AWARDING BID FOR THE WATERFRONT TERRY TERMINAL
ACCESS ROAD IMPROVEMENTS
WHEREAS, the Borough has publicly advertised for the receipt of bids for the Waterfront Ferry Terminal
Access Road Improvements, NJDOT Grant and Project #2021-MA-00359; and
WHEREAS, the Borough has solicited and received four (4) bid proposals for the Waterfront Ferry
Terminal Access Road Improvements, NJDOT Grant and Project #2021-MA-00359 as follows:

1. S. Brothers, Inc. $1,663,721.90
2. Lucas Brothers, Inc. $1,751,750.96
3. Black Rock Enterprise, LLC $1,849,666.67
4. Berle Construction, Inc. $2,064,153.20
WHEREAS, S. Brothers, Inc., of South River, NJ has submitted the lowest bid for said contract as
evidenced by the response on file with the Borough's Purchasing Department and with the Borough
Engineer; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award
of a contract to S. Brothers, Inc., in a total amount not to exceed $1,663,721.90 for Base Bid and Items 1
through 70 and Addition Items A-40 inclusive, per attached award letter; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose.

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as
follows:
1. That the appropriate Borough Officials are hereby authorized to enter into a contract
with S. Brothers, tile., of South River, NJ for the Project for the sum of
$1,663,721.90 in accordance in all respects with the request for proposals and bid on
same.
2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department, the Borough's Consulting Engineers CME Associates and the
Borough's Director of Engineering.
3. That the aforementioned award of bid is contingent upon formal approval from the
New Jersey Department of Labor, Division of Wage and Hour Compliance.
4. That the aforementioned award of bid is contingent upon Borough Attorney and
NJDOT Local Aid, District III authorization.

Enclosed herewith please find a summary of bids received on November 10, 2022, for the above
referenced project. A total of four (4) bids were submitted, ranging from an apparent low base bid of
$1,159,163.65 by S. Brothers, Inc. to a high base bid of $1.382.422.45 by Berto Construction, Inc.
The Engineer's Estimate for the base bid and addition item were $1,323,587.20 and $501,00.00,
respectively, for a combined estimate of $1,824,687.20. Please find enclosed a complete Summary
of Bids for the Council's review..

Upon review, S. Brothers, Inc. is the lowest responsible bidder. While there were irregularities
present in other bids submitted, we found that they were minor in nature and the outcome of the bid
was not affected.
As a matter of procedure, our office has contacted S. Brothers, Inc. to discuss their bid. The
representatives we spoke to indicated they are comfortable with the bid as submitted and there is no
objection to completing the project based on the bid prices submitted and the contract time.
Based on this information, we recommend the following actions:
1. Award of the contract to the low bidder, S. Brothers, Inc., P.O. Box 317, South River, NJ 08882
within 60 calendar days, on a unit price basis in the total amount of $1,663,121.90 for Base Bid

Items 1 through 70, and Addition Items A-1 through A-40 inclusive, as available funding permits.
The award should be subject to review and approval by the Borough Attorney and NJDOT Local
Aid, District III including concurrence to waive any minor irregularities, the review of the bid bond
and surety from.the low bidder, and submission of the required bonds, and. insurance certificates
for the project.
2. Bid and bid security of the second and third low bidder be retained and held open, pending
execution of the contract agreement by S. Brothers, Inc.
3. Return of bid securities to remaining bidders.
By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of
Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded
to my office for further execution.
