McDowell , Ortmeyer, Whitecotton and Wildhaber. y ;; Councilmen absent: None. j A quorum was declared present . f� The minutes of the meeting of April 15th were approved as received. ;; - - - - - - - - - - f 'IA Public Hearing was held on the rezoning of part of the requested '130 acres known as the John Ihler Farm, lying east of Route 179 and ! i' south of Boonville Road, adjoining the Universal Products Plant, ' from RS-1 to M-1 . Public E Michael Riley, Attorney for Universal Products, stated that Hearing �ithey had met with residents . The proposed building will be for a �lparcel service and there will be at least a 500 foot buffer zone from the last street. The residents wanted an agreement that there ; would be no change for fifteen years, which his client could not approve. Irvine Appleton, Ron Haril and Elwyn Shikles and Joe Thomas, residents of Wesley Drive, appeared in opposition to the rezoning. They stated that all neighbors opposed rezoning and wanted the areall to remain residential . - ! Newborn, representing concerned Pastors in the East Miller �1Street Development, stated that they had met with homeowners regard .ling the project. Many desire to remain in area and the majority East .have the feeling that the area should be rehabilitated, with Miller Ijadequate parking area for the city heavy equipment. They also Street :;request public discussion for plans now pending with the Mayor and Development. ;Council participating. p ~ j4he following statement from the Junior High Group of the First i,Baptist Church was presented to the Council: The Junior High Church Training Group at First Baptist Church ` in Jefferson City are interested in giving our support to the ,Juvenile Attention Center. We think the new facilities will ijprovide better care for those who need to reside there. This agenc} ilia an important one for our community. It is meeting the needs of ('kids who need help. If it was not for the center, the kids would Juvenile 1Inot have any place to go. The center is important in giving Attention .guidance, counseling, support and love for the children from broken Center. homes or families who can not or will not take care of them. We appreciate the very responsible and dedicated people on the (;staff and the many volunteers who give much of their time and effort to these kids and to this center. Authority, , A request was received from Sheldon Gentry to rezone property along Planning and Ellis Blvd, , from RS-2 to RA . Zoning The request was referred to the Planning and Zoning Commission.Commission. w - Councilman Gordon presented a petition from property owners , requesting the Council to form a Sewer District , in the 800 block Street of Boonville Road. Committee Councilman Gordon moved that the petition be referred to the IIII Street Committee. Motion passed. _ _ _ _ _ _ ! Councilman Barry, Chairman of the Insurance Committee, presented the following report: Insurance !; Committee The Insurance Committee met on April 22, 1975, at the Colonnade Report . Restaurant, at noon, with all Committee members present, being: Barry, Borgmeyer, Gordon. Also present were City Attorney James Dalton, and Thomas Naught of Naught, Naught & Jones Insurance (Agency, Inc. The first matter of business was to clarify the situation with ! respect to whether or not the members of the Police Department are 1covered under the existing City policy for such things as claims of 1Ifalse arrest. Mr. Naught reported to the Committee that the � present City coverage extends to Policemen for false arrest claims �when on duty and also when off duty, when acting within the course : and scope of their employment. The Committee reviewed the existing situation regarding bonds ! for City employees and officials and decided to instruct the City , Clerk to notify the various bonding companies that the City desires ;; to extend all bonds presently due until June 1, 1975. The Committee : then determined that there could be a significant savings in bond premiums by covering all of the officials under a blanket bond, and': the Committee recommends that specifications be prepared so that �i f) 323. The Fire Committee met May 5 , 1975, at 7:45 o'clock, with all members present. Motion made by Mr. Hager to have Fire Chief meet with Evans "and Associates to further study the proposed costs of the exterior ,. finish of the new Fire Station and report back to the Committee. Present were Members Borgmeyer, Gordon, ! :' Wildhaber and Whitecotton; Mr. Rackers , Director of Public Works , i 'was also present. j A petition to pave Boonville Road from Norris Drive to Belmonti� Street, without the usual curb and guttering, was denied on motion !! of Mr. Borgmeyer, seconded by Mr. Wildhaber. j Mr. Gordon reported severe erosion in the backyards of homes „ on Geneva Street and Southern Air Drive, possibly created by water ►I !, blockage in a small stream draining that area. After a brief I: ' discussion, Mr. Borgmeyer moved that the Public Works Department " 1remove the blockage and that the Director examine the area and make '' a recommendation on the possible elimination of the erosion. The petition to curb and gutter Hutton Lane, between Express- view Drive and the dead end, with the necessary grading, paving andj' drainage, under the Sales Tax Capital Improvement Program, at a 'maximum cost of $5.00 per front foot to the abutting property A(owners ; together with an increase in the width of the proposed 3000 foot extension of this street to 36 feet as opposed to the original 32 foot width, at an estimated cost of $10 000.00, was approved on Street motion of Mr. Borgmeyer, seconded by Mr. Wildhaber. Committee A drainage problem on Oak Street and a drainage block on Karen :Report. � Street was discussed with Mr. Rackers stating that he would check and attempt a remedy. Whitecotton, Chairman The Street Committee met in the Council Chamber at 7:00 P.M. , Monday, May 5th, 1975. All members were present. Mr. Rackers, Director of Public Works , was also present. After a discussion on the proposed sale of five City owned lotd numbered 302 through 306 at the intersection of California Street and Ellis Blvd. , Mr. Borgmeyer moved that the Lots be advertised for sale to the highest bidder. The motion seconded by Mr. Gordon prevailed. Action on the proposed construction of a double 6 X 6 Box Culvert in a creek in the Landwehr Subdivision was deferred to the next Street Committee meeting. The disposition of a 1930 model Motor Grader and the purchase of a later model demonstrater grader for use of the Public Works Department was deferred to a more definite future need. I Mr. Bob Cureton appeared before the Committee and asked for i assistance in the correction of a drainage problem on Poplar, at the rear of the Freeman Mortuary property. On motion of Mr. Borgmeyer, seconded by Mr. Wildhaber, the Director of Public Works is to determine a possible correction and make a recommendation to the Committee. On motion of Mr. Barry, seconded by Mr. Wildhaber, the Director of Public Works was authorized the employment of twelve (12) student summertime employees at the minimum wage scale. Mr. Borgmeyer reported that the Memorial Baptist Church, 1120 Madison Street, had made inquiry as to the City resurfacing their ;:Street private drive due to its being used as a turnaround by Still licommittee Hospital traffic exiting to go south bound on Route # 54. That the area described above is insanitary, blighted, deteriorated or deteriorating and is appropriate for development ofi,11 the character contemplated by the Housing and Community Development ' Act of 1974 and qualifies as an eligible project area under Section 99-320, Revised Statutes of Missouri for 1969. 2. That the financial assistance available under the Housing and Community Development Act of 1974 is needed b� Jefferson City and Cole County, Missouri, to finance the undertaking of the proposed roject . That the joint one year Community Development Program presentec t� the Jefferson City City Council and the Cole County Court by the designated Community Development Agency is hereby approved and the Community Development Agency is authorized to file and to incur i costs in the preparation of an application for financial assistance ) under the Housing and Community Development Act of 1974. 4. The Community Development Agency Director is authorized to carry out all functions under the Housing and Community Development Act of 1974 and to sign, when so authorized, for and on behalf of the City of Jefferson and the County of Cole all certifications, assurances and documents as may be required by said Act or, to present to the Chief Elected or Executive Official or other appro- priate official of either of the applicant jurisdictions all such documents for signature, execution, attest, certification or 'I assurances as may be required by said Act. 5 . If any portion of the authority herein approved or granted should be hold to be invalid such holding shall not invalidate the remaining portions of this Resolution. 6 . Neither this Resolution nor Community Development activities hereby approved shall in any way affect Progress Urban Renewal Project, Mo. R-45, except improvements specifically designated in the Community Development Plan for inclusion therein. Councilman Wildhaber stated that the map, as submitted, with the Resolution be changed by eliminating a park in the plan so that displaced residents could either have their old home moved or build in the area. Ted Herron, Executive Director of the Housing Authority, showed the revised map to the Council. Councilman Barry moved that the Resolution be amended as follows : "Page 2 - Paragraph 4, line 3, by inserting 'When so authorized' between sign and for". Motion passed. Councilman Barry then moved that theResolution, as amended, be adopted. The Resolution was adopted by the following vote: Councilmen voting Aye: Barry, Borgmeyer, Brant, Gordon, Hager, Manes , Ortmeyer, Whitecotton and Wildhaber.1 Councilmen voting Nay: McDowell. Councilmen absent: None. Councilmen Hager stated that the Council was indebted to Councilman Wildhaber for solving the problem and asked that he be given a hand. Councilwoman McDowell introduced the following Resolution: BE IT HEREBY RESOLVED by the City Council, City of Jefferson, Missouri, that the Missouri Power and Light Company make the following installations in accordance with recommendations presented to the City Council by its Committee on Public Utilities and adopted by said City Council on May 5, 1975. 328. __Regul.ar-Council. 1. Install necessary street light at intersection of the north-south and the east-west alley in the 1200 block rear West High Street. 2. Install necessary street light at the rear of 200 block Resolution East High Street (Approximately Dallmeyer's Jewelry Street Store) for the benefit of a City Parking Lot. Lights. 3. Install 18 fixtures on the curb line replacing 37 fixtures in the center of the street in the Valley Park Subdivision. Adopted: May 5, 1975 /s/ Robert L. Hyder, President of the Council.
