A quorum was declared present. il The Minutes of the Regular Council Meeting of April 2nd were approved • l;as received. On the Minutes of the Special Meeting, held April 5, X1979, Councilman Robinson requested that all discussions, motions Minutes and votes taken on matters not listed in the Mayor' s Call shall be : Approval and jdeleted. Motion seconded by Councilman Wildhaber and carried. The Correction matter will be deleted. Councilman Brant inquired if the matter deleted could be brought' 'up at tonight ' s meeting, and the Mayor stated it could be. 1 Councilman Hackers made corrections in the "Progress Report of City Audit" : On Page 34 , third line from the bottom of the page, change the year "1979" to "1969" . On page 35 , the first and second paragraphs ;were changed to read: "In July, 1973, the Council passed a IResolution, agreeing to transfer to Sewer Construction Fund the 'amount of $325, 000. 00, the City ' s share of the new secondary treatment plant . It was to be paid $162, 500. 00 from the 1973-74 budget and $162 , 500. 00 from the 1974-75 budget. The first payment • was made but not the second. We need a determination as to whether :! you desire to transfer the second $162 , 500. 00 or if you wish to amend your Resolution in some manner. I After discussion , Councilman Hackers made the motion that we I reaffirm our commitment in the Resolution , for the present , and payment be made either during this fiscal year or next , for the amount of $162, 500. 00, from General Revenue to Sewer Construction. " A Public Hearing was held on the rezoning request from Roy G. and Judith Horridge, to rezone property in Mall Ridge Addition , from Public t-4 (planned commercial ) , to RD (duplex) and RA (multiple dwelling) .Hearing This property is located on the west side of North Ton Mile Drive near the intersection of U.S. Highway 50 and North Ton Mile Drive, �{{ Mr. Louis Vetter appeared on the matter - there was no opposi t i on. A petition to rezone land at 1922 Sun Meadow Drive, owned by David, Planning & Ruth H. , Dennis R. and Karen A. It was referred to the Department of Public Works, as Callaway was the first petition. The matters of voluntary annexation to the County City of Jefferson, under the short form Statute, will be set for Annexation public hearing at the first meeting of the City Council in June, which will be June 4th, 1979. The Director of Public Works must draw a legal description to be included in the advertisement for the Public Hearing, illplicatio The application of Dannie B. Mayor Nyder stated such report was received ;` Report and approved. +Councilman Borgmeyer presented the following report of the Accounts, IL 'Claims, and Personnel Committee: j"The Accounts, Claims and Personnel Committee met on April 5, 1979, ►lin the Council Chambers of the City Hall . Those members in :attendance were Chairman Vince Borgmeyer, Harvey Hager, and George ?Hartsfield. Also present were Councilmen Ed Rackers, F. E. "Buck" ;Robinson and Thomas Whitecotton. Others present included Mike Bates, from Benton, Jim Hartley, Chief Patton and Chief Thompson as well as members of the news media. !The first item of business was discussion of a letter received from lithe Missouri Municipal League regarding the City' s Health Insurance ii program. Tom Benton reported that Rick Curneal of the League stated that the letter did not apply to Jefferson City. All departments with the exception of the Park Board are covered as part of the high option plan. On motion made by Mr. Hartsfield and seconded by ?Mr. Hager , it was approved that our Health Insurance program remain as it presently stands. JThe next item of business was a legal opinion from Chris Graham, (City Attorney, which stated that it would be illegal for the City 'to pay a portion of the employees family health insurance premiums. Mr. Hager moved that the letter be entered into the minutes of this Accounts, meeting. Mr. Hartsfield seconded the motion and it was passed Claims & !unanimously. The letter reads as follows : Personnel Last October, you requested an opinion regarding the Committee legality of the City' s paying a portion of the employees family health insurance premiums. An much as I would like to see this be done , I can find no authority to permit such payments and cite to you the cane of State ex rel . Sanders vs. Cervantes, 418() ,' . W. 2d 888 which Invalidated portions of ,Section 84 . 100 VAMS which provided health, medical , and inrsurance, coverage upon dependents of employeee. Article 0 Section 25 of tho Missouri Constitution prohibits the payment of money to private individuals. Therefore, it it; my opinion that the payments you contemplate would be Illegal . Vory truly yours, Christopher Graham City Attorney The third item was a request from Mike Bates for a review of the i( method of determining vacation leave as established in Ordinance !' 8914 relative to Art Landers and Melroy Thompson , both employees of the Street Department. The ordinance refers to "continuous it service" . After considerable discussion, Mr. Hartsfield moved that4 continuous service for Mr. Landers and Mr. Thompson be determined as the date of their last hiring. Mr. Hager seconded and the motion passed unanimously. The fourth item of business was a referral from the Parking Authority (!minutes that granted an increase in salary for Clarence Knatcal and Jack Rogers of $50 per month each. Jim Hartley stated that sufficient funds were in his budget and the revised salaries were within the appropriate range listed in the salary ordinance. Motioi was made by Mr. Hager and seconded by Mr. Hartsfield that a $50 per : ;month increase be granted to Mr. Knatcal and Mr. Rogers effective ;I April 1, 1979. Motion was unanimously approved. The Committee next discussed the subject of participation in a idental health care program for City employees. After Tom Benton ! reported that the computer data from the League included informa- ;t , tion on cities participating in this program, it was moved by y(!{{' Mr. Hartsfield and seconded by Mr. Hager that this matter be considered as a part of the fringe benefit package that the 4 Committee will be discussing in the near future. He has a statement from his Doctor approving his return to work without 0 - I restrictions. Councilman Borgmeyer seconded the motion and it carried. ,i I ---- Fire Councilman Hager reported that the Fire Department realized the sum ! Departmentlof $3, 842. 15 from their Auction held April 14th. The money is to 11 - Auction bo deposited in the General Revenue Fund and if it is needed for a 1 Receiptsrescue tool at a later date the allocation can be made at that time.1 I 1 The following Minutes of the Parking and Traffic Commission were , presented: i !I 11 i "The Parking and Traffic Commission meeting was held Thursday, 11 ' ' April 5 , 1979 , 7: 30 a.m. at the Police Station with all members 111 present. Parking Congress regarding the practice of Issuing stickers allowing Traffic local residents to park without restriction near their homes and q . Commission said he would make a report to the Commission at such time as he ! received the information. ) 2) After considerable discussion regarding abuse of Two-Hour , 1 ' 4parking zones and, in particular, that zone in front of St. Peter' s;1 Church, the Commission requested the City Attorney review wording of the current Parking Ordinance with the Police Department and ! the Parking Authority to improve enforcement capabilities. 13) The Commission approved the opening of Monroe Street to Two-way 1 traffic from Tanner Bridge Road to Stadium Boulevard and also the 0removing of parking from the east side of the same. ! , 0) The Commission approved the removal of parking along both curbs . 1 of Stadium a distance of 200 feet east and west of the Jefferson 1 Street-Stadium Boulevard intersection. i 5) The Commission denied a request for a Yield sign at the north 1 0end of Southridge Drive behind Ramada Inn. 6) The Commission denied a request for a Stop sign on Monroe at NWoodlawn. 1 ' 07) The Commission held over a request and petition for the removal of parking on the north side of Swifts Highway from Myrtle to 1 ' Southwest Boulevard with the Commission to receive additional information at the next meeting regarding the problem of student 1 , ' parking at Hellas High School. Mr. and Mrs. Harold Rung, 1604 A Swifts Highway, appeared before the Commission and presented a petition signed by residents in the 1500, 1600, and 1700 blocks of Swifts Highway. BE IT RESOLVED BY THE APPLICANT/GRANTEE, as follows; t` Section 1.
