Ij Public,, Tom Benton, Director of Planning and Code Enforcement, propose Hearing.!itwo amendments to the Plan: , (1) Retain residential (single family) zoning at the junction of i i. Ja cee Drive and Industrial Drive (north side) . j (2� Change zoning on a tract of land located at the intersection f lof Route 179 and West Main - east side of 179 - 300 south of Sue f ; Drive, to Rural Conservation, the next 650' to multiple family, and11� l: remaining 1860 ' as Industrial (M-1) , a similar proposal on the westli , side of 179 with Industrial (M-1) from West Main to the Rural r• ; Conservation area. l� Councilman Borgmeyer moved that the two amendments , as pro- p osed by Mr. Benton, be adopted as part of the Comprehensive Plan. ,,Motion passed . Scott Cantine , Planning Consultant , reviewed the Comprehensive !j , Plan. He stated that the supplement to the Comprehensive Plan is ' in two portions - Updating the Plan and a detailed Plan for the :, i� Country Club Neighborhood Area. There is more development occurrit*; ;, outside of the City than is occurring within its borders . ;! , Recommend that policies be adopted to expand the City. The City is ;f i; growing faster than the road system which must accomodate it . lRecommend that Transportation Committee be reformed. New techniqu 'and regulations , other cities are using for development, have been hincorporated in the supplement- . Also recommend the adoption of , site plan review of proposed construction. j if After considerable discussion, Councilman Hager moved that i ;'written suggestions be submitted and that action of the Council be j held over until the next meeting. Motion passed. -- �! Appointment; - - r - - - - - - Animal , The application of Ralph N. Study for the position of Animal Contr Control ! Officer, was submitted for approval. Officer. Councilman Rackers moved that the appointment be approved. Motion passed. Accounts, (Councilman Borgmeyer,-Chairman of the Accounts , Claims and Claims and��Personnel Committee, presented the following report: Personnel ! Committee). The Committee recommends an additional $50.00 per month E Report. l� increase for Gilbert Ortmeyer, Building Inspector. Councilman 1Hager moved the approval of this request, effective September 1, 11978, seconded by Dr. Brant and passed. !1Councilman Borgmeyer moved the report be approved. Motion passed. - l I iCouncilman Whitecotton, Chairman of the Tax Study Committee, ff ' presented the following report: �! ;The Special Tax Study Committee met at 7:30 P.M. , Thursday, August 1117th, 1978, with all members present. Also present were Tom Benton, !Ed Cole Lon Stone and Roy Farmer. Following a discussion on a Gross Receipts Tax Schedule l „prepared by Mr. Farmer, Mr. Borgmeyer moved the adoption of the tax , schedule as submitted. The motion seconded by Miss McDowell was �I approved. ii 394. Regular. Council Meeting, August.. 21, 1978._. Mr. Hartsfield moved the ado tion of another bracket of less ! jthan $50,000.00 at a tax of $25.09. That motion seconded by Mr. ' Rackers was approved. (See Tax Schedule as approved attached) . jj Mr. Wildhaber moved that all Jefferson City businesses subject to being licensed under Missouri State Statutes be subject to the ! Gross Receipts tax as approved. The motion seconded by Mr. jHartsfield prevailed. ! Mr. Benton informed the Committee of problems relating to } repeat inspections under the Electrical and Plumbing Codes , and the ; necessity of establishing a workable inspection program for the inspection of existing buildings . A discussion resulted in a motion by Mr. Borgmeyer, seconded by Mr. Wildhaber, to establish a three level reinspection fee of $25.00, $50.00 and $75.00. The motion was adopted unanimously. Mr. Rackers moved that Mr. Benton be directed to meet with the ! 11Fire Department , Health Department and the Licensing Office to ?' establish a workable program of inspections of existing buildings. The following report of the Planning and Zoning Commission was presented to the Council : �{ The Jefferson City Planning and Zoning Cotmnission met on August 10, 1, ` 1978, in the Council Chambers of City Hall with the following Planning I members present: Vice-Chairman Dick Caplinger, presiding; Members and Mike Bates , Fred Bode, Charles Dudenhoeffer, Jr. , Seth Evans , Gale !!zoning Hackman, Carolyn McDowell, Obie Munzell, F. E. "Buck" Robinson and ::Commission Fred Rost, Jr. Mr. P. Pierre Dominique and Charles Jackson were ':;Report. unable to attend. Also present at this tweting were Thomas H. Benton, Director of Planning, and Kevin Roads , Planner. i The Minutes of the July 13, 1978, Planning and Zoning Commis- I sion meeting were approved on a motion made by Seth Evans and seconded by Charles Dudenhoeffer. sI E The following items of business were transacted: 1. The first item of business on the Agenda was the request from Elizabeth E. Butzer, to rezone Lots 3, 4 and 12 of Block 1, and it Lots 1 and 2 and the northerly part of Lot 17 of Block # 2, all in Butzer's Subdivision, from RS-4 (single family) to RD (duplex) . Harold Butzer made the presentation on behalf of his mother who was!, in attendance. Mr. Butzer stated that the lots , if zone3as duplex, ;] would increase the saleability of the lots and when developed with I! duplexes would therefore increase the tax base of the City. In his!' r� opinion, due to the rough terrain of. the lots, they were not 'f adaptable for the construction of single family houses. Those speaking in opposition to the request were: Mr. W. G. Northway, 106 South Taylor Street, Charles Schaefer, 101 North Taylor Street, Debbie Frank and Carney Graham 114 South Polk !' Street All testified that in their opinion duplexes built on these tots would compound the parking and traffic problems already ;! apparent in the neighborhood. Twenty-one people were in attendancei who were opposed to the rezoning request. " i 395. Council...Meeting,. Upon motion by Obie Munzell with a second by Fred Rost, the request was denied. The vote was unanimous . 112 . The next item of business was the request of orscheln Brothers (Truck Line to rezone a tract of land approximately 7.2 acres located [between St. Mary's Boulevard and Highway 50 West from RA (multiple Owelling) , to C-2 (general commercial) . Mr. John Ellinger, Attorn 1represented the Orscheln Brothers firm. Mike Burnam, the proposed buyer of the property explained the proposed development. He stated that they intended to have a series of Butler type buildings ,that would be rented out in sections as mini warehouses . No lopposition appeared on this request . i Mr. Dudenhoeffer moved that the request be approved. Seth ;,Evans seconded and the motion passed unanimously, i3. The third item of business was a request from Mr. and Mrs . Planning IElmer L. Evers , Mr. and Mrs . Wilbur Lage and Mr. and Mrs . Walter A. and OWeigand,, to rezone Lots 53, 54, 55 and 56 of W. A. Beck Addition, Zoning ; from RS-3 (single family) to C-2 (general commercial) , Both Mr. Commission livers and Mr. Weigand appeared before the Commission. No oppositior Report. liwas voiced on this matter. Mr. Robinson moved that Lots 53 thru ! and including Lot 58, of the W. A. Beck Addition be rezoned from 1 1RS-3 (single family) to C-2 (general commercial) . The motion was !seconded by Mr. Bode and passed unanimously. i14. The fourth item of business was the request from Rev. Alan B. :IMcGuirk to rezone 1.15 acres of the former LaSalette property which [is located south of the road exiting on Myrtle Street, with 285.63 Ifeet of frontage on Myrtle Street, from RS-2 (singlb family) to RA (multiple dwelling) . Attorney Tom Rost made the presentation for Ithe request. He stated that Ray Roling intends to build a twelve lunit apartment on this property. Mrs . Don Kruse of 1310 Swifts Highway asked questions relative to the proposed development but ' stated that she was not necessarily opposed to the request. Allan Pollock of the Housing Authority commented that the Housing Author- ity was interested in possibly purchasing this property but that . Ray Roling does presently have an option on it. Due to the fact that the notices which were sent out on August 3, were not received by the property owners until August 9, it was moved by Mrs . Munzell that action on this request be post- poned until the September meeting, Miss McDowell seconded and the , motion was approved unanimously, with the exception of Mr. Evans who abstained. 5 The next item of business was the request from the Jefferson City Housing Authority to rezone a five acre tract of land formerly owned by the LaSalette Seminary and fronting on Myrtle Street, from RS-2 (single family) , to RA (multiple dwelling) . Mr. Allan Po,lock, Troject Engineer for the Housing Authority, made the presentation. IHe stated that it was their intent to construct a one hundred and ,ten (110) unit apartment building for the purpose of housing elderly and handicapped. After considerable discussion, it was moved by Mr. Robinson and seconded by Mrs . Munzell that action on this request be postponed until the September meeting so that groper notification can be sent to adjoining property owners . The motion passed unanimously with Seth Evans abstaining. o The sixth item of business was a request from Mr. and Mrs . Herman Weavers , to rezone property located at 1006 Monroe Street, from RS-4 (single family) to RD (duplex) . Mr. Weaver, who was in attendance was represented by his daughter Pauling Markway. She stated that her parents wished to sell the property and move . to an apartment. She felt that the property would sell better if it were zoned as a duplex, since at one time the structure was actually used as a duplex. No one appeared in opposition to this request. On the basis that approval of this request would constitute spot I zoning, Mrs. Munzell moved that the request be denied. Mr. Seth Evans seconded and the motion passed unanimously. 7. The Commission next heard from Frank Railton, owner of property located at Route -179 and West Main Street, and Joe DeLong, Chairman Iof the Jefferson City Chamber of Commerce industrial Committee, who requested that consideration be given by the Commission to rezone approximately 100 acres of land owned by Mr. Railton, and intended , to be developed by the Chamber of Commerce . as an industrial tract. On a motion made by Gale Hackman and seconded by F.E."Buck" Robinso IMr. Benton was instructed to work up a proposal which would be agreeable with the City, Mr. Railton and Mr. DeLong. This proposal is to be presented for consideration at the September Commission Imeeting. 396. August 21., _1978.,_ 8. The next item of business was consideration of the Final plat of Hoffman Subdivision. John Parrish of Harms and Associates made ;!the presentation. On motion by Mr. Dudenhoeffer with a second by jSeth Evans, the final plat was approved unanimously. 9. The ninth item of business was consideration of the Final platl:, ,of Mallridge Addition, Section 1 . Presentation was made by Louis Vetter of Central Missouri Professional Services . On motion by Mr. q IDudenhoeffer, with a second by Seth Evans, the final plat was :Planning !, aproved unanimously. and 1 T he next item of business was consideration of the Linhardt- ,Zoning ,-Kiesling Subdivision, Section 7. Mr. Benton stated that the Commission Department of Planning and the Department of Public Works did have Report. some question about location of roads in the overall general development plan, but that it did not effect the layout of the lotsl:, for Section 7. He further recommended that Section 7 be approved !,as submitted. On motion by Miss McDowell with a second by Fred Rost, the final plat of Section 7 was approved unanimously, Miss McDowell moved that the Commission change their regular monthly meeting to the second Thursday after the first Monday of each month. This motion was seconded by Seth Evans and passed jj unanimously. jl There being no further business before the Commission, the ,meeting was adjourned. Motion passed. - - - - - - - - - - The following report of the Parking and Traffic Commission was presented to the Council: ! The Parking and Traffic Commission met August 10, 1978, 7: 30 A.M. , at the Police Station, with the following members present: Chairman Dill , Councilman Whitecotton, Police Chief Patton, Rael Amos , Director of Public Works Bates , and Street Commissioner Bates." ,Councilman Hager and James Whaley had excused absences . The Commission made the following recommendations : 11) Removal of parking on the north side of East Elm Street from Clark Avenue to Vetters Lane. 2a) Two-hour parking from 7: 00 A.M. to 7:00 P.M. , on the north side of Woodlawn from Monroe to Madison. Il b) Approved the designation of a loading zone along the east curb " of Madison, beginning at a point 80 feet north of the north curb of ;II Woodlawn. c) Removal of parking along the east side of Madison north of the north curb of Woodlawn a distance of 80 feet. The Commission also approved the removal of parking along the east side of Madison fromP a int 100 feet north of the north curb of Woodlawn a distance of ;parking 2790feet. iIand 3) Removal of parking on both sides of Adams Street between the !Traffic Woodlawn intersections . Itmmission 4) The installation of a Stop Sign at Hutton Lane before eport. entering Expressview Drive. 5) Removal of mid-block loading zones in the 100, 200 and 300 blocks of East High Street . 6) Two-hour parking on a 90 day trial basis along the west side of Broadway south of the alley to West High Street . 7) Removal of parking on the north side of Franklin between Jefferson and Madison. 8) Removal of parking along the west curb of Jefferson Street for )!, a distance of 40 feet north of the alle y immediately north of the i! Expressway. 9) Removal of parking a distance of 60 feet along the east curb of Monroe south of Union Street. The Commission also considered the following items : 1) The problem of school bus parking at the corner of Franklin and Lafayette Streets was referred to the Police Department for necessary action. it 2) As a result of the residents on Twin Hills Road requesting 11 speed limit signs , the Commission was informed that 30 MPH signs were posted at each end of the street and that the Police Departmen�l will observe the area to insure enforcement in the future. 3) The request for restricting parking the 200 block of Dix Road was dropped at this time. 397. Regular Council Meeting, August 21, 1978. _.. . _.-. 114. The Commission considered the installation of Slow signs on 11West Main near Belair, and limiting truck traffic on West Main. [After considerable discussion, the Commission felt truck traffic 1would decrease due to the re-opening of the 100 block of Dix Road ;,and that Slow signs on West Main would not be effective in reducing �� Ithe speed of the traffic . �- The Commission did request the Department of Public Works and '!the Police Department make a recommendation as to what might be { "done with an existing tree at the northeast corner of Belair and ;,West Main which now restricts sight distance. i;5) Mr. Bruce Martin and his attorney appeared before the Commissia ;Ito request review of the removal of parking on Edgewood west of :Satinwood . On the recommendation of the Director of Public Works y Parking 'the Commission took no action on the referral and informed Mr. and ;Martin that he could appear at the next Council meeting should he Traffic so desire. Commission: The Commission held the following items over: ;j Report. 1) The report from the City Attorney on legal definition of -;snow tires . 2) Removal of parking on Southwest Boulevard to provide a center I� :; turning lane was again reviewed and after hearing several area 1N ,1residents who appeared in opposition the Commission held the I, ,proposal over until the next meeting with the Police Department to :; present speed checks and accident reports and the Department of ;'Public Works to determine if only portions near intersecting streets °;could be striped for a center turning lane. 3) Consideration of request. for "No Perking" in north-south alley ;off Hough Street between Johnson and Lincoln Streets . it4) Consideration of "Yield" or "Stop" on Stephen before entering ITheresa. 1 Respectfully submitted, /s/ Bill Dill, Chairman. i ±Councilman Hager moved that the report be approved. Mr. Gideon Houser was ii 'tunable to attend this meeting. Also present were Thomas H. Benton, ;; Director of Planning, Kevin Roods , Planner, and Carlotta Wilbers , 1, Secretary. The following items of business were considered: j The Minutes of the Special Meeting of July 28, 1978, and the :Minutes of the regular meeting of July 11, 1978, were discussed. I!Mr. Busch moved to ap p rove the Minutes of both meetings and Mr. P JlPersinger seconded the motion. The motion passed unanimously. Report i' The request of Mr. Ben W. Finley, for a conditional use permit }} of !, to construct a parking lot on property located at 2523 West Main Board ofiStreet , was then considered. The following persons were sworn in: Adjustment 'Mr. Ben W. Finley, 618 Norris Drive; Mr. Mark Viets , representing his parents, Mr. and Mrs . 0. J. Viets , 2517 West Main Street; Mr. 1't Donald Connor, 2509 West Main Street, and Mr. Wilfred..H.eckman, 2513 West Main Street. Mr. Finley then gave brief testimony as to his need for park- g for his employees . He stated he purchased the property in question to provide parking as he is presently renting space across Jaycee Drive and this property lies adjacent to his present 1 ibusiness. A letter was submitted to the Planning Department from Mr. �1Jack Markway, 108 Jaycee Drive, who stated he was an adjoining iproperty owner and was in favor of the parking lot location. Mr. Mark Viets then gave testimony as to the reasons his jparents were opposed to the request. He stated it would be unsight illy, the parking lot would increase traffic on West Main Street, the ` drainage could be a problem and they were opposed to extending the industrial area into a residential area. I Mr. Donald Connor and Mr. Wilfred Heckman then testified they were opposed to the request as adjoining property owners because oft the traffic, possible drainage problems, and because they could note b sure Mr. Finley would maintain the lot in an acceptable manner. 398. August 21,. 1978. __......_ ... __�.._ ..._.M Mr. Morris then asked the Board members if they would have any !; objections to tabling this request until Mr. Finley could submit a i site plan, showing the number of parking spaces to be provided, the '. , manner in which the drainage would be handled and the landscaping of the lot, and any buffer area between Mr. Viets property and the property in question. The Board members had no objections and therefore the matter was tabled until such time as Mr. Finley has the site plan prepared and ready to submit for review.
