance shall be not less than twenty -four inches (24 ").
The protection shall extend nine inches (9 ") beyond the sides
of the range. When combustible material or metal cabinets above
the cooking top of domestic free- standing or built -in ranges are
protected by a metal ventilating hood, the top of which is more
than twenty -four inches (24 ") above the cooking top and is insu-
lated with at least one- fourth inch (1/4 ") thick asbestos mill -
board, such protection need not extend beyond the sides of the
range.
2. Horizontal clearance of built -in top cooking units.
Minimum horizontal distance from the center of the burner
head(s) of a top (or surface) cooking unit to vertical combusti-
ble walls extending above the top panel shall be not less than
that distance specified by the permanent marking on the unit.
(b) Ranges and Hot Plates. Ranges or hot plates shall not
be installed in rooms intended to be used for sleeping purposes.
(c) Kitchen Ventilation. There shall be installed in the
wall or ceiling, approximately over the cooking facilities; a
ventilating opening with a minimum area of eight inches. by six
inches (8 "x 6 "), connected >'by an incombustible ventilating duct
to the outside of the building.'- The ventilating duct for each
kitchen-shall have a minimum "cross-sectional area of twenty - eight-
square inches (28 sq. in;. )-. An approved forced -draft system of
ventilation 'may be substituted for the natural -draft ventilating
system.
Combination -type gas aril solid-fuel ranges and trash- burner
ranges must be vented to a Type A,, chimney constructed in accord-
ance with the provisions of this Chapter, for use by trash bur-
ners. Solid -top -type gas' ranges and .built -in gas circulator -
type ranges shall be' vented to ,an approved Ty",pe: B gas vent or
Type A chimney. Gas ranges having a griddle „and - open -type top
burners are not cla,ssed' as s?o1id 7top ranges.'
(d) Domestic Clothes Dryers,,. .1. 'Prohibited locations.
Clothes dryers shall not be instal -led in bathrooms or rooms
used for sleeping purposes.
2. Moisture exhaust ducts. Where clothes dryer is con -
nected to a moisture exhaust duct it shall be installed in ac-
cordance with manufacturer's instructions and recommendations.

ed into any Vent connector,' gas vent, or chimney.
Ducts fpr exhausting clothes dryers shall not be put to-
gether with sheet metal screws or other fastening means' which
extend into the duct,
In no case shall the moisture exhaust terminate beneath
the building or in the attic area."
