Councilmen present: Borgmeyer, Brant, Gordon, Hartsfield, McDowell, Rackers , Robinson, Whitecotton and Wildhaber. . Councilmen absent: Hager , absent with leave. A quorum was declared present. .,The minutes of the meeting of May 16th were approved as received. - ':The following bid was received for the installation of a radio Opening tower at Fire Station No. 1.: of Columbia Electronics Bids New 50' tower delivered and installed $ 839. 00 Move tower from Station #3 and install with new antenna and cable at 621 West High Street 682. 00 After some discussion, Councilman Wildhaber moved that the bid of $839.00 be accepted. Motion passed. The following bids were received for the sale of one 1963 Opening Chevrolet School Bus : of Arthur Landers 104 McKinley, Jefferson City, Mo. $ 100.00 Bids. Terry Reed, 314a West Elm, Jefferson City, Mo. 252.00 Kenneth Menges, 1105 East Miller, Jefferson City, Mo. 250. 00 ;Councilman Borgmeyer moved that the City sell the bus to Mr. Reed. {Motion passed. - - - - - - - - - - The following names were submitted for appointment as Probationary Appointments Police Officers , to fill the present vacancies: to Ronald L. Walker, Gary B. Kempker, Terryy L. Day. Police Councilman Whitecotton moved that the names be referred to the Department. Police Committee. Motion passed. Colonel Patton, Chief of Police, submitted the name of Paul Buchanan for promotion to the rank of Corporal , to fill the vacancy due to the resignation of Corporal Sennott , and Ralph Coshow for 'promotion to the rank of Sergeant, due to the resignation of Sgt . Promotions . Francis Crews , with a request of an effective date of June 6 , 1977. Police Councilman Whitecotton moved that the requests be referred to Department, the Police Committee, with power to act . Motion passed. A letter of resignation was received from Jimmie A. Fisher, Resignation. Jefferson City Fire Department, effective June 30, 1977. Councilman Gordon moved that the resignation be accepted. Motion passed. ,tA request was received from N. H. Scheppers Distributing Company Fire ; for the City to install fire plugs in the 1700 block of Southridge Committee. :.Drive, since they now have a Class 8 rating. The matter was referred to the Fire Committee and the City {,Attorney for an opinion as to the City installing fire hydrants . Mayor Hyder stated that due to a recent election, the Capital "City Water Company will make a connection with Water District No. 2, which will run through the Scheppers property. - - - - - - - - - - An application was received from Ted Stewart to rezone 20 acres in planning and ;the vicinity of Route C and Ellis Boulevard, from C-4 to C-2 Disb ct, Zoning The application was referred to the Planning and Zoning Commission. ;Commission. Councilman Hartsfield said that he had received numerous complaints ; An retard to flooding conditions in the creek system in the Belair Street ! Distr ct. He requested that the matter be referred to the Street Committee� Committee and Department of Public Works . Mayor Hyder said that there had been problems for several years l ;; and requested an opinion from the Director of Public Works . The Director of Public Works stated that $10,000 had been iallocated in the budget to help alleviate the problem and suggested ! , a holding area in the old lagoon in the vicinity of Norris Drive. , The troubled area is located in a flash flood area and the run off Iproblem will increase with new subdivisions being developed. Councilman Borgmeyer said the same problem is on Southwest ; Boulevard. Also present , Director of Public Works Mike Bates, Street Commissioner Larry Bates , and Sewer Commissioner " I!Jim Locke. Councilman Borgmeyer, referring to salaries in the Sewer and �; Street Departments , explained there was an error in computation in i' determining the minimum and maximum wages . A new schedule was .; Submitted showing correction in four of the brackets . A Also discussion had about pay of the Street Superintendent and .' Accounts, '!Assistant Street Superintendent ; considering their salaries are on Claims and 1;a regular basis - no overtime - they are not comparable to others Personnel in lower brackets . Correction made in these two positions . Committee Motion made by Councilman Hager, seconded by Councilman Report. ;Wildhaber, and carried, that the attached schedule be accepted for the Street Department and the Sewer Department . Discussion then had about position of Survey Chief, Designer, for Chief Construction Inspector, listed in the Engineering Depart- 11ment . Borgmeyer Chairman. `!Meeting of the Accounts , Claims and Personnel Committee called for :+'Tuesday, May 24, 1977, 8:00 P.M. , Council Chambers , to meet with Representatives of the Labor Union. Members present were Councilmen Borgmeyer, Brant, Hager, ,:Hartsfield and Wildhaber. Also present were Director of Public "Works Mike Bates, Street Commissioner Larry Bates , and Sewer ''Commissioner Jim Locke. Representing the Labor Union were Mr. Francis Jacobs , Inter- :,national Representative of Laborers ' Union #45, Mr. Mitchell ;iBennett Business Manager, Local Union #45, and Mr. Carl Bradshaw. ii Mr. Jacobs presented a copy of "Intent and Purpose" to Members �! ,:iof the Committee and then read through the same, replying to any Hquestions presented. He suggested the Members study this paper and J:then set another meeting date. Information brought out by questions and discussion: At the time of the last election there were ap roximately : A 61 members in the Union - representing City employees. Union ,, represents all employees regardless of whether or not they are paying ilmembers _ this Union is their exclusive bargainintfagent. Mr. !,!Bennett stated there are approximately fifty or fifty-five per i:cent still in good standing with the Union. ii In this Union of City employees, there are two or th&wq; ;:Stewards - at this time they have William Bemboom in the Street l; Department, Delbert Hodges in Transit, and the one in the Sewer ,iDepartment is no longer in the employ of the City, and has not been " ,: replaced. There are three Units in the Union of City Employees , one ;; 14or Sewer and Engineering, one for Transit and Maintenance, and one :; ;! for Street Department. A regular meeting is set up for the second ; for of each month at the Labor Temple. Several requests were made to the Union Re s paid drequesting a list of the City employees who were up members ini I i1the Union, but theRepresentatives said the same was not available. Motion made by Councilman Brant that this Committee request lLocal Union # 45 to go back to their Members for a show of confi- dence vote, showing they have at least a majority wanting this Unicol' their Representative. Motion seconded by Councilman Hager and 1passed. The Representative stated this request would have to be submitted to the Board of Mediation. Councilman Borgmeyer stated , ' he would await a reply from the State Board of Mediation before setting another meeting. II 97. The Street Committee met at 7:00 P.M. , Wednesday, June 1st, with I street ,Members Borgmeyer, Robinson, Hager, Brant and Chairman Gordon "► Committeeiipresent. Street Commissioner Larry Bates , Planning Director Tom Reporti, Benton, and Director of Public Works Mike Bates were also present, !; Other persons present were Earl Antweiler from Callaway County and ;. Fred Nichols and John Meyer from E. S.M. The order of business was as follows: X11) At the request of the Director of Public Works the following (, personnel requests were made. On a motion made by Councilman Brant !land seconded by Councilman Borgmeyer, Carl Connell was promoted �ifrom Technician III to 'Survey Party Chief 'at a salary of $890.00 per month effective June 1st. As a part of the same motion author-1 ixation was given to hire Robert McPherson as Technician III at a ,� s ! salary of $800.00 per month'. i2) Earl Antweiler from Callaway County appeared before the Committee as per the March 14, 1977, Street Committee minutes, to !; { inform the Street Committee the Callaway County Special Road '! District had asked for and received bids for the new bridge over iiTurkey Creek. The low bid of $73,000 was rejected and the Special l !! Road District is going to proceed with their own personnel to buildi iCouncilma' n the new structure at an estimated cost of $67,000. On a motion by Borgmeyer, seconded by Councilman Brant, the Public lWorks Director was instructed to meet with the Special Road Distric return with a recommendation to the Street Committee, as to the amount of 'participation by the City of Jefferson. 3) Fred Nichols and John Meyer appeared before the Street Committee with a "Street Sweeping Proposal" for the City of Jefferson. After some discussion on problems which could arise 1 98. from such an agreement, Councilman Borgmeyer made a motion to rejectil the proposal Councilman Hager seconded the motion. The motion ,,passed. Members voting aye: Robinson, Borgmeyer and Hager Members voting nay: Brant 14) Fred Nichols also requested a water supply system located on i'City right-of-way which is currently being used in front of the new ., `E. S.M. building by Carl Propst Water Hauling be relocated. On ;!motion by Councilman Borgmeyer, seconded by Councilman Hager, the '!Director of Public Works was instructed to contact Mr. Propst and !!take the necessary action. !6) A request from Jack Jordan was received regarding the extension ,'of Stadium West. Mr. Jordan indicated he has waited for several .iyears for action by the City and if progress on the extension is not` ;:made in the near future he would proceed with his development. On ;,a motion by Councilman Hager and seconded by Councilman Borgmeyer, ,'!Planning Director Tom Benton and Director of Public Works Mike Bate , !;were instructed to meet with Mr. Jordan as soon as possible and Street !!report to the Street Committee on progress made. Committee 16) A request from Paul Kolb and William Ruprecht to vacate a tract Report. of land referred to as a "Commons" being a part of Jones Addition land adjacent to Missouri Boulevard was held over for further study . !Director of Public Works shall report at the next Street Committee :meeting. 'designating 7) A request from Ed Hasselman for a combination bus stop and sign his recently platted subdivision, Ed Nor East, was 11received. On a motion by Councilman Robinson, 'seconded by Council- ': ;Iman Borgmeyer the matter was referred to Planning Director Benton liwith the condition that the sign portion of the proposal be jjig eliminated. 8) A request from Central Missouri Professional Services to vacate, ! a sanitary sewer easement between Lot No. 32 and Lot No. 33 of Leslie;' Acres Subdivision was received. A motion was made by Councilman , Borgmeyer and seconded b Councilman Robinson to approve the request !;after the Director of Public Works indicated the request was inorder. ;19) Councilman Borgmeyer reported he had been in contact with the 11property owners along Minnesota Street and that they will contact lithe Street Committee in the near future. ;110) Councilman Brant posed the question as to ownership of the ;Isouth drive of the Gerbes East Store. He was informed y Street iCommissioner Bates this was a portion of Benton Street vacated upon ; 11construction by the store and it is now a private drive. On a ; motion by Councilman Brant, seconded by Councilman Robinson, the ,' Committee directed Street Commissioner Bates to contact the Manager;! eland notify him if the drive is not patched within thirty (30) days :! the City would close the access onto Miller Street. Ill) Councilman Borgmeyer reported he has had several complaints as If ,ito drainage off of Dora Street into the backyards of the properties ;�l lon Westwood. The Committee directed Street Commissioner Bates and i .; Director of Public Works Mike Bates to investigate the problem and !1 determine action to be taken. : 12) Councilman Robinson reported that the realignment of the High .! Street-East McCarty Street intersection appeared over the last two j': (2) weeks to be working well. On a motion by Councilman Robinson, iIseconded by Councilman Borgmeyer, it was agreed to make the irealignment permanent. !f There being no further business the Committee adjourned. The application of Robert Anderson was considered with the llapplicant being represented by James Gallaher. There was no opposi ,tion to this request to rezone Lots 42, 43 , 44, 45 and all except 1the westerly five (5') feet of Lot 46, of Mount Hope Heights iSubdivision, from RS-2 (single family) to RA (multiple dwelling) . 1!The motion to approve this request was made by Fred Bode and the !I :!second by Bert Koester. !� i12. The request of Richard Groner to rezone fifteen (15) acres of 4J #!land from RS-1 (single family) to RA (multiple dwelling) east of ILadue Road and west of Von Hoffman Press between Industrial Drive And Highway 50 West , was presented by Mr. Groner. Opposition to 11this request was voiced by J. Raymond Brummet, Robert Major, Keith !� (Hunter and Jerry Uhlmann. A motion to approve this request was made , by Fred Rost and seconded by Charles Dudenhoeffer. However, a }' ;;substitute motion to hold this application over for further study i; ;,was made by Mr. Robinson and seconded by Mrs . Munzell. The substitute motion was approved by the following vote: Members voting Aye: Robinson, Munzell, Dudenhoeffer, Koester, ,, Plannin g , Evans and Bode. and ;Members voting Nay: Bates , Caplinger, Hackman and Rost. Zoning 13. The application for approval of a preliminary plat of Leanda ! Commission 'iSubdivision presented by Lee Stafford was approved subject to the Report. tprovision of necessary right-of-way for the extension of Windriver ;(Drive eastward to the adjoining property. The motion to approve : this request was made by Mr. Caplinger with the second by Mrs . Munzell. ! 4. The replat of Fox Ridge Subdivision was approved with the motion to approve this request being made by Mr. Rost and the ! ! second by Mr. Dudenhoeffer. 15. The attached plan (Exhibit "A") was presented to the Commission ! by Mr. Benton. Various requests for amendments were made by Ron !'Prenger, representing General Growth , Mike Riley representing Gene IKnipp and Bob Dallmeyer, Mike Riley representing Russell Hall, and ' Jim Dalton representing Roy Horridge. !� The General Growth C-1 (neighborhood commercial) designation ,,was enlarged on a motion by Mr. Hackman with a second by Mr. Rost. ill The property south of Highway 50 West and owned by Gene Knipp ;was designated as C-1 (neighborhood commercial) to a depth of 1 ,89011 ; feet from the center line of the highway. The motion was made by Mr. Caplinger with a second by Mr. Hackman. Property owned by Robert Dallmeyer, Jr. , etal, designated as IC-4 (planned commercial) on a motion by Mr. Caplinger and seconded by Mrs . Munzell. Seth Evans voted negative and Charles Dudenhoe&r1l la stained from voting on this item. No action was taken relative to the Russell Hall request ( presented by Mike Riley. On a motion of Mr. Rost with a second by Mr. Bode, the area ! between North Ten Mile Drive and the north and west City limits is to be designated as C-4 (planned commercial) . The above recommendations are shown on Exhibit "B". (� 6. The proposal from Harland Bartholomew and Associates for , updating the 1969 Comprehensive Plan was discussed (see Exhibit I "C") . The estimated cost for these services range from $10,000.00 + ito $15,000.00. A motion was made by Mr. Koester and seconded by Mr. Dudenhoeffer that the Planning and Zoning Commission request , the City Council to finance such an up-date with Revenue Sharing Ifunds as soon as possible. Up-dating of the Comprehensive Plan is vital to the planned growth of our City. There being no further business, the meeting adjourned. Mr. Benton explained that the plan had 138 acres zoned for commercial and the Commission increased it to 276 acres . For good land use planning they set aside too much area for commercial zoning. The Zoning Commission does not have public hearings , but (: I they have had good news coverage and interested persons can sit in ,tat the meetings . No one appeared at the meeting in opposition to Neither plan. Councilman Whitecotton stated that in fairness to they !! people concerned, the Council should refer Item No. 5 back to the ,1planning and Zoning Commission. In regard to Item No. 6, Councilman Brant moved that the City lAttorney draw the necessary Ordinance. Councilman Ra6kers said that the Council should list what they .; liwant included in updating the Comprehensive Plan and suggested that )� ,lMr. Benton give recommendations as to subject matter at the next :1 meeting; ,11Councilman Robinson moved that the report be filed. Brant has served as a valuable member of the Jefferson City Airport Commission for a number of years , and WHEREAS, during his tenure of office as a member of the , Commission many valuable improvements have been made on The Airportl� including the construction of taxiways , ramps , runways, SDF ,landing , system, control tower and other improvements , which are largely the ilresult of the untiring efforts on behalf of the Airport by him, and '; WHEREAS, he is retiring as a member of the Airport Commission: ,. Finney had informed him on Friday that the National Guard Bureau in Washington was still evaluating the proposed facility and also that an answer would be forthcoming soon. Mr. Randolph reported that the New Jefferson City Flying IService had asked for ro sals to build their new hangar and that they had received two Eallo. and as soon as they heard from the otherl one they will decide on which one they plan to use and will then i present thL-ir application to the Airport. Commission for their leaseii Building and Grounds Committee Chairman Ott reported that he and Director of Public Works, Mike Bates, had discussed the razing of the old T-hangars located south of the Terminal Building. Mr. . Ott recommended that the Public Works Department be agermitted to remove the building for the salvage materials available. Mr. Bates agreed that he would remove the building and clear the property at no cost to the Airpoit Commission. He plans to use the material to )l Ibuild a building for the City Street Department . After discussion, !, Mr. Ochsner made a motion to approve the recommendation of the Building and Grounds Committee that the building be torn down by e the Public Works Department at no cost to the Airport Commission. i The motion was seconded by Dr. Miller and unanimously adopted. 101. -June Mr. Randolph reported that the 8-26 runway lighting project7 !,was complete and that the contractor had been paid in full . He -further reported that the overlaying of runway 12-30 had just ;started with the removal of the paint and the clearing of the jointd" ' nand the spauled areas were being resealed and leveled prior to the i . overlaying process which he hoped would start w thin the next week or ten days . He also reported that there a perfod of four or five days that both paved runways would be closed as the overlaying �!process went through the intersection of the two runways. However, !' !all the sodded areas would be available to accept smaller aircraft. Il Mr. Randolph requested to install eight reserve parking areas ,,; for the two rent-a-car companies on the back side of the last row :of parking spaces in the parking lot. These would be visible for people as they approach the terminal building to find a place . to Airport ;leave their rental car. After discussion Mr. Borgmeyer made a Commission motion to approve the installation of the signs for the two rent-a- I! Report car companies . Mr. Randolph reported that the old well at the control tower ;.had failed and that a new well had been sunk at a cost of $163 and ,,:was now working perfectly . Mayor Hyder reported that he has been negotiating the purchasell lof several different pieces of property to exchange with Lincoln ! University for the necessary acreage to extend runway 12-30 1500 , feet. He hoped to have the negotiations completed within the next 'I , two weeks . Mr. Randolph stated that he would contact FAA to see if iit would be possible to acquire federal funding for the land lacquisitions and the paving project to be included in this years i ` FAA's program, which would make them eligible for the ninety federal land 10 local per cent participation of the cost . Mr. Randolph reported that the annual Cedar City Drainage , District meeting would be held on June 4 at 2 p.m. at the Ai rport. ,lHe requested authority to authorize the payment to the Drainage dDistrict for the total amount of acreage of the Airport. It was gointed out that although only a part of the Airport is protected y the levee, it has been the practice of the Airport Commission to �.pay the assessment on the total property to help the Drainage ;!District maintain the levee. The Special Permit was issued and was to be 'valid and effective only as long as certain conditions were =i +continually observed; primarily, "that the parking area be paved, ;sand maintained, in a manner that it will not present a dust 11nuisance." After viewing the parking lot, I find that the Chamber of ':ICommerce is technically in compliance with the portion of the Permie Irequiring that the lot be paved. In the case of Ross v. Kendall, i i;81 S.W. 1107 (Mo. 1904) , the Court defined paving as follows: Opinion "An Ordinance authorizing paving of a street may include City .I paving with asphalt, or with vitrified brick, or with Attorney;; macadam or the like. The term 'pave' in its generic sense, McGraw means to place some substance on a street, so as to form an Parking; artificial roadway, or wearing surface which shall change Lot. ;; the natural condition of the street." But the Permit also required that the lot be "maintained in a I+manner that it will not present a dust nuisance," which has not beell� !done in light of the complaints which have been brought to the attention of the City Council. All that has been done is to regrade the lot and oil it, which apparently has not prevented a ; ydust nuisance.
