HomeMy Public PortalAbout19440405CCMeeting38 Town of Savannah Beach, Tybee Island, and three (3) of whom shall be bona fide residents and domicled in Chatham County, outside of the Corporate limits of the Town of Savannah Beach, Tybee Island, and . who shall own property at Savannah Beach, Tybee Island, to hold office until the first Monday in April, 1946, or until their succ- essors have heen duly elected and qualified, have made the consoli- dated returns and /or results to the Mayor and Councilmen calling said election, which consolidation was done in the presence of and together with the several managers; and WHEREAS, it appears that EDWARD A. Dutton received the highest number of votes for Mayor of the Town of Savannah Beach, Tybee Is- land; and WHEREAS, JOEL T: FARRELL, BENNO P. HOSTI and MITCHELL R. YOUNG received the ,highest number of votes for Councilmen of the Town of Savannah Beach, Tybee Island, who are-bona fide residents and domiciled within the corporate limits of the Town of Savannah Beach, Tybee Island, and WILLIAM S. LOVELL, MORRIS SLOTIN and CHARLES V. WALSH received the highest number of votes for Councilmen of the Town of Savannah Beach, Tybee Island, who are bona fide residents and domiciled in Chatham Count, outside the corporate limits of the Town of Savannah Beach, Tybee eland, and who own property at Savannah Beach, Tybee Island; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, in Council assembled, and it is hereby resolved by the authority of the same that the result of said election be and the same is hereby declared as electing: EDWARD A. DUTTON as Mayor JOEL T. FARRELL as Councilman BENNO P. HOSTI as Councilman MITCHELL R. YOUNG as Councilman WILLIAM S. LOVELL as Chairman MORRIS SLOTIN as Councilman CHARLES V. WALSH as Councilman for the Town of Savannah Beach,. Tybee Island, to hold office until the first Monday in April, 1946, or until their successors are elected and duly qualified; said results appearing from the returns of said election managers, which said returns are hereby adopted and made a part hereof. M., and was attended by the Mayor Dutton, who presided, and Councilmen Walsh, Young, Farrell, and Hosti and also W. H. Toms, J. G. Atta- 1 1 way and G. R. Vinson. • Mr. Attaway stated that in connection with the resolution passed at the meeting of Council of March 31, 1944 that it would be necessary to vary somewhat, for to complete the work in the order as shown on the resolution before he started laying pipe would work a hardship on him, Mayor Dutton stated tilt it was not necessary to do the work in the order ea shown, Mr. Toms sug- gested that part of resolution be re- worded. Councilman Walsh moved that at the end of Number 4 paragraph of the resolution passed March 31, 1944, be added to the following. Councilman Young seconded and the motion passed. RESOLUTION WHEREAS, the J. G. Attaway Construction Company, the contractor now eonstnucting the sanitary aewernge system at Savannah Beach Tybee Island, Georgia, Federal Works Agency Docket No. Ga. 9 -244 NF, has requested an extension of fifty -five (55) days to com- plete the original contract and subsequent change orders; and WHEREAS, should the said extension of fifty -five (55) days be granted, the origin-1 contrnct and a11 subsequent change orders should be fully completed by the said J. G. Attaway Cons- truction Company on or before ' une 4, 194-; and WHEREAS, it is deemed advisable to grant the said fifty -five (55) day extension as aforesaid in order to complete the said sanitary sewerage system; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of the ?own of Savannah Beach, Tybee Island, in Council assem- bled, that the said J. G. Attaway Construction Company be and it is hereby given an extension of fifty -five (55) days to complete the. entire construction of the original contract and subsequent change orders and that said completion d to willke on or before June 4, 1944; subject, however, to the provisions that the said J. G. Attaway Construction Company will complete the following work in the order in which it is designated; or cnn devate from this if it is advantageous and of benefit to contractor in the use of his equipment to do the jobs in this list other than in order, as shown: 1. Complete sewer line on Campbell Street. 2. Install and complete pumping station on lst Aveune and Campbell Street. . 3. Complete all work on 10th Street from the Strand to Jones Avenueand put street in condition for use by motorists. -4. Lomplete all work on Jones Avenue from 10th to 12th Streets and repave damaged portions of street. 5. Lay pipe from Alley tIDH to -loth Street. 39 40 6, Repave and resurface cave -in in pavement at 14th Street and let Avenue. 7. Install manhole at 14th Street and Jones Avenue. S. Complete shelling of all streets that have been damaged during construction, placing the shells on the surface instead of covering them with sand. 9. Complete resurfacing and repairing all streets with a crown and bring them up to engineer's grade on all other streets that have been damaged during construction. 10. Install pumping station at Estill Station. 11. Backfill around digestor and grade around disposal plant area. 12. The following work can be completed at any time by the contractor: Lay pipe, in accordance with change order, on Butter Avenue from 15th Street to 16th street; on 14th Street from the Strand to Butler Avenue; on Butler Avenue from 11th to 12th Streets; on Jones Agenue from 13th to 14th Streets; on Butler Avenue from let to Tilton Street; and on 6th Street from Butler Avenue to Radar. RESOLVED FURTHER that before this Resolution becomes effective the said J. G. ,Attaway Construction Company will acknowledge and agree to the terms of this Resolution. AN ORDINANCE AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAYlst, 1944; AND FOR OTHER PURPOSES. 42 SECTION 1. Be it ordained by the Mayor and Councilmen of the Town • of -Savannah Beach, Tybee Island, Georgia, in Council assembled, and it is herby ordained by the authority of the same, that. the rate of taxation upon real estate and personal property within the limits o of the said Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year commending May 1st, 1944, shall be ONE AND ONE *HALF (1i) PER CENT upon the assessed or returned value of same, the value of real estate improvements to be ascertained from the returns of the Committee on Assessments of said Mayor and Councilmen, and the val- uation of personal property to be ascertained from the returns of the owners thereof, in pursuance of the scheme and.plan contained in Sections One, Two, Three and Four of the Ordinance to provide for the assessment of taxable property in the Town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such property for taxation and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia, approved August 19, 1922, Section 21, passed -.in Council assmbled October 13,'1922; and it is further ordained that if any person or persons shall refuse or neglect to pay the tax req- -uired by this Ordinance within seven (7) months after same shall be- come due, or shall fail or refuse to pay any DOUBLE TAX assessed as above provided within thirty (30) days after same shall become due, the Clerk of Council, as Ex- officio Treasurer of said Town, shall issue execution thereforc and the further sum of One Dollar ($1.00) for costs, and the Chief of Police and Ex- officio Tax Collector shall pro- ceed with such execution in the same manner as how provided by the law in such cases of execution lodged with the Sheriff of Chatham .County. • SECTION 2. Every person who shall pay one -half (1/2) of his taxes on or before the 15th day of May, 1944, and the balance of said taxes on or before the. 15th day of November, 1944, shall be 1 1 1 43 entitled to a deduction of ten (10) per cent on account thereof, and the Clerk of Council and Ex- officio Treasurer of said Town is hereby authorized to make such deduction upon receipt of tax. The provision of this Section shall not apply to licenses for doing business in said Town, the. rate for such licenses being net. SECTION 3. All ordinances or parts of ordinances conflicting with the promisions of this ordinance are hereby repealed; provided, however, that so much and such parts of ordinances passed as provided for-:the execution of any tax assessments, or part thereof, shall con - tinue and remain in force so as to authorize the Clerk of Council and Ex- officio Treasurer to issue executions and the Chief of Police and Ex- officio Tax Collector to collect same until said taxes or assessments shall be fully paid. AN ORDINANCE AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSES FOR DOING BUSINESS IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR ENDING APRIL 30th, 1945; FIXING PENALTIES FOR THE VIOLA* TION.: AND FOR OTHER PURPOSES. SECTION 1. In the event any business or ()ailing not specifi- cally mentioned in the above list set forth shall be established in the Town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance, which fee is to be of equal dignity as the license 'specifically mentioned in the above Section, provided, however, that such license shall not be more than the sum of Five Hundred Dollars ($500.00). SECTION 3. This Ordinance shall be subject to alterations or repeal in whole or in part at any time during the fiscal year be- ginning May lst, 1944, should it be deemed advisable, and no such amendment or repeal shall te•consirued::to impair the right of Coun- cil to assess or levy tax for the whole of such year whenever made. A iw 47 SECTION 4. Any person, firm or corporation violating say of the provisions of Section one (1) of this Ordinance shall, upon con- viction before the Mayor's Court of said Town, be subject to be fined in the sum of not more than One Hundrod Dollars ($100.00) or be imprisoned ,not more than thirty (30) days, either or both or any portion of either or both in the discretion of the Court. SECTION 5. ALL Ordinances or parts of ordinances conflicting with the provisions of this Ordinance are hereby repealed, Councilman Hosti moved that the following ordinance be adopt- ed, Councilman Walsh seconded and motion passe. AN ORDINANCE *AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TY}3EE ISLAND, GEORGIA FOR THE OPERATION AND MAINTENANCE OF A SANITARY SEWER'GE SYSTEM AND. THE PREVENTION OF BEACH EROSION FOR THE FISCAL YEAR COMMEN* CING MAY .1, 1944; AND FOR OTHER PURPOSES. • SECTION 1. Be,.it ordained by the Mayor and Councilmen of the Town of Savannah Beach, Tybee Island, Georgia, in Council assemb- led, and it is hereby ordained by authority of the sae, that there be levied and imposed a special tax of one -half (1/2) of one (11 per cent upon the assessed or returned valu of all real and per- sonal property within the limits of said Town of Savannah Beach, Tybee Island, Georgia, as of January 1, 1943. SECTION 2. Be it further ordained by the authority afore- said that said special tax shall be due and payable on May 1, 1944, for the fiscal year ending April 30, 1945, and that if any person or persons shall refuse or neglect to pay the same within thirty (30) days after the sue shall become due, then the Clerk of Council, as Ex- officio Treasurer of said Town, shall issue execution therefor and the further sum of one Dol- lar ($1.00) for cost, and the Chief of Police and Ex- officio Tax Collector shall proceed with such execution in the s:me manner as now provided,by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION 3. Be it further ordained by the authority a-"ore- said that the proceeds of said special tex shall be used for the operation and maintenance of the sanitary sewerage system of said town, and that any surplus shell be used for the prevention .of beach erosion. SECTION 4. Be it further ordained by the Authority afore- said that all ordinances and parts of ordinances in conflict herewith be, and the same are hereby,. repealed. Councilman Young moved that the following Ordinance be adop- ted, Councilman Walsh seconded, the motion passed. AN ORDINANCE AN ORDINANCE TO PROVIDE FOR THE TAC:ATION OF REAL AND PER- 48 SONAL PROPERTY IN THE TOWN OF SAVANNAH BEACH, TYiEE ISLAND, GEORGIA FOR THE PURPOSE OF MAINTAINING THE SEAWALL ANDfOR ALONG THE STRAND AND /OR RIVERS FOR THE FISCAL YEAR COMMENCING MAYI, 1944; AND FOR OTHER PURPOSES. SECTION 1. Be it ordained by the Mayor and Councilmen of the Town of Savannah Beach:;. Tybee Island, Georgia in Council assembled and it is hereby ordained by authority of the same, that there be levied and imposed a special tax of 81.50 per $1000.00 upon the assessed or returned value of all real and personal. property with- in the limits of said Town of Savannah Beach, Tybee Island, Geo- rigia. SECTION 2. Be it further ordained by the authority afore- said that said wpecial tax shall be due and payable on May 1, 1944, for the fiscal year ending April 30, 1945, and that if any person or persons shall refuse or neglect to pay the see within thirty (30) days after the. same shall/ come due, then the -Clerk of Council, as Ex- officio Treasurer of said Town, shall issue execution therefor and the further sum of one Dollar ($1.00) forcosts, and the Chief of Zolice and Ex- officio Tax Collector shall proceed with such execution in the same manner as now pro- vided by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION 3. Be it further ordained by the authority afore- said that the proceeds of said special tax shall be used for the purpose of maintaining the sea, wall and /or groins along the Strand and /or rivers. SECTION I. Be it further ordained by the authority afore- said that all ordinances and parts of ordinances in conflict herewith be, and the same are hereby, repealed. Councilman Young moved that the Chairman of Finance Committ -, ee be authorized to buy a meter for use at Fort Screven to rec- ord the sewer going into the treatment plant. Councilman Walsh seconded, motion passed. Councilman Young moved that the connection charge-of $1.00 charged the Plumbing Contractors for the furnishing of the location of the stub to the property line be paid to G. R. Vin- son as his fee for furnishing the location. Councilman walsh seconded and the motion passed.. Councilman Walsh moved that the bills for the general govern- ment for purchases made during the month of March amounting to be paH, and bills of Tybee water works for $142.10 he paid. Councilman Farrell seconded, motion passed. Councilman Hosti moved that the bills submitted by J. G. Atta- way1Company for stubbing amounting to ;?1309.68, be paid. Council- man Young seconded, the motion passed. Councilman Young moved that for the purpose of arriving at the proper fee for stubbing to the DeSoto Reach Hotel that they be charged on the basis of fixtures. Councilmen Walsh seconded, motion passed. There being some difference of opinion between Fort Screven and the Town as to the proper charge fOr the Water furnished to the Diving School, the matter was referred to the committee composed of Councilman Young, G. R. Vinson, and Henry M. Buckley, to handle the matter. It being called to the attention of Council that raw sew- erage was being dumped into Tybee Inlet from the diving school, the Clerk was instructed to write Colonel Carmody, CO, at Fort Screven that steps be taken to eliminate this bad condition at once. It was decided that the Parking Areas would be open for collection of toll on April 16, 1944.
