00n the Annexation of Riveria Heights, Mr. Jap Trimble appeared and
;offered to withdraw all lots except those in the area where the
'homes are located, and the main road, so these people can be annexed '
'to Jefferson City.
'The Mayor stated the matter would be considered under Unfinished
tusiness, but informed Mr. Trimble that the petition could not be f�
Riveria altered after it had been processed. There would have to be a new !
Heights 'petition filed after this one is disposed of.
Annexation IlDwight Fine spoke for the home owners and stated they would
;appreciate the Council ' s favorable consideration on the petition to
Jannex their homes to Jefferson City, since it is adjacent.

Payment #8 the amount of $138,883. 50. Motion made by Councilman Whitecotton,

Public Works,�t'The Jefferson City Transit Authority would like to start a new bus
and gute. It would start from Memorial Park and go to the Capitol

"The Committee of the Whole met May l4th, following the Special it

After a discussion on Central Maintenance and Transit operations of (;
the City, Councilman Brant offered a motion to terminate the !jCommittee-
Transit Authority and place the Transit operations and the Central :of-the-
Garage operations under the Public Works Department . Mr. Graham

,,Air. Bates recommended accepting the low bid of J.C. Industries of
!,$273,436. 00 on the Stadium Blvd. West Project. This is contingent
on the City receiving a share of the construction cost from Clarkson`;
Finance & ;:Construction Co. of $37,291 . 50 and the Gregory-Jordan property of
Personnel !$38, 169.60. This would reduce the City supplemental appropriation
Committee !to $197, 975. 00.
Report ++lMr. Bates, also, recommended that the City purchase the "Barry Lauf"

The following Minutes of the Board of Adjustment were presented to
the Council : '
"The regular monthly meeting of the Board of Adjustment was held in ��
Lithe Council Chambers of the City Mall building, 240 East High Street
Ion Thursday, May 10, 1979, at 8: 15 a.m. The following members were ;:
present : Chairman Rick Morris, presiding; Members Harold Busch, Time";
Frevert , and Gideon Houser. Mr. Gordon Persinger was unable to
attend this meeting. Also present were Thomas H. Benton, Director
of Planning, Kevin Roods, Planner and Carletta Wilbers, secretary.
,Mr. Morris informed the gallery that one of the members was absent , '
11therefore all four members present must vote in the affirmative for !'
i�' any request to be approved. Therefore, if anyone wished to table �
their request until the next meeting when a possible full Board '!
11would be present , they may do so. '

IMr. Ronald Prenger, asked that his request for a variance in the 11
( density requirements be tabled until the June Board of Adjustment
meeting.
! The following items of business were then transacted:
1. The request of Mrs. Stella I . Elliott , 1220 Cottage Lane, for a
conditional use permit to operate a Day Care Center to care for ten ;Board of
( 10) children from her home was then considered. IkAdJustment
Mrs. Elliott was sworn in and stated the majority of the jMinutes
children would be cared for during the hours of 7: 30 a.m. to
5: 30 p.m. , with an infrequent child staying until 10: 30 p.m. She
also stated the back yard of the property is fenced and tine basementi
area of the home has been converted into a play and nap area for the,'
children.

Mr. Morris then noted four (4) letters had been received in
opposition to this request. The following persons wore sworn in it
and spoke in opposition to the request : Mrs. Edith hackie, 1217
Cottage Lune, Mrs. Marie McGinty, 1219 Cottage Lane, Mrs. Ruth
Shoults , 615 Houchin Street , Mrs. Ethel Snellen , 1211 Cottage Lane
and Mrs. Sara Shoults, 1222 Cottage Lane. All of the above, were
' apposed due to the number of children living in the neighborhood.

comment was the problem some of the neighbors have been havinE; with
their sewers. As it is an old rower and a Small line, they felt

12. The request of Mr. Ken Perry, for it conditional use permit to

operate a Private Club for an archery range on property located
east of Tanner Bridge Road and west of Bough Park Golf course, along!
the southside of Ellis Boulevard, was then considered. p
Mr. Pere was sworn in and �
Perry gave testimony regarding the request;;
Mr. Perry stated the course would be set up in the safest manner il
possible and would be used by members of the club with youth groupsiBoard of

answered, Mr. Morris asked for persons who wished to present

Priddy also spoke in opposition and voiced his opinion regarding the I i

Aesthetic damage to the terrain if trees were painted with bright
;range to warn persons of the archery range. Mr. Gary Tichelkamp
(voiced his opposition and stated he concurred with Mr. Priddy
egarding the request.
1 r. Leo Redel, an officer of the Archery Club, was sworn in and
'1"stated members usually practice in groups and therefore one of them lj
would notice if a child did wander on the range.
Board of fter considerable discussion regarding the request , the Chair asked
Adjustment ifor a motion on the request. Mr. Morris moved the request be denied
Minutes !,*-r. Houser seconded this motion and all. members voted unanimously to
,deny the request.
The last item of business to be discussed was the request of
illiam L. Wyss, for a conditional use permit to allow an apartment
labove his office at 209 West Miller Street.
,Mr. Wyss was sworn in and stated he wished to place an apartment
above his office to obtain the maximum use of this building. He
further stated it would be a one bedroom apartment and he has seven
(7) existing parking spaces behind the building with ample room for
Iten or more.
After discussion, the Chair asked for a motion. Mr. Houser moved
?,this request be approved subject to the easement on the common
driveway being maintained. This motion was seconded by Mr. Frevert
ith all members voting unanimously.

i IThe Minutes of the April. 19, 1979, Planning and Zbning Commission
)meeting were approved as submitted on a motion by Dick Caplinger
!with a second by Charles Jackson.

Whe following items of business were transacted:

h. The first item of business was a request from Mr. and Mrs.
Harold Tindle, to construct a Day Care Center facility on property
located at 2002 East McCarty Street , which is presently zoned C-4
(planned commercial) .
Attorney Mike Riley represented the applicants and stated that the
property is already zoned commercial and the Commission should
confine the hearing to review of the site plan in terms of parking, i
ingress and egress and similar characteristics. Mr. and Mrs. Tindle{
submitted a petition signed by thirty (30) people expressing a need
for such a facility. They also stated the proposed building was to
be a 321 X 701 metal building, 12 to 14 feet in height. The
'expanded facility would allow them to care for fifty (50) more
1children in addition to the thirty (30) they presently care for.

Mrs. henry Rackers, 1928 East McCarty Street submitted a petition !j
with eight ( 8) signatures opposing the request . They opposed the
!request due to noise and additional traffic. Councilman Robinson
also spoke in opposition.
�lAfter considerable discussion, the Chair requested a motion.
Mr. Caplinger moved that the request and site plan be approved.
'IThis motion was seconded by Mr. Evans. The following vote was
recorded:

2. The next item of business was a request from Tom Rose and Ed .Planning and
Rackers to rezone a five (5) acre tract of land from RA (multiple Zoning
;dwelling) to C-1 (neighborhood commercial.) . This property is Commission
situated adjacent to and south of McClung Park with 330 feet; of Minutes
,frontage on the east side of Chestnut Street.
Mr. Rose and Mr. Rackers ;stated that they would sell. the property to,
Mr. Cyril Baumhoer.
I' Mr. Baumhoer stated that he intended to construct a 1.00' X 120 '
metal building near the front of the property to be used for the
storage of automobiles. Some vehicles would also be parked behind
the building.

Mr. A. E. Pullam, Dean of Administrative Affairs for Lincoln
University spoke in opposition to this request. Ile stated that
Lincoln University will soon construct an $800,000 animal research
center across Chestnut Street and Lincoln did not feel that the i
proposed metal building would improve the area.

Councilman Borgmeyer stated that since the Sponsor of the Bill was
not present there could be no action -taken. Councilman Rackers
stated he would sponsor Amended Bill 20 and it could be then
brought back to the next Council meeting, in proper form. It could
be corrected, mailed out , and brought back for third reading at the !'
Inext meeting. This seemed to meet approval.

Annexation ' r. Benton stated there was a second set of petitions presented to i
the City Clerk requesting Annexation to the City. They have been 4
thoroughly examined and placed on a map and in his opinion in no way'
are they contiguous and meet requirements of the State Statutes. He
�gas asked an opinion from the City Attorney. There are scattered

thru - in his opinion they are not eligible to be considered for
annexation.

�ito Councilman Whitecotton, from the County Court , regarding the
proposal of the County to bill and collect City 'I'mces:
!i"As a result of our meeting on May 16, 1979 as requested by your F!
11committee, the Council of Cole proposes to bill and collect the
!taxes for the City of Jefferson for s,he amount of 1i`k of taxes
�1collected. The dollar figure based on the projected tax billing and,
,,collection for Jefferson City in 1979 would be approximately

$22, 500. This was unanimously approved in court session by the
County Court on May 16, 1979.
The above proposal would be predicated on the following:

"We have prepared two checks for delivery to you as payment-in-lieu ,
of taxes for Projects M. 9-1 ($6, 422. 95) and Mo. 9-3 elderly if now
($1,917. 10) . As you know, the City would, upon receipt , be required?j
to distribute these funds and as a result would retain about 26%. ?
The Housing Authority intends to build a tunnel from Dulle Tower to
the new highrise and its cost estimated at $25, 000 should be
charged to Dulle Tower. The tunnel will provide Dulle Tower
residents access to the Senior Center and diningroom. The budget i6l
not, however, adequate to cover the cost.
The Cooperation Agreement states that while the City will not forego
payment-in-lieu of taxes it will, if necessary, waive collection.
Such delayed payments would then remain as an account payable to be '?
settled at some future date conceivable when bonds are retired.
We respectfully request that you consider this proposal to delay
payment with the City Council specifying that the money is to be
used for the tunnel. Unless the Council specifies use, the funds
must go to the Operating Reserve account. "

against the City on this particular question, they should write : Programs
such information in a letter and attach figures or data regarding
the same. Mayor also stated to the Council that he had met once
with Judge Schleer and would talk to him again about these pending
matters. He asked the indulgence of the Council until they could
meet once or twice and bring back the information to the Council . S'
Councilman Kliegel suggested we have Ted Herron of the Housing i
Authority meet with the City about those matters, if necessary,
Mayor Hartsfield inquired of Judge Schleer how they would like to
pay Civil Defense portion in the future. Judge Schleer stated it !
i could be paid once a year, at the begininng of the Budget year.
In discussing Revenue Sharing Fundo, Mayor 1artsfield rotated that
when the Grant money , in payment of buseH wan received, it was put 0
into General. Revenue, uo they balanco of some ninety-nine thousand
