Motion passed. - - - - - - - - - - IA communication was received from the Housing Authority 's Attorney `:Fire ',, regarding the problem they are having with the Water Company ( Hydrants. 1� concerning installation of new fire hydrants . The Housing Authorit}_ 1has taken the position that under the law and the Water Company tariff, the Water Company is obligated to put the hydrants in at their cost, which they refuse to do. Therefore, they are requesting` that the City, through normal Council action, should request the jWater Company to install these hydrants which are located in the I�Moreau Atchison Neighborhood and the Southside. 'I The matter was referred to the City Attorney to request , on .! behalf of the Council, to proceed with the installation of the 111hydrants . - 111Mayox Hyder ex lained to the Council that the contract between the ,, City and Hidle s, for janitorial service' had expired and is now on . a 30-day basis. They are charging the Health Department $91 .00, Public Works $181 .05 , and City Hall $391. 50, per month. A contract has been presented from Environmental Sanitation Management to do 'Contract . the janitorial services for the City Hall Building far $300.00 but Janitorial would not include toilet paper, towels or soap. It was the Mayor's ' Services . ginion that the contract should be rebid. After some discussion e matter was held over for executive session. Motion passed. ! - jCouncilman Hager, Chairman ofthe-Health Committee, presented the following report: 1A meeting of the Health Committee was held Wednesday, January 18th, ': tat 7:30 P.M. Present were Councilmen Hager, Hartsfield, Rackers and Borgmeyer. Also present was Chester McKinney, the Health Commissioner. Mr. McKinney urged the Committee to review the salary schedule;; of his Department . According to his rojections , his employees, on;: an average are making approximately p$2,000 less per year than similar salaries paid by other cities to members of their Health 1 il IDepartment.. respectfully. Members of the Health Committee suggested to Mr. McKinney that : it was too late to insert or make changes in the Salary Ordinance ''just adopted by the Council. Mr. Rackers made a motion that the Accounts and Claims ;;Committee review the salary and ranges just adopted for the Health ; (Department in the new Salary Ordinance, due to the fact no compari- i! ;;son figures were available from other cities , the review to be .completed prior to the annual budget session later this year. Mr. li , Hartsfield seconded the motion. The motion passed after Mr. McKin- I lney expressed his satisfaction that the matter would be looked intai; Health The Committee then questioned Mr. McKinney as to the reason Committeei, for considerable overtime pay in the Department. Discussion Report. ;'centered around the cut-off time of 10:00 P.M. On a motion by Mr. +; lHartsfield and seconded by Mr. Rackers, the Cc:mmittee voted that 11 ;;the Department cease picking up dead animals , dogs and cats, at !8:00 P.M. instead of 10:00 P.M. j Another matter the Committee frowned upon was the surveillance! liof barking dogs and advising complaining people of the procedure tosi :iobtain relief. It was suggested that the Police Department could i investigate such complaints and advise people how to proceed 'S illegally. A total of 10 separate reasons for night calls and overtime I `,were discussed, and Mr. McKinney intends to review and consider ;?different disposition of several of these items . (i The Committee then went into a long period of discussion with ! Mr. McKinney on the Department 's method of dispensing animals , ' namely dogs and cats . After Mr. McKinney had finished, the Committee instructed him to investigate what is called The Pressurejl Cabinet for destroying animals , instead of the needle and serum now used.i used. After two and one-half hours with Mr. McKinney the Health Committee adjourned at 10:00 P.M. I Mr. McKinney stated that the Company is going out of business Ilat the end of this month and if the City is going to get the 1equipment the order has to be in by the 10th of the month. Councilman Whitecotton questioned obtaining parts for the lequipment if the Company is going out of business . (� !� Councilman Rackers moved that action be deferred until the next Council Meeting. At the time of this writing, the projects on Oak Valley Drive are close to completion, and will be complete before the close of business today. Theproject on Mary Drive is complete at this time. (This does not mean that all applicants are hooked up presently, but ,that the cable is energized and ready to use. We await only the applications being filed by some of the people, advance payments in (I other cases, and. 'some of the others are presently hooked up. i For your guidance and that of the committee and Council, .I '! itwould like to give you the projected order of priority, in the I remaining projects, insofar as we have set priorities . The reason for listing number eight in that way is tfiat tfie balance of the projects , as we have previously submitted them to you, require other work that trenching and splicing. For instance, ) ; five of the other locations will be serviced overhead, with no `trenching required, and we might finish these projects before the ,ones listed above, based on the availability of the "strand", which;: ;,will be placed by the Capital City Telephone Company. The telephone, !',company, in turn, must wait in some cases for the Missouri Power ( Light Company to re-arrange its lines before placing the strand for,. us . So you can see that some of the projects await the actions of third and fourth parties . I must point out at this point that we have received nothing but the best cooperation from the Capital ;International City Telephone Company. Telemeter. FROM: George Hartsfield REFERENCE: Trip to Washington DATE: February 6, 1978. !! + it i While in Washington Last week, I took time to visit with , Representative Ichord and members of Senator Danforth's Staff ; regarding funding for the Wears ' Creek Project and the 312 Housing ; Rehabilitation Program. The Wears ' Creek Project is riding on the Waterways Users ' Bill which has passed the House. There is considerable controversy!} in the Senate regarding the level of tolls to be charged on inland waterways. Assuming no extremely long delays on this legislation or the unlikelihood of our project inadvertently getting "over- ) looked" or "lost" in some of the rewrites or subsequent legislation, everyone I talked to felt that the prognosis of passage by the end of this session was very good. Kermit Almstedt and Bur leigh Leonard of Senator Danforth's Staff were not familiar with the project but are now and promised to "keep an eye" on it as well as keep the Senator alerted to its changing legislative status . I f gave them names of Ichord and Eagleton staffers" from whom they Wear's could get more information and coordinate activity. :! Creek From all I could find out funding for the 312 Loan Program is":; not final at this time and officials at HUD's Washiu ton Office state that they feel that it is a good program and that they have no intention of killing it by withholding funds (or by intention- ally underfunding) . Representative Ichord indicated that several members of Congress had contacted HUD regarding this same concern. This situation should be monitored closely as it is very critical to our city's ambition to avoid neighbor blight. It has been very j# successful in Jefferson City. Councilman Borgmeyer presented the following to the Council; !� The Jefferson City Electrical Board met at 1:00 p.m. , on January ; 19, 1978, at the office of Planning and Code Enforcement, 911 East Miller Street. The following members were present: Vincent Borgmeyer, Bob Stokes, John Sullivan and David L. Scott, Electrical;; Inspector. Mr. Martin Bunch was unable to attend the meeting. Also:; present. was Thomas H. Benton, Director of Planning. The Board reviewed and approved, the request from Don Houser } and James Pavelec to take the Contractor's examination. The men jf were so notified. After discussion, the Board allowed for flexibility to be allowed in the requirement of one (1) Journeyman to one (1) E! apprentice electrician. Commission# Members present were: Chairman Hendren, Ochsner, Munzell, Miller, �I Report ., Gordon, Borgmeyer, Hartsfield, Wildhaber and Bates. Also present were: J. Stauffer, News Tribune; Bill Ward, Jefferson City Flying Service; Herman Lueckenotte, Trans-Mo. Airlines ; John Drainer, �TowerChief; John Randolph; and Erle Taylor, Airport Manager. The minutes of the November 290 1977, meeting were presented, Chairman Hendren requested that the Resolution that the Commission presented to John Randolph on December 16, 1977, be added to the i record. Being no objections or corrections Mr. Ochsner made a motion to approve the minutes . Motion seconded by Mr. Munzell and unanimously ado ted. The financUl reports for December, 1977, and January, 1978, Iwere presented. After discussion, Mr. Munzell made the motion to yaccept the' report. Motion was seconded by Mr. Ochsner and unanimously adopted. i) Mr. Randolph reported that after discussion with Mayor Hyder, that there was still one mortgage note missing on the Lincoln, t Property. The complete agreement should be completed this coming , weekend. Mr. Randolph reported that the National .Guard intends to ! advertise for bids on the fill for the National Guard Facility in ii March. Mr. Taylor reported that the annual meeting of the American I { Road and Transportation Builders Association would be held in ! Washington, D. C. , on February 12-16, 1978. Mr. Taylor was a Imember of the Board of Directors of the Aviation Division for eight!! , years and is presently a member of the Board of Directors of the ' entire Association. ARTBA provides much assistance to airports in 260. Regular Council Meeting, February 6, 1978. lWashington and has been a forceful lobby group on airport affairs . {Mr. Miller made a motion that Mr. Taylor be allowed to attend the ,,meeting. It was seconded by Mr. Hartsfield and unanimouslyy adopted. Mr. Ward, Jefferson City Flying Service, and Mr. Lueckenotte, 'Trans-Mo Airlines , both made appearances and complained about the ';service from Yellow Cab . After discussion the Board instructed ',,Mr. Taylor to notify Yellow Cab of their deficiency, and also to ,, discuss with Chief Patton the requirements for limousine service to :'the airport to open the possibility of competitive limo service to the airport. Mr. Taylor informed the Commission of the request from the Airport , National Guard for a fire pit. After discussion Mr. Taylor was Commission !! instructed to consult with the Fire Chief and the National Guard Report. Band agree on a suitable area. Mr. Taylor reported that because of heavy snows and little or no melting trends , that the cost of snow removal was going to be �Auite high. The Commission went into an Executive Session. Mr. Taylor reported that Wayne Wansing, trainee tower operator, ,was not meeting required ,fob expectations . Mr. Drainer further ' explained the situation and recommended that if Mr. Wansing did not 1have his FAA Facility Rating in thirty days , that he be terminated '' at that time. Dr. Miller made a motion to approve the recommendation. It :was seconded by Mr. Hartsfield and unanimously passed . There being no further business, the meeting was adjourned. ! WHEREAS, the City of Jefferson, Missouri, which is a recipient ("Recipient") under the Urban Mass Transportation Act 11 ("Act") of 1964, as amended, has filed and will file application for capital and operating Grants under the Act ("Project") and' in consideration of receipt of said funds under said Grants ; and 263. .—Rpgplar-Council Meeting, February 6, 1978. WHEREAS, Sections 3(e) , (4) , 5(n) (1) , and Section 13(c) cl£ the Act require as a condition of any Grants thereunder, that fair and equitable arrangements be made, as determined by the Secretary of Labor, "to protect the interests of employees affected by such 11 lassistance"; and WHEREAS, the arrangements hereinafter contained are intended : to provide such fair and equitable arrangements as to protect the interests of employees of Recipient who may be affected by a ,;Project and any other employees in the mass passenger transit if Jndustry in the service area of the Recipient who may be affected '!by a Project; and 4� WHEREAS, all of the Union employees of Recipient affected by ' a Project are represented by Public Service Employees Local Union " No. 45 of the Laborers International Union of North America ,, ( 'Union") ; and WHEREAS Recipient, as a condition of its participation in a Project, will meet the requirements of the Act and in so doing will ! accept obligations for performance of the following terms and provisions , which shall be binding and enforceable against it., as ': hereinafter provided, by any employee of Recipient and any other employees in the mass transportation industry in the service area , .'' of the Recipient who are affected by a Project, as hereinafter provided individually or by their designated representatives; Resolution,, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF Transit! (l) The term "Project" as used in this agreement shall mean the �,; operation of the Jefferson City area Transit System during such times as it is funded, in part, by a Grant under the Urban Mass Transportation Act of 1964, from the Department of Transportation. ', The term "Project" and the terms and protections of this agreement .! shall not apply to events occurring as a result of volume rises andl� !! falls of business , changes in volume and character of employment ,; brought about by causes other than the Project (including any . economies or efficiencies unrelated to the Project) total or ,, partial termination of the Project, discontinuance of Project ; services or exhaustion of project funding, notwithstanding any .. other rovisions of the agreement . (2) rights, privileges and benefits of employees covered by this agreement (including pension rights and benefits under LAGERS ,. of employees having already retired) under current State law, existing Personnel Ordinance provisions , Labor agreements and retirement systems or under any revision or renewal thereof, shall ! be preserved and continued; provided that an K such rights I , privileges and benefits may be modified by the Recigient In !! consultation with the Union to substitute other rig ts , privileges ;! and benefits. Unless otherwise provided, nothing in these arran ge- i m shall be deemed to restrict any rights the Recipient may ilotherwise have to direct the working forces and manage its 11 business as it deems best. 11 (3) The existing rights of employees, covered by these arrange- ,Iments, to present proposals to Recipient and to meet, confer and ,',, discuss such proposals relative to salaries and other conditions of employment' shall be preserved and continued. J (4) No change in the present structure and operation of the Jefferson City Transit System is planned or anticipated as a result l' of the Pro act and it is not contemplated or foreseeable that any of the following events shall occur: a. that employees ' positions with res act to employment shall be worsened as a result of the Project; b. that any other mass transportation system will be acquired as a result of the Project; c. that present employees will be laid off or terminated as a result of the Project . (5) In the event Recipient contemplates any change in the organi- zation or operation of its system which may result in the dismissal!( i1or displacement of employees , or rearrangements of the working ilforces covered by this agreement, as a result of the Project, the Recipient shall give to the Union 60 days written notice of each proposed change. Such notice shall contain a full and adequate !I statement of the proposed changes including an estimate of the 11number of employees affected by the intended changes and the !! numbers and classifications of any jobs in the Reciplentis am loy- Oment available to be filled by such affected employees . At the request of either the Recipient or the representatives of the 264. affected employees , meetings for the purpose of discussing the appliontion of the terms and conditions of these arrangements to the intended changes shall commence immediately. These discussions' shall include determining the selection of forces from among the employees of other urban mass transportation employers who may be ii 11affected as a result of the Project, to establish which such t employees shall be offered employment with the Recipient for which �! they are qualified or can be trained; not, however, in contravention; of provisions of the personnel ordinance and the working conditions relating thereto. j! (6) The Project shall be carried out in such a manner and upon I such terms and conditions as will not in any way adversely affect employees in the mass passenger transportation industry within the service area of the Project. (7) No employee shall be laid off or otherwise deprived of employment, or placed in a worse position with respect to compensa-H , tion, hours, working conditions, fringe benefits, or rights and �! � privileges pertaining thereto at any time during his employment as 11 a result of the Project, including any program of efficiencies or ! economies directly or indirectly related thereto. An employee shall,! not be regarded as deprived of employment or placed in a worse , position with respect' to compensation, etc. , in case of his j resignation, death, retirement, dismissal for cause, or failure to 1� work due to disability or discipline. !! (8) In the event an employee is terminated or otherwise laid off as a result of the Project, he shall be' granted priority of employ-(! ment or reemployment to fill any vacant position for which he is, or by training or retraining can become, qualified. In the event training or retraining is required by such employment or reemploy- ;+; ment, the Recipient shall provide or provide for such training or !" retraining at no cost to the employee, and such employee shall be I! paid, while training or retraining at no cost to the employee, and1 such employee shall be paid, while training or retraining, the 11 i salary or hourly rate of his former job classification or that of i! the classification for which he is training, whichever is higher, J (9) The assurances contained in the agreement of the American Public Transit Association pursuant to Section 13(c) of the Urban Mass Transportation Act of 1964, as amended, dated July 23, 19750 will apply to any employee whose position with respect to his employment is worsened as a result of the Project. (10) The Recipient shall be financially responsible for any such deprivation of employment or other worsening or employment i1 position as a result of the Project. 'Resolution- (11) In the event there arises any dispute with respect to the 11 Transit irotection afforded by these arrangements, or with respect to the E nterpretation, application or enforcement of the provisions of 1 these arrangements which cannot be settled by the parties thereto 4j within thirty (30) days after the dispute or controversy arises , it may be submitted at the written request of the Recipient, the ;± employees , or the Union, to any final and binding dispute procedure acceptable to the parties, or in the event they cannot agree upon such procedure, to the Department of Labor or its I designee for final determination. 1 (12) The Recipient shall maintain and keep on file all relevant books and records in sufficient detail as to provide the basic information necessary to the making of such decisions. (13) The Recipient will post, in a prominent and accessible place,'1 a notice stating that the City is a Recipient of Federal assistance'f under the Urban Mass Transportation Act and has agreed to comply (1 with the provisions of Section 13(c) of the Act. (14) These assurances shall be a supplement and in addition to all! rights and privileges existing or hereinafter conferred under !� Personnel Ordinances or labor agreements and that the Project I shall be performed and carried out in fuh compliance with the li protective conditions described herein. The Department of Labor requires that Othese people will not be put in a worse position through receiving Ithe Grant. The proposed Resolution is based on the one adopted by !
