Councilmen present: Borgmeyer, Brant, Gordon, Hager, Hartsfield, McDowell , Rackers , Robinson, Whitecotton and Wildhaber. ! Councilmen absent: None. A quorum was declared present. ;:The Minutes of the meeting of May 2nd were approved as received. I! A Public Hearing was held on the rezoning of 2 .8 acres (part of ! Outlot No. 73) from RS-3 (single family) to RA (multiple dwelling) .; Louis Vetter, one of the owners of the property to be rezoned, !1appeared before the Council. He said that the land lies behind the '! Taylor Court Complex on East McCarty Street. The 2.8 acres lies in . " an area of approximately 7.0 acres . A buffer zone will be made out of the bulk of the land. The request is not unreasonable since the • topography is not appropriate for single family dwellings . All Public traffic will come off East McCarty Street . On the lower level Hearing: .; three buildings will be built, housing between 20 to 30 apartments and two six plexes will be built on the upper level . Tom Wilson, Attorney representing the opposition, presented a petition in opposition to the rezoning and presented his clients i� for hearing. Ed Hood, 409 Lark Street, Mark Schaeffer, 411 Lark Street , ,. Orville Stutte, 415 Lark, Ron Taggart, 412 Lark, and Jim Wilson, 410 Lark, appeared in opposition since they did not think there would be an adequate buffer zone, lowering of property values , £; inadequate sewer system, and traffic hazard on East McCarty Street. . ! Mr. Langer, 1615 East Miller, stated that he did not approve of spot zoning. Councilman Wildhaber stated that the sewer line which would ' serve the area has been backing up on Grant Street. - ^ '; The following bids were received for the installation of a garage ; door at the Health Department: ij Capital Installers , Inc. $ 11115.82 { Ralph E. The request was referred to the Street Committee. - The following was received from the City Attorney: i. -The Honorable Mayor and City Council 'Jefferson City, Missouri. f if ;Dear Ladies and Gentlemen: You have referred to me a request from Larry Randazzo, with jl ; respect to the validity of Section 1297 of the Revised Ordinances of the City of Jefferson (1956) . This Ordinance provides for the , ;!hours of operation of barber shops within the City of Jefferson. Section 71. 750, R.S.Mo. 1969, states as follows : "The legislative bodies of all incorporated cities, towns and villages are hereby empowered to pass , alter, { amend and repeal Ordinances to regulate the hours of closing of barber shops and beauty shops ." i} The City Council of the City of Jefferson, by the passage of . Section 1297 of the Ordinances of the City of .Jefferson, saw fit toil - regulate the hours of closing of barber shops , but has not enacted ! Legal an Ordinance nor included in Section 1297, beauty shops . Opinion It is , therefore, my opinion that Section 1297 of the Revised Barber Ordinances of the City of Jefferson (1956) is a proper exercise of I' Shops . the police power granted to the City Council 'by Section 71. 750, and that the provisions of said City Ordinance are valid. Councilman Brant stated that the Ordinance should be changed, since, in his opinion, it was discriminatory. Motion passed. - Ii Councilman Gordon presented the following report from the Jefferson !McGraw- City Health Department: IlEdison An inspection was made May 10, 1977, on the parking lot located at IliLot. g . in the 1700 block of Industrial Drive across from McGraw Edison Co. ,I The following conditions were observed: 11. The parking lot has not been paved but has been covered with ('oil by City Paving Co. , and they indicate this is to be the final faction. �2. The parking ot is not enclosed in front b Industrial Drive with chain link fence. y 3. The lot is adequately lighted. �4. The lot entrance has two metal poles with attached chain to prevent vehicle access when not in use. t' . The lot was relative free of litter and was in a clear state when inspection was made. In general, the parking lot still does not meet the require- �ments as outlined in Section 1701 Article XVII Ordinance 588 of the ;i City of Jefferson. c� Very truly yours , /s/ Chester J . Council Meeting, .May lb, .1977... __ ....... . 11Councilmen Gordon then presented a petition signed by 38 persons 11that the Council revoke the Special Permit granting permission for ':McGraw Edison use of the parking lot . Mark Cordell, Executive Vice President , Chamber of Commerce, ;said that they had regraded and oiled the lot, which was what they were asked to do, and they feel that they have complied with condi tions of the Special Permit. Mr. and Mrs . Nelse Addison and Dave Hanna appeared and stated that the same conditions still exist . McGraw After considerable discussion on the matter, Councilman Edison ;Borgmeyer moved that the matter be referred to the City Attorney toi' Parking determine if the Chamber of Commerce is in compliance with the Lot . Motion passed. ! �1Councilwoman McDowell, Chairman of the Special T V Committee, presented the following report: j ,'Meeting was held Tuesday, May 10th, 1977, with Councilmen White- cotton, McDowell and Mike Bates and Pat Healey of C.A.T.V. :.Discussion was held on the area newly annexed, Hiddenwood and Cable Wildwood, would be as quickly and rapidly as can be. T V stated that the Highway Department would not allow the line to be Report . installed over the Highway, but would allow the installation when ;the construction of the interchange near the apartments . Mike :;Bates , Director of Public Works, and Larry Dates , Street Commissioner: :'were also present . Mr. John Brown, 2034 West Main Street , appeared before the 1Committee and reiterated his claim of damage relating to alleged loss of access to several lots due to the improvement of Grant Street and suggested a new street in the area to provide access to :these lots .. On motion of Mr. Wildhaber, seconded by Mr. Gordon, i� the Committee postponed action until Mr. Ted Herron could be ! Spicer, 908 Minnesota Street, to ( resurface that and other streets in the area, was held in abeyance ; , until Mr. Spicer could be contacted by Mr. Borgmeyer to inform him of the $5.00 charge per front foot to abutting property owners, and ; �ireport back to the Committee. On motion of Mr. Borgmeyer, seconded by Mr. Wildhaber, the ; ! Committee approved the retention of the Consulting Firm of Horner I� ; and Shifrin to make the initial study and develop a comprehensive ' , plan to serve the St. Louis Road - Indian Hills Sewer District, as ! recommended by the Director of Public Works . A recommendation for 'I ! the project had been previously requested by the Committee. '! Councilman Whitecotton, Chairman of the Street Committee, presented j the following report: .The Street Committee met in the Mayor's Office, City Hall, at 7: 15 : P.M. , Monday, May 16th, 1977, with members Borgmeyer, Robinson, ;Wildhaber and Whitecotton present . Mr. Mike Bates , Director of I'Public Works, Mr. Larry Bates , Street Commission, and Mr. Ted };Herron of the Housing Authority, were also present . i Following a discussion on the complaint of John Brown relating, ! to alleged property damage due to the improvement of Grant Street, 1,Mr. Borgmeyer moved that 50% of the footage of the Brown property, ;abutting on Grant Street, be waived . The motion, seconded by ,iMr. Wildhaber, carried. Mr. Mike Bates requested authority to permit Les Parscal of Street :;the Sewer Department to attend an Effective Management School at a Committee +1cost of approximately $200.00. Mr. Wildhaber moved that the Report. ,request be approved. The motion seconded by Mr. Borgmeyer carried, On motion of Mr. Borgmeyer, seconded by Mr. Robinson, the jCorunittee approved the employment of Herbert C. Goeller as ;Technician III , Department of Public Works , at a salary of $850.00 I;Der month, to become effective June 1, 1977, if possible. Motion passed. - - - - - - - - - - Councilwoman McDowell, Chairman of the Public Utilities Committee, Public moved that the requests for a street light be placed on the Utilities ,existing pole in the 300 block of East Capitol, near the side Committee ; entrance of the First United Methodist Church, and the necessary Report , lights in Landwehr Hills Subdivision, Section 8, be referred to the Missouri Power & Light Company for their recommendations . Motion passed. The following report of the Parking and Traffic Commission was , presented to the Council: i'The Parking and Traffic Commission meeting was held May 5, 1977, '17: 30 A.M. , at the Police Station, with all members present . Also Iiin attendance at the meeting was Councilwoman McDowell. The Commission made the following recommendations: 11) That a 4-way Stop be designated at the intersection of Jackson nand State Streets during construction of the high-rise for the ' elderly, To be in effect only during construction. 2) That a Stop sign be installed on the southeast corner of Parking 1` David Street before entering Douglas , and i3) That parking be removed west of the west curb of Ash Street Traffic on the south side of High Street for a distance of 70 feet . Commission The Commission denied the following requests: Report. � 1 To permit parking at 1830 Greenberry Road. � 2� Request for removal of parking on West McCarty from Fulkerson to Vista. � 3) Loading zone request in the 200 block of Monroe Street, It ' was recommended that Capt . Duncan contact the Sheriff's Department to assist in keeping the alley clear during the hours of the Pre-Kindergarden Nursery loading and unloading, The following items were held over for further consideration: I1) Request for No Parking" on one side of 100 block McKinley, 1 200 block N. Taylor and 1200 block E. Water Streets . Councilman I Robinson will be asked if petitions could be presented from the I� pproperty owners stating from which side parking should be removed. 2) Request for elimination of 2 hour parking restriction in the 100 block of Jackson Street. Sewer !`Mayor Hyder informed the Council that the Capital City Water Biling. !Company had agreed to extend their billing and collecting of the sewer charges indefinitely. The following report of the Parking Authority was presented to the Council: The ParkingAuthority met at 7:00 A.M. , Tuesday, May 10, 1977, with Robert Schulte, Vincent Borgmeyer, Carolyn McDowell , Charles "Czarlinsky, Mike Bates , Roger Verslues , Bill Boes , and James Hartley present . James Thomas and Wilben Dill were out of town, :1. Roger Verslues made recommendations on repair to the drainage system in the City Parking Garage. Total cost of $14,000 included , repair of pipes that are broken, and removing all drainage pipes II from under the sidewalk and run them to a drop inlet on Capitol Ave: Parking On a motion by Borgmeyer, and seconded by Czarlinsky, the Authority,Authority will take bids on repair of the pipes only. Report . 2, Concerning the parking lease with the Missouri Chamber of Commerce, Borgmeyer made a motion, seconded by McDowell, to lease 30 spaces to the Missouri Chamber starting April 15, 1977. ; 3. The go--ahead was given for conversion of 2 hour parking meters '! ' on 3 blocks of High Street to a one hour limit , 4. On a motion by Czarlinsky, seconded by Borgmeyer, the Authority,, will advertise for part-time employees . ;f ' S. The Authority approved Sherman Hayes , Jr. , for part-time help. , 6, On a motion by Borgmeyer, seconded by McDowell , the Authority ;will invest for 1 year $550,000 from the Parking Lots Fund in U.S. 'Treasury Bills . 7. Verslues reported to the Authority on the progress in repairs of the top deck. Grinding of the surface and applying of a magic floor patch on a small portion of the deck will be tried, /s/ Robert C. Bill 9. :'Mayor Hyder said that the proposed zoning in the area would be Defining presented to the Planning and Zoning Commission on the 19th of May, City which would save a number of public hearings before the Council . Limits . Councilman Brant asked what guarantee the Council would have that people would not set foundations before the Bill is passed. Mayor Hyder said that owners of property have gone to Mr. lBenton for a reasonable zoning method, therefore it would be sensi- ble to wait until the first meeting in June for final passage of the Bill.
