He stated that they ',were buying the assets of International Telemeter and are ready to ';service people who have been waiting for service. They need ,assurance from the Council, prior to December 31st , to proceed in the process of getting a loan. Councilman Hager moved that the Council approve the transfer lof the franchise contingent on the Company making extensions of ' CATV services to those on list submitted to them by the end of the year. Regular Council Meeting, November 21, 1977. i:A request was received from the Capital City Water Company to waive lithe 7% Gross Receipts Tax on water supplied to Water District No. 2. Councilman Borgmeyer suggested that the request should not be ,considered until hydrants are installed in the area to satisfy the ; residents . Mr. Phill.iber, Capital City Water Company, said that his ;Company has nothing to do with the operation of Water District No.2 ':or their distribution center. They are just furnishing water to Capital ,,them. City { Mayor Hyder stated that the Council needs a legal opinion from Water ,,the City Attorney in regard to waiving the 7% Gross Receipts Tax. Company. Councilman Rackers moved that the Council meet with both Water : Districts and Mr. Philliber. Motion passed . - - - `A request was received from Jim Hofmann to lease property (east of Lease - .Jefferson City) owned by the City of Jefferson (approximately 100 City acres) for $3,050, to be paid on or before December 15, 1978. owned Mayor Hyder stated that the Chamber of Commerce plans to take property, over the property as soon as it is acquired by the City and pay the City h%+ interest annually. They would take care of leasing the :.property. Councilman Borgmeyer stated that it should be advertised for ,bids . .A petition was received from residents requesting paving and Petition- ;guttering of Minnesota Street between Holly and Laurel, under the Street ' Sales Tax Capital Improvement Program. Improvement. Councilman Borgmeyer moved that the matter be held up until he and Miss McDowell meet with residents of Holly and Laurel Streets . ,Motion passed. - - - - - - - - - - iPatitions were received from residents of Nelson Drive, protesting Director of the rezoning of property east of Nelson Drive and south of the Rex Planning and Whitton Expressway, owned by Mr. Fred Rost, Jr. , Mr. Seth Evans , Code Mr. Frank Twehous and others , from RS-3 single family, to S-Special Enforcement . Zoning The Plat was referred to the Planning and Zoning Commission. : Commission. - - - - - - - - - - ;' Councilman Borgmeyer, Chairman of the Accounts , Claims and ;' Personnel Committee, presented the following report: ;:A meeting of the Accounts , Claims and Personnel Committee was held Accounts, on Thursday, November 17, 1977, in the Council Chamber at 7:00 P.M. , Claims and 1with all members present . Also present were: Michael Bates , Personnel ,; Director of Public Works ; Larry Bates , Street Commissioner; Tom Committee ;' Benton, Director of Planning & Code Enforcement ; James Locke, Sewer' Report . ; Commissioner, and Jim Hartley, Parking Authority Supervisor. The following items were discussed: ., Item 1. Mr. Benton presented an Organizational Chart for the " Department of Planning & Code Enforcement. After some discussion, Dr. Brant moved the approval of appointment of Supervisor of : Building Regulations, at a starting salary of $14,000.00 per year. , Mr. Hartsfield seconded the motion. Motion passed unanimously. i1Item 2. Restoration of vacation of sick leave and vacation for striking employees . Mr. Hager moved that all employees who have jworked one year from the strike date have all seniority restored. ilNo vacation or sick leave would be retroactive. Mr. Hartley presented two items that were omitted from the ; budget . Dr. Brant moved for approval of a full-time , aintenance Man for the Parking Authority at a starting salary of ;'$650.00 per month. The motion was seconded by Mr. Hager. Motion !!passed unanimously. Mr. Hager moved that the position of Meter Clerk-Clerk Typist ,be established at a starting salary of $600.00 per month for a "probationary period of six months . After that period the Department; i'Head could approve the salaryy of $650.00 per month if the person isj 'qualified. Motion seconded by Mr. Hartsfield. Councilman Borgmeyer moved that the appointment be approved. (Motion passed. Housing A communication was received from the HousingAuthority, requesting j Authority;!Council approval to condemn the Louis Bredeman Property located at 11209-215 Bolivar Street . I� Councilman Borgmeyer moved that the request be granted. ;Motion passed. - - - - - - - - - - Street ;'Councilman Gordon, Chairman of the Street Committee, presented the Committee, following report: Report ., �A Street Committee meeting was held prior to the November 21, 1977, 1 ;Council meeting, with Members Borgmeyer, Hager and Robinson present,i along with Chairman Gordon, Street Commissioner Bates and the Public" 'Works Director. The Street Committee requested the approval for promoting ;,Vernon Walthers from Maintenance II to Foreman. This would be a i,salary increase of 134� per hour from $4. 83 to $4. 96 . Police;;the following report: Committee,i Report:The Police Committee met with Col. Patton at Police Headquarters at ; ' 7: 30 P .M. , Tuesday, November 15, 1977. Present were Members "McDowell, Hartsfield and Whitecotton. Members Brant and Wildhaber ;were excused. Also present were Mr. Tom Benton, Mr. Jablonski and i 'Mr. Brzuchalski, A general discussion with a number of questions by Committee '!members and Mr. Benton. followed Mr. Jablonski' s presentation of :,the proposed final sketches of the interior and exterior, and the '(outline specification of the proposed Police Building. I� The interior sketch met with general approval subject to some minor changes to be worked out between Chief Patton and Mr. (Jablonski. l; The exterior design and outline specifications were also j (generally acceptable with some reservations as to overall costs and !+ ,Item twelve of the specifications "Facia a. The members and Mr. Benton would like fi Ito see samples of the metal and if possible some photos of building with this exterior treatment, which forms an overhang. I The Committee agreed to meet again .on November 22 to prepare . for the presentation of the building plans and specifications to it ';(the Committee of the Whole for its consideration, together with the ;, j�Police Committee approval and recommendations . (I might add that in my opinion the exterior design of the building 'with the landscaping did present a very pleasant appearance, howevex: the new structure and the Old Jail when viewed in perspective, are ;! Councilman Whitecotton, Chairman of the Special Committee on Furniture and Fixtures , presented the following report: iYour Special Committee on Furniture and Fixtures for City Depart- ments, with Members Borgmeyer and Whitecotton present, met with i1 ! Chief Willmeno at 1:00 P.M. , Tuesday, November 8, 1977. Mr. Wild- 1haber was unable to attend the meeting but does agree with the action taken. Following a trip to Fire Stations 3 and 4, the Committee ' approved the purchase of six overstuffed chairs at $100.00 each to replace a badlyy worn lounge at each of the Stations 3 and 4. These '` chairs are to be obtained locally rom two prospective suppliers . :Special !{ The balance of the $900.00 appropriation will be used to P to Committee on : purchase 10 or 12 straight chairs from Surplus Property at $25.00 Furniture and leach. `Fixtures At the request of Chief Wilheno, Mr. Borgmeyer made some Report. 11suggestions on the correction of seepage that was creating some ;; interior and exterior damage at each of the Stations . E. "Buck" .Robinson. Also ; present were Thomas H. Benton, Director of Planning, and Kevin ;,Roods , Planner. { The following items of business were transacted: �j 1. The application of Fred Rost, Jr. , Seth Evans and Frank +Twehous, to rezone property located cast of Nelson Drive and south , of the Rex Whitton Expressway, from RS-3 (single family) , to RD + (duplex) , RA (multiple dwelling) , C-1 (neighborhood commercial) , (rand C-2 (general commercial) , was presented by Fred Rost 'r. Mr. Rost presented a preliminary plan for the entire sixty (to) acres , showing a combination of townhouses, apartments, condominiums , Planning and offices and retail sales areas. Zoning {' A petition bearing twenty-three (23) signatures was "Commission {submitted in op osition 'to the application. Mr. Herb Lam of 615 :Report. ;Nelson Drive, Miss Estelle Kauffman of 709 Nelson Drive, and Mr. , John Gray of 612 Nelson Drive, spoke in opposition to the applica- tion. At the suggestion of Mr. Benton, the applicants requested that ± the a plication be changed to request a S (special development) request S q ; district. Mr. Dudenhoeffer moved that the re for a (special !! development) designation be approved. The motion was seconded by tj Mr. Caplinger and passed, with Mr. Rost abstaining. The applicants ,, were instructed to prepare the preliminary plan for submission to ` the Commission. 2. The application from Windsor Investment Corporation to 1rezone property located south of Buehrle Drive from RS-2 (single Ifamily) , to S (special development) was presented by Louis Vetter. ! The application ;requested rezoning of property located at the intersection of U.S. "50 and Country Club Drive, from RS-1 (single family) to C-2 11(neighborhood commercial) . Caplin or to rezone the property shown on the attached f ' sketch (Exhibit "A ) from RS-1 (single familyy) to C-4 (planned commercial) . The motion to second was made by Mr. Dudenhoeffer ;; and it passed with Mrs. Munzell voting Nay. i 4. The application of Mrs . Mary Cohen, to rezone Lots" No. 29, t 309 31 and 32, of the Second Replat of Vista Place, from RD(dupplex) , to C-2 (general commercial) was approved with the motion made by i ; Carolyyn McDowell and seconded by Mrs . Munzell . 5 . Wooded Trails Subdivision; Section 3, was approved subject !` Ito final review and approval of the Department of Planning and Department of Public Works . The motion was made by Mr. Caplinger Planning; and seconded by Mr. Dudenhoeffer. and 1 6 . Motion , passed. - - - - - - - - - - i The following report of the Parking and Traffic Commission was 'presented to the Council: j ;The Parking and 'Traffic Commission meeting was held November 10, 1 1977, 7:30 a.m. , at the Police Station, with all members present :'except Jim Whaley with an excused absence. The Commission made the following recommendations: �I 1) The 'Commission approved the relocation of the eastbound j bus stop on High Street from the Southwest corner of Bolivar and ,:West lfiglt Street to the Southeast corner of Bolivar and West High ,Street . 2) The Commission approved the removal of parking along both ,sides of Jackson Street south from East Dunklin for a distance of II Parking 50 feet. and 3) Ron Forck appeared before the Commission in regard to Traffic iparking problems at the Employment Security Office in the area of Commission ;iJackson and Dunklin. After considerable discussion the Commission Report. removed a portion of the one hour parking restriction (Section ,+ 110.140 (41))along the South curb of Dunklin a distance of 1401 iieast of the East curb of Adams Street . 4) The Commission approved the including of skate boards in ! ilSection 7140, Paragraph 1 and 2 and Section 7.145 of the Parking ;!and Traffic Code. I� 5) Motion was made carried to repeal Paragraph 1 of Section I 119.080 of the Parking and Traffic Code. j li 6) The Street Department was requested to repaint the inter- jsection of High and West Main and to review the signing of the 11Thompson-Southwest Boulevard intersection. �? 7) Councilwoman McDowell appeared concerning traffic condi- ,I � tions at the intersection of Route C and Southwest Boulevard and j !:Jefferson Street and Southwest Boulevard. ' I�Their request was referred to the Police Department and the Depart 1{meat of Public Works for an investigation of sight distance 1problems with the Departments reporting to the Commission at the iinext meeting. if 3) A representative appeared before the Commission from Community Park -Village requesting two stalls of hourly parking 11along the south side of Elm Street. His request was held over for additional study to be acted on at the next Commission meeting. 4) A request to remove parking on one side of Meadow Lane was ' returned to Mr. Lester Cole. Mr. Cole was requested to return to Parking and 'the Commission with a petition to determine which side parking Traffic 'shall be removed from. Commission The Commission denied the following; Report. ( 1) A request to relocate bus stop from Southeast corner of ;High and Jefferson to the Southwest corner. yE 2) Request for. protected left turn and protected walk at ;(Madison and High Streets . 3) Request to make Beck Street two-way traffic. Motion passed. - '!The following report of the Parking Authority was presented to the Council: ,The Parking Authority met at 7: 30 a.m. , Tuesday, November 15, 1977' ;, 1,with Robert Schulte, Vincent Borgmeyer, James Thomas , Wilben Dill., Mike Bates and James Hartley present. Mr. Robinson was out of town. ;Charles Czarlinsky was absent. Roger Verslues and Bill Boes. attended the meeting. 1. Mr. Buescher made a request to purchase part of Lot No. 5, !which is adjacent to his property, The Authority. rejected the , request on the grounds of demand for additional parking in the area ,'! 2. After much discussion over the repairs that Linhardt i�Construction Company has been making on the Garage new addition, it l. was decided to give him a deadline of Thanksgiving for completion land two days to do it in. If the work is not completed with the two day period the ( contractor would be charged for the parking space revenue which (would be lost through repairs past the deadline. ;I The motion was made by Borgmeyer and seconded by Dill. 3. On a motion by Borgmeyer and seconded by Thomas , $7,500 for 'landscaping of -city. parking lots was set aside. Attempts would be made to plant the trees before winter. 4. On a motion by Borgmeyer, seconded by Dill., a rate of 'Parking $15.00 per month was recommended for a lot on 400 Broadway Street. Authority 5 . On a motion by Borgmeyer, seconded by Dill $50,000 would Report . ,be invested from each fund in U.. S.Treasury Bills . (I months) , 6. On a motion. by Borgmeyer seconded by Dill, proceed with repairs to the drains in the parking garage. $750.00 was the only bid received. 7. A decision on a request from the State Division of Design i !,and Construction for a lower rate on a temporary lot in millbottom was held over. ;{ 8. East Elm Councilman Brant again questioned the Director of Public Works in Street regard to the rock-fill area on East Elm Street. He was informed Access that it is State owned property and for him to contact the Highway Patrol and Highway Department. Adjournment Councilman Hager moved that the Council adjourn, under the rules .
