A special meeting of Council 1•.ras held today at 5 :00 P.M.
and was attended by Mayor Dutton, who presided, and Councilmen
Walsh, Young, Hosti, Lovell, end Ferrell and also W. H. TOms
J. G. Attaway and G. R. Vinson.
The meeting was called for purpose of:
1. Discuss and taking whatever action is necessary to
expediate work now being done by J. G. Attaway Company in
connection with the sewer system.
2. The election of Town Attorney.
Mr. Toms stated that he was anxious to get the project
finished_just as quickly as possible and that he would end
had been cooperating to the fullest, change order number 8 w
was approved for. 75 drys which was for expiration of approved
time to April 10, 1944 rather than March 21, 1944, the word-
ing of resolution did not set the correctdate. The seventy -
five days should be for additional work and expiring time
January 26, 1944 to March 21, 1944, he stated Town was very
cooperative in granting extension of time. When Contractor
took over the work at Treatment plant he did not have any
additional time granted to him, but he did the work. Mr. Haz-
lehurst ordered twenty days additional time for the work on
treatment plant, which had never been approved, Mr. Toms stated
he was not here to influence Council but to work with all con -
cerned. He stated that Town intended giving the Attaway
Company seventy -five days extension but for elapsed time Jan-
uary 26, 194+ to March 21, 1944 there was no change order cov-
ering this. If he were in J. G. Attewa.y's position he would
ask for additional time, the job could have been handled more
expediteously the F.W.A, had purchased the equipement on hand
from old W.P.A. all of this was supposed to have been on the

job, some of it was not, Mr. Toms stated another factor against
J. G. Attaway Company being away from labor market and third
several instances he was giving tide elevations which were in-
correct. It would be of benefit to Tybee if they would grant
seventy -five day extension March 21,. 1944 to. June 5, 1944 in add-
ition to that already authorized.
Mr. Vinson stated that if the original contract had been ad-
herred to, the job would have . been completed earlier that is
one hundred and fifty calendar days instead of one hundred and
fifty work days.
Mayor Dutton stated that the position of the Town is that the
matter was misrepresented by both the government and the J. B.
McCrary Company. If Town had known what the cost would be to op-
erate plant the Town would never have gone into it. The town ad-
vertised for bids. The J. G. Attaway Company was low bidder.
Competitors said he could not complete on time. Contract was
changed to agree to J. G. Attaway Company, they have fallen short,
Mayor Jones was constantly fighting it, trying to keep things
functioning properly, streets have been blocked, residents could
not get to their homes, a dangerous fire hazard was created, and
at this late date, the system should have been finished and the
streets should be repaired.
Mr. Vinson stated that he wished to correct the Mayor about
the cost of operating the sewer system, for when the survey was
made an entirely new plant had been designed.
Mayor Dutton stated that the 10th street area has been under
water for several months. Mr. Attaway stated that he would put
in a new line with a new catch basin at 10th street and second
avenue as the old catch basin put in by the town is below street
level and overflows during the spring tides, at present time his

bulldozer which was recently repaired is again out of service,
the vents came and they were the wrong kind. Mayor Dutton
said that he appreciated the difficulties of Mr. Attaway, but
the Town has to do something. Mayor Dutton asked who would
have the say as to when the system is completed, Mr. Toms
stated the town's Engineer, J. B. McCrary Company along with
F. W. A., that when inspeotion is called if contract is not
met then F. W. A. will require that it will be. Mr. Attaway
stated that he had about one hundred feet more pipe to finish,
Mr. Toms stated that there was two pumping stations to finish,
Mr. Attaway stated that he could lay new lines in three weeks
as all of the trenches are shallow. The bad condition of
some of the streets were mentioned and Mr. Toms stated that a
list of streets most essential be made nd he would see that
they are fixed first. Mayor Dutton asked if all of the stubb-
ing had been put in, Mr. Vinson aid no but all W. P. A. work
had been stubbed, Mr. Toms stated that he would give ti Cont-
ractor the 75 days that he asked for with the stipulation that
the work would be finished and streets put in condition as
called for under his contract. Mr. Toms asked Mr. Attaway
how long it would take to put streets in proper condition? Mr.
Attaway said it would bequire e couple of weeks, Mr. Toms
suggested that instructions as to gist of just what is to be
done be issued to the Engineer and Contractor by letter send-
ing him a copy, this will eleminate a lot or erregularities
and misunderstandings. Mr. Vinson stated the system would
be in operation within 10 days and houses that are vacant can
connect now. Mr. Toms stated that Mr. Attaway had made a re-
quest and he wanted to notify the Atlanta office so whatever

lease let him know. Mayor Dutton stated-that

if additional time is given that it should be put in writting as
just what is to be done, first thing is to complete the system,
Secondly the important streets should be put in condition and in
order of importance.
Councilman Lovell moved that the following resolution be a-
dopted, Councilman Host seconded and -the motion passed.
RQSOLUTION
WHEREAS, the J. G. Attaway Construction Company, the.contract-
or now constructing the sanitary sewerage system at Savannah
Beach, Tybee eland, Georgia, Federal Works Agency Docket No.
Lea. 9 -244 NF, has requested an extension of fifty -five (55). days
to complete the original contract and subsequent change orders;.
and
WHEREAS, should the. -said extension of fifty -five (55) days be
granted, the original contract and all subsequent change orders
should be fully completed by the said J. C. Attaway Construction
Company on or before June 4, 1944; and
+TE ^A3, it is deemed advisable to grant the said fifty -five
(55) day extension as aforesaid in order to complete the said
sanitary sewerage system;
NOW THEREFORE, HE IT RESOLVED BY the Mayor and Councilmen
of the Town of Savannah Beach, Tybee Island, in Council assemb-
led, that the said J. G. Attaway Construction .Company be and it
is hereby given an extension of fifty -five (55) days to complete
the entire construction of the original contract and subsequent
change orders and that said completion date will be on or before
June 4, 1944; subject, however, to the provisions that the said
J.• G. Attaway Construction Company will complete the following
work in the order in which it is designated:
1. Complete sewer line on Campbell Street,
2. Install and complete pumping station on let Avenue
and Campbell street.
3. Complete all work on 10th Street from the Strand to
Jones Avenue and put street in condition for.use by motorists.
4. Complete all work on Jones Avenue from 10th to 12th
Streets and repave damaged portions of street.
5. Lay pipe from Alled HD" to 10th Street.
6. Repave and resurface cave -in in pavement at 14th
Street and 1st Avenue.
7. Instal. manhole at 14th Street and Jones Avenue.
8. Complete shelling of all streets that have been
damaged during construction, placing the shells on the surface.
instead of covering them with sand.
9. Complete resurfacing and repairing all streets with
a crown and bring them up to engineer's grade on all other streets
that have been'damaged during construction.
10. Install pumping station at Estill Station.
11. Backfill around digestor and grade around disposal
plant area.
12. The following work can be completed at any time by
the contractor: Lay :pipe, in accordance with change order,
on Butler Avenue from 15th. Street to 16th Street; on 14th
Street from the Strand to Butler Avenue; on Butler Avenue
from llth to 12th Streets; on Jones Avenue from 13th to 14th
Streets; on Butler Aveunue from 1st to Tilton Street; and on
6th Street from Butler .Avenue to Radar.
RESOLVED FURTHER THAT before this Resolution becomes
effective the said J. G. Attaway Construc_ ion Company will
acknowledge and agree to the terms ofthis Resolution.
Nominations were called for the election of a Town At-
torney, Councilman Young moved that A. Leopold Alexander be
elected Town Attorney for the remainder of the fiscal year
at 450.00 per month. louncilman Walsh seconded, the motion
passed.

, A special meeting of Council was held today at 6 :00 P.M.
and was attended by Mayor Dutton, who presided, and Council-
men Hosti, Young, Lovell, and Walsh.
The meeting was called for the purpose of:
1. Adopt a resolution certifying the returns of the
managers in the general election held on April 3, 1944.
Codncilman Lovell moved that the following resolution
be adopted. Councilman Hosti seconded, motion passed.
RESOLUTION
WHEREAS, the managers duly named by Resolution passed
by the Mayor and Councilmen of the Town of Savannah Beach, T
Tybee Island, Georgia, in Council assembled, on the ,
day of March, 1944, to conduct the election just concluded
and held on this the 3rd day of April, 1944, at Savannah
Beach, Tybee Island, for the purpose of electing a Mayor and
six (6) Councilmen, three (3) of whom shall be bona fide
