He read the following letter from Mr. Long,;, ` Manager of the Transit Authority: !i i� "I would like to recommend Floyd Nichols, Jr. to be advanced from Driver to supervisor Driver. This position would call for driving, '! typing and supervising drivers. As 1 have no Asst . Manager, this position is very much needed. His annual Salary is now $9, 071. 00. On February .1.4 , we noticed we worn havint, problems with tho drainage in our homo. On Fobruary 15, wc callod Louis Kramp & ? Sans, who are plumbers to chock out our line. Upon their arrival i. they called the Public Works Department to have the line flushed. The Public Works Dept. flushod the main sewer line from Union Streo� to west of Oak Street , which flooded our basement with 2-3 inches of water. In the ineantime the plumbers kept workinFr, running our entire line to the main line, which was not stopped up, & they could not relieve the pressure. The second time we called they said there was nothing they could do. The third and final time the ! Public Works Dept . flushed east of Oak Street, back up Union Streetj� which relieved all the pressure. I am therefor having the plumbers( send their bill to the Clty since my line was not stopped up. Whenff the water came into the basement , it ruined carpeting in our ), basement, & I believe the City should replace this carpeting. I 1' am enclosing a copy of the bill for replacing that carpeting. This could have all been avoided if the Public Works Dept . had done their`! Job properly. Committee installed in time for the publishing of the new Telephone Directory11 Report but at this time this does not seem advisable. ----------------------- ,a The following report of the Parking and Traffic Commission was presented to the Council : I The Parking and Traffic Commission meeting was held Thursday, February 8, 1979 , 7:30 a.m. at the Police Station with the following members present: ;1 i t; 514. Duncan , Councilmen Hag;er, hitecotton and Rackers, Street Commissioner Bates, and Parking ::Authority Supervisor Hartley. Member Jim Whaley was absent and j `Members Rael Amos and Mike Bates were absent with leave. t {;Also present were several representatives from the Dix Road area and; Nrs. Dennis Smith. The Commission made the following recommendations : ' til) Approved the elimination of a loading zone at the City Parking Garage. ,2) Removal of parking on both sides of Ellis Boulevard from Hough l !Park Road to Greenberry Road. 113) Removal of parking on the west side of the 700 block of Walsh Parking an 6treet. Traffic 1'4) Removal of parking on the west side of the 100 block of Clay s Commissioni8treet from West Main Street to the first driveway north. Report 15) Approved One-Hour parking at 1120 East McCarty extending for 1100 feet from a driveway at Clark Avenue on a 90 day trial basis. {`6) Approved the removal of parking on one side of Mesa Avenue with ;the determination of which side to be left with the Director of ublic Works. i 7) Denied the request to prohibit parking in the 200 block of Dix f 1 Road. The regular monthly meeting; of the hoard of Adjustment was hold in � tho Council. Chambers of the City Hall building , 240 East High Street , on Tuesday , (February 13, 1979, at 8: 1.5 a.m. The following mombers � were present : Chairman Rick Morris, presiding; Members (Harold Buscl ;Gideon Houser and Gordon Persinger. Mr. Tim Frevert was unable to ij attend this meeting. Also present were Thomas 11. Benton , Director il jof Planning, Kevin Roods, Planner and Carletta Wflbers, Secretary. �1 The first item of business was approval. of the Minutes of the ( January 9, 1979, Board meeting. As there were no corrections the Board of Minutes were approved. AdMinutest; The following items of business were then considered: :11. The request of Richard McCullough which had been held over from 11 the January meeting was then considered. Mr. McCullough had no 1 further testimony to present. Mr. Benton gave a brief summary regarding this request . At this time Mr. Houser informed the Board he wished to withdra jj his motion made at the January meeting in which he moved to allow a fifteen foot variance which would permit construction tc } within five (51 ) feet of the rear property line. Mr. Persinger ''� in turn withdrew his second to this motion. All members voted unanimously. The request was then discussed with several questions being l asked regarding the present footing; and the retaining wall. ,{ Mr. McCullough stated the footing was approximately ten to fifteen years old and was located gust inside the retaining wal . Mr. Houser then stated he inspected the location of the propose addition and in his opinion the property in question did not p resent exceptional or unusual physical conditions and therefor a variance would not be relevant . In his opinion , a variance I' could be granted only under these conditions and not just for l the convenience of the property owner. 515. Regular Council Meeting, February 19, 1979. After lengthy discussion Air. Persinger moved fioo approva the request as submitted. This motion was seconded by Mr. Busch. i The following vote ensued: Members voting aye: Busch, blorris and Persinger Members voting nay: Houser I� The motion failed for a lack of four (4) affirmative votes and the request was denied. j2. The next item to be considered was a request from Joe Bledsoef I for a rear yard variance to construct an addition to the existing building at 620 Jefferson Street . After being sworn iri Mr. Bledsoe presented a sketch displaying the overall appearanc6 of the building in the event the proposed addition could be constructed. The Board members questioned Mr. Bledsoe on available parking Board o£ f. Adjustment for the proposed restaurant and also for the apartment units. it Mr. Bledsoe stated he could provide approximately three to four Minutes. !? parking spaces on the south side of this building but owned no ( adjoining property on which lie could provide more parking spaces. Mr. Rouser then moved to deny this request. This motion was seconded by Mr. Busch with all. members voting affirmatively. 3. The request of Linda A. Connell , 418 Union Street , for a. home occupational use permit to care for ten ( 10) children in her home was then considered. After being sworn in Mrs . Connell i gave brief testimony as to her need to obtain permission from the Board prior to obtaining State Licensing to operate a Day Care Center. The Board members had questions regarding fencing of the rear yard. Mrs. Connell stated the yard was presently :fenced with al four (41 ) foot fence. Mr. Rouser stated in his inspection of the property lie noted the lock for the gate was the type easily; opened by small children. Mrs . Kelly Pool., the attorney reprosenti.ng Dr. liatthews was swore in and presented Hite plant, and an aerial photograph in which 11 hr stated the proposed addition would not: extend pant the existing homes along Bolivar Street . Ile stated there is ample � parking spaces provided and the existing parking lot would be expanded to provide thirty (30) parking spaces and would have an asphalt surface meeting the requirements of City Ordinances, Mr. Benton stated he and the Director of Public Works , Michaelri Bates, had inspected this location for problems regarding the it sight distances for motorists. It was their opinion the proposed addition would not obstruct vision. Mr. Randall Waltz, attorney for Mrs. Molly Cowley, 304 Boliver Street , was then sworn in and gave testimony as to why his cliq�t was opposed to the request. Mr. Waltz stated the proposed I addition would extend past Mrs. Cowley' s front porch and tliere�pre would block her view, the sunlight and air flow to her property;. He also stated Mrs. Cowley objected to the use of her drive by !1 patients of Dr. Matthews and also the workmen in the past haver blocked her drive and made it impossible for guests to use. iI After several presentations by Mr. Pool and rebuttals by I Mr. Waltz, Mr. Morris asked for a motion on this request. 1 Mr. Persinger moved to approve the request subject to the i proposed addition being constructed in line with the front i porches of the existing homes on Bolivar Street and 304 Boliva ! Street in particular, and that the parking lot be expanded to allow for thirty (30) vehicles and the parking lot be paved according to City requirements. This motion was seconded by I' Mr. Busch. The Minutes of the December 14 , 1978 Planning and Zoning Commission meeting; were approved as submitted on a motion by Fred Bode with a second by Obio Munzell. Planning and '; The following items of business were transacted: Zoning Commission 1, The first item of business was the request from Norman W. and 11 Report Edith E. Thompson , to rezone Lots 14 , 16, 21. and 22 , of Monroe P1a.cel 'which lies between East Atchison Street and Hickory Street in the i� °400 block, from RS-4 (single family) , to RA (multiple dwelling;) . +� f , Mr. Norman Thompson was present to answer questions from the it Commission. No one appeared in opposition or notified the office of ;Planning of their intention to oppose this request . On a motion made by Mr. Dudenhoeffer and seconded by Hr. host , it wits moved that Lots 13 , 14 , 15, 16, 19 , 20, 21 and 22 , of Monroe Place, be rezoned from RS-4 (Single family) , to RA (multiple dwelling;) , provided that drainagte planes be approved at the time of i.s3s;uanco of any building permits. Thin motion passed unanimously. ! 2. Tho next; item of business was the cons l(leration of the final plat of Del. Cerro Subdivision , Section 1 , submitted by Roger F. Verslues I .and AsgsociateH on behalf' of Thomas Ott. Mr, Ott wits, present and available to answer questions from the C,otmnissJon. Mrs, hfunzoll moved that the final plat: be approved. This wits f� seconded by Mr. Dudonhoeffer. The motion passed unanimously with � Mr. Rost and Mr. Evans abstaining. ''3. The third item of business was consideration of the final plat it of Wild' s Subdivision submitted by Central Missouri Professional Services on behalf of Ken Wi.ldhaber. Mr. Wildhaber and Mr. Vetter � :made the presentation, Mr. Benton requested that Iaot #6 be desig;nat d as "Reserve Tract" . Mr. Bode moved the plat be approved. The ,notion was seconded by Mr. Robinson and carried unanimously. (l. The next item of business was consideration of a preliminary pla ; of Country Club Estates submitted by Central Missouri Professional �9erviees on behalf of Randall Fischer. Mr. Vetter made the presentation. It was suggested by Mr. Bates that perhaps right-of-w y ,should be provided for a connector street extending to property owned by Vernetta Carver. Mr, Robinson moved that action on this :subdivision be postponed to the next Planning and Zoning; Commission jneeting and that the plat be reviewed by Mr. Vetter, Mr. Bates, and ,Mr. Benton. This motion was seconded by Mrs. Munzell . 'After considerable discussion, Mr. Jackson moved that the preliminary plat be conditionally approved subject to review by Mr. Vetter, Mr. Bates and Mr. Benton, with regard to the possibility of providing �xig;ht-of-way for the connector street. The fifth item wasp consideration of a preliminary plat of RidgeView Estates submitted by Central Missouri Professional ServicE on behalf of Bill Peters. Mr. Peters and Mr. Vetter were present to, ,answer questions from the Commission. On a motion made by Mr. Pudenhoeffer and seconded by Mrs. Munzell the preliminary plat was japproved unanimously. 6. The last item of business was discussion relating to zoning of 1:i Mall Ridge Addition. Mr. Vetter was instructed to inform the owners' that they would be required to request and file an application for rezoning of all lots within this subdivision within the city limits! on which they intend to construct multiple dwellings. M. Thursday, February 15, 1979, with Robert Schulte, Vincent Borgmeyer, F. E. Buck Robinson, Charles :' Czarlinsky, James Thomas, Wilben Dill, James Hartley, Hike Bates iJim Jordan, James Strong, Stephen Bradford, and Walter Johnson. 1. On a motion by Thomas, Seconded by Czarlinsky, recommend to ! the !: I City Council that property owned by Ron Kaiser on 100 E. High St . I �1 b e appraised. IThe Parking Authority is considering the purchase of this property for a Walkway from High St. to Lot 1 . Ron Kaiser has offered this 1property to the City for this specific purpose. Jim Mordan said that two appraisals are necessary and the cost would be $350. 00 to $400.00 for each appraisal. 2. State Representative James Strong, Walter Johnson , Director of Design and Construction , and Stephen Bradford, State Cominission .r of Administration, met with the Authority to discums t4tato parking. Bradford and Johnson did not see any reason why the stato should gel involved in leasing of parking. However, James Strong said there would be no problem in getting a yearly lease on certain floors of the structure next to the Joffers4,n Building. He said the state is starting to realize it has a responsibility to provide parking for state employees, Air. Johnson felt that additional surfaced parking provided by the state would not affect the economics of the City Garage. Mr. Johnson said there wasn' t any need for a parking structure in the Millbottom area until the area has developed. Mr. Bradford ask if a lease of parking would be possible from the City in the Ifillbottom area? At present only six spaces are vacant but in June after the General Assembly recesses, a lease of parking ,, could be worked out. 11 Mr. Schulte ask that the Office of Administration recommend to the Mayor a person to represent the State on the Parking Authority. 3. On a motion by Bates, and Seconded by Borgmeyer, recommended to ', the Police Court Judge the following increases in fines: Excessive Overtime from $2. 00 to $3.00 li Loading Zones from $2.00 to $10. 00. Blocking a Lane of Traffic from $2. 00 to $10. 00. It 4. On a motion by Borgmeyer, Seconded by Robinson, rental of 1parking meters to Contractors for trucks would be limited to one space per Contractor. A Sub-Contractor would also be limited to lone space. The rate per day would stay at $1. 00. Construction jl trailers will be charged $3. 00 per space. 518. Regular Council Meeting, February 19, 1979. :'S. A rate increase Jan. 1 , 1979 being the contributi! g factor for the increase. Usage Chart attached. 6. Employ Michael. Varney on a part time basis at $2. 97 per hour. 7. On a motion by Borgmeyer , Seconded by Robinson, Hartley to continue to receive $25. 00 per month car allowance until Nov. 1, t 1979. $225. 00 would be added to the Car Allowance category in the j Parkinf; Lots Budget. fj .I /s/Robert C. Mayor Pro tem Brant read the following letter from Byron Zalken, President of the Cole County Mental Health Service: "The Board of Directors of the Cole County Mental_ Health Services requests your permission to meet with the Council of the Whale as .soon as possible. i It is our intention to discuss with you the operation of the Cole I .County Mental Health Services, its benefits to the community, and .our needs from the city ' s involvement within our program. j! We also wish to invite a member of the Council , or the mayor, to I� become a full time board member of the Services and help participate; in its total operation.
