APPROVING PROGRESS PAYMENT ESTIMATE NO.3
& CHANGE ORDER 91
ARTS DISTRICT STREETSCAPEIMPROVEMENTS PHASE II
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract to S. Brothers, Inc. iri the amount of $785,316.00 for the Phase II Arts District
Streetscape Improvements; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary and has recommended that the aforesaid contract be modified in accordance
with Progress Payment Estimate #3 & Change Order #1 (see attached); and
WHEREAS, Progress Payment Estimate No. 3 & Change Order #1 include a change in
the description of work and/or to decrease quantities to reflect as -built conditions, and to
provide for certain supplementary items; and
WHEREAS, Change Order #1 provides for a net increase in the contract price in the
amount of $153,610.32, resulting in a revised contract price of $938,925.32 including all
previously approved change orders; and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the
above described changes and/or modifications to the project were unforeseen at the time
of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
I. That Progress Payment Estimate No. 3 & Change Order #1
attached, hereto and made a part hereof, resulting in a net increase
of $153,610.32 .and resulting in a revised contract price of
$938,925.32 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to
execute Progress Payment Estimate No. 3 & Change Order #1 and
issue payment thereon, based upon the recommendation of the
Borough Engineer and subject to attorneys review of the
maintenance bond.

3. A copy of this resolution and a fully executed copy of Progress
Payment Estimate No. 3 & Change Order #1 be forwarded to the
Borough's Purchasing Department and CME Associates for
distribution to S. Brothers, Inc.

and certified as a true copy of the
original on September 23, 2022.

NOTICE OF AWARD OF CHANGE ORDER
Please be advised that an September 22, 2022 the Borough Council
of the Borough of Carteret, Middlesex County, New Jersey, adopted
a Resolution authorizing Change Order 81 providing for,a net'In-
crease In the contract amount of $153,610.32 resulting in a revised
contract price of $938,925.32.
The Change Order specifically was for S. Brothers, Inc. with regard
to the Arts District Streetscape Improvements Project.
The Borough's Engineer has certified that the changes were neces-
sary and not anticipated at the beginning of the project.

Dear Ms. Pogorzelski:
Enclosed for your review and further handling, please find Progress Payment Estimate No. 3 and Change
Order No. 1 for the above -referenced project, as approved by this office. This estimate is in the amount
of $169,710.11 for work completed through August 2022 by the Contractor, S. Brothers, Inc. Work
includes parking lot construction, striping, lighting improvements, and streetscape work along Pershing,
Washington, and Cooke Avenues. Certified Payroll Records will be provided by the Contractor under
separate cover.
Also enclosed herewith please find Change Order No. 1, prepared by our office for Borough Council's
review and approval. This change order reflects increases and decreases in contract quantities required
to complete the project and accommodate additional scope and expanded project limits. The increases in
quantities could not, in our opinion, have reasonably been effectuated by a separately bid contract without
unduly disrupting work and imposing adverse consequences on the Borough. These improvements will
ultimately provide an improved level of service to the Borough and its residents.
Change Order No. 1 results in an increase in contract value from the original amount of $785,316.00 to
and adjusted contract amount of $938,925.32, for an increase of $153,610.32.
