Public i'Members present included Councilmen Brant , Kliegel , Whitecotton , and Safety &,,Hoquembourg, Councilman Gordon was absent. j Health Committee The first order of business was a hearing of the transfer of a Taxi !':franchise from Mrs. Rosie Henderson (Veterans Cab) to Mr. Virgil Minutes !Wells, Mrs. Wells and Mrs. Henderson were in attendance to answer 5questions. After discussion a motion was made by Brant to postpone ;action until the next Committee meeting to research Mr. Wells' j;previous record in Taxi business. Motion was seconded and passed. ;.Six new applicants for taxi permits were approved and numerous ,:renewals were approved with Mr. Whitecotton voting "no" on two new applicants. 1A request was made for permission for Melvin Godsey from Health to !'attend the Solid Waste Management Seminar in Columbia. Request was ;t !denied for lack of a motion. Hequembourg is to confer with Chester :,McKinney about reasons for trip. I'The new animal control ordinance with a fee schedule will be ii.reviewed at the next Public Safety Committee meeting and will be !'forwarded to the Council at the August 6, 1979 meeting. Motion was made Wh:itecatton {' ;I to advertise for bids for demolition of building. Motion passed. ; Chief Patton requested permission to advertise for bids for security ; gates on parking lot. Request was denied until further study could l! be made in regards to new land acquisition. ,I ! Chief Patton requested permission to purchase four new Radar guns. Public j Discussion centered on fact that guns were at a special price. `,Safety & 1, Whitecotton moved to purchase guns, motion passed. Health flA request was made for one officer from the Police department to Committee ( attend a firearms school at an approximate cost of $1,000. 00. ::Minutes la After discussion request was denied for lack of a motion. ! Procedures for interviews for fire chief position were discussed !land interviews will begin in approximately two to three weeks. '! Discussion of rescue trucks to replace old truck was held. After all questions had ! been answerod to the Commission ' s satisfaction, Mr. Caplinger moved that the plat be approved subject; to the removal of the note regarding; location of driveway approaches. This motion was seconded by Mrs. Munzell and was approved unanimously. 2. The next item of business was the request from Arthur W. and ;l Venita E. Betts to rezone property located at 608 Ellis Boule- vard, from RS-2 (single family) , to RA (multiple dwelling) . ! Mike Riley presented the request on behalf of the owners. Ile stated that the Betts' intended to sell the residence to an architect who wanted to use it for an office. Mrs. Ed Pope, ;'Planning & {` 1911 Tanner Bridge Road, and Mrs. Earl Heinrich, 704 Ellis ;,Zoning Boulevard, spoke in opposition to the request . .Commission Mr. Caplinger moved that the request be denied as it would !;Minutes constitute spot zoning. The motion was seconded by Mrs. Munzell and approved unanimously. The request was therefore denied. Mr. Caplinger then made a motion instructing the Planning De- r. partment to prepare a recommendation for an amendment to Ordinance #8508, which would allow professional services to be ! included as a conditional use in a RS district. The motion was!; seconded b Mr. Dudenhoeffer and i Y passed unanimously. The ; recommendation will be considered at the August meeting. 113 j !j 1� it i� i. The third item of business was a request from David and Ruth VanLoo and Dennis and Karen VanLoo to .rezone Lot #28 of Sun Valley Drive Addition, which in 1922 Sun Meadow Drive, from RS-2; il (single family) to C-1 (neighborhood commercial) . All VanLoo' were present and David VanLoo made the presentation stating that, they now were the owners of the property and intended to operate! a drapery shop from the residence and would provide four (4) off-street parking spaces. Otto Barker of 1926 Sun Meadow Drive spoke in opposition to the !I ii request and presented a petition signed by six (6) property J! owners who were opposed to it. Mr. Dudenhoeffer moved that the request be denied as it would constitute spot zoning. Mr. Evans seconded the motion and it was approved unanimously. The request was therefore denied. Planning & A. The next item of business was the request from Landwehr Enter- Zoning prises, Inc. , to rezone fourteen ( 14) lots in Landwehr Hills I! Commission Subdivision, from RS-2 (single family) to RD (duplex) , and an Minutes adjoining tract from RS-2 (single family) to C-4 (planned commercial) . This land lies along both sides of the proposed extension of Eastland Drive. Frank Landwehr was present and i if Louis Vetter presented the proposal. Numerous questions were 9 J, asked concerning the dimensions of the zoning district , creek location and re-location and topography. Robert Philbert , 333 Eastland Drive and Sid Dulle, 403 Eastland Drive spoke in i opposition to the request primarily because of Increased traf f icij !t Mr. Caplinger moved that both requests be denied. The motion i was seconded by Mrs. Munzell and passed unanimously. The 1!f request was therefore denied. 5. The last Item of business was consideration of an amendment to Zoning Ordinance #8508, by adding new sub-sections to Section 4(A) (2) in order to provide additional conditional uses in a RC (conservation) district. Warehouse accessory to a barge docking facility for storage ,, of barge shipments on a site of at least forty (40) acres provided that: 1) Building coverage will not be greater than 2. 5% of the total site. 2) All storage of materials and handling equipment will be enclosed within the warehouse. 116 Regular .,Council Meeting , July 16, 1979. 3) In order to protect the view 'of the Missou'ri fdv6ill and the flood plain, an irreplacable natural resource of the City, the Board of Adjustment in addition to the general authority provided in Section 9 (A) (4) (d) , shall not approve a conditional use permit for an accessory warehouse in the RC (conservation) district unless it finds that : ;Planning & a) The building and facilities will be sited so ;Zoning so as to cause minimum visual impact from the .Commission State Capitol and the City. 'Minutes b) The building and parking areas will be screened, with shrubs and trees. c) All building access points and all parking areas will be screened from the Capitol and the City by the building Itself or appropriate , landscaping. d) No signs shall be permitted except informationai signs with an aggregate total area of 1. 5 square feet at any one location. e) Outside lighting shall be limited to the minimum amount required for safety and security and shall be directed downward and not across the river. f) Building materials and colors used on the build»• Ing will blend in with landscape and minimize visual impact of the structure. g) Building height shall not exceed 28 feet above , the average grade of the surrounding terrain. Kay Kennedy, reporter for the News-Tribune, covered the meeting. it The meeting was called to order by the Chairman, Mrs. DeLong, who 0 introduced members of the Commission and guests. IMINUTES of the previous meeting were approved as mailed. 11REPORTS - SUB-COMMITTEES 1) Tell Neff reported on the draft which he had prepared to repeall'I Section 5. 7 of the "Public Offense Code" and provide certain additions and alterations. (Exhibit 1) Commission members discussed various items within the proposed draft, which included among other things specific fines for violators who litter from automobiles and extension of areas presently covered to include public alleys, public rest areas, downtown islands and grass medianfi strips. 1i Action on the proposed draft was deferred until the next i� meeting. U-7 Regular Council Meeting , July 16, 1979. ,2) Flood Plan - Tell Neff presented the architectural rendering of ;the plan of"Vairmer' s Concrete Company to construct. a warehouse on s. li-i-acre plot on the riverfront owned by the Farmers. There was i;;discussion of the effect this commercial structure would have on the:i: view from the Missouri State Capitol and from Overlook Park. There Environmental was reference by several members to the Harland Bartholomew compre- Quality ',hensive plan for Jefferson City and the overall beautification plan ,;' Commission ';both of which call for maintaining the basic rural nature of this Minutes ;area�,area along the Missouri River and for maintenance of the view from 'the Capitol to the bluffs. ii lilt was noted by the Chairman that the Jefferson City Planning and "Zoning Commission had very recently voted to change the zoning of !this particular area from Rural to General Commercial (not heavy ;1 ;industrial as the Farmers had requested) . The only dissenting vote {was cast by Mrs. Obie Munzell. ,,The Chairman of the Environmental Quality Commission had on June 14 ,'� I' t'1979, filed a statement with the Jefferson City Planning and Zoning ''Commission recommending that the re-zoning of this property from `Rural to Heavy Industry be rejected with several reasons set forth. ';(Exhibit 2) Also, George Dickie, of Skidmore, Owings & merrill , had' ,';on June 14, 1979, dictated a telephone message to Tom Benton in ,which he said, "This is a critical. issue, and the decision will set ,,;,a precedent for future development. . . . .My colleagues and I at S. 0. M. strongly urge the retention of this area as a rural zone. . . ,, 1,1t will , in its original form, provide greater benefits for all ,;residents of Jefferson City. Virginia Pell, executive coordinator of the Clean City Commission of Kansas City, Missouri, spoke to the group on her work �n Kansas City, particularly with regard to the litter problem. Shel i ave a capsule presentation of KAB (Keep America Beautiful) , to ;Mch Kansas City has subscribed. "If you change people' s attitudes &ou change people' s behavior"--this is the basic concept of KAB, which Mrs Pell highly recommended for Jefferson City. "We don' t eal with litter -- we deal with the act of littering (behavior)" , Ishe added. The first item of business was the request of Ronald J. Prenger, '`.for a variance in the density requirements to allow construction of sixteen ( 16) apartment units on property located in Block 2 , Lots ' 131 14, 15 and 16, of Crandall ' s Subdivision , which lies on the 3 north side of the 1100 block of West High Street. i:Mr. Ronald Prenger was sworn in and presented a site plan to the !Board for review indicating the location of the proposed building Wand parking areas. He stated the building would be brick and all !!parking areas would be paved according to City specifications. ii JNr. Benton stated that the applicant did not request a variance for :! Considerable discussion followed regarding the number of employees , }! parking spaces required , and use of the alleys for Mr. Steinmetz business. liMr. Buford Hil.gert, 713 Ohio Street , was sworn in and stated he had , ' no objection to the construction of the building. However , his objection was the customer vehicles which block the alley and � create a hazard and nuisance for the other property owners in this J area.
